Section 1. Authority. The Wyoming Community College Commission is required by W.S. 21-18-202(a)(xiii) to establish a standardized tuition structure for the State Community College System.
Section 2. Applicability. This chapter governs the tuition charged at all districts in the Wyoming Community College System. Districts which fail to comply may have part of their state appropriation withheld.
(a) The tuition waiver policy is effective July 1, 1994, except for nonresident students who received tuition waivers for the 1993-94 school year, and these waivers may be continued through the 1994-95 school year.
(b) A tuition waiver is a college-funded tuition grant unit which may not exceed the current resident tuition rate and is supported by a budget line item.
(c) Tuition waivers, including those funded by state, local or institutional revenue, may not exceed twenty (20) percent of total tuition revenues received in the current fiscal year.
(d) Tuition shall be recorded as revenue for every student. Waivers shall be recorded as expenditures in the appropriate NACUBO programs.
(e) No student shall receive more than one (1) tuition grant unit during any given semester.
(f) No tuition waiver will exceed the resident tuition rate.
(a) Prior to the biennial budget hearings, or as otherwise needed, the State Commission will conduct a study of the tuition structure of the State Community College System. The study will include a comparison of tuition charged by districts for resident and nonresident students with those of similar community colleges located in surrounding states, the region, and the nation, and other information as needed.
(b) At or prior to the biennial budget hearing, or as otherwise necessary, the State Commission will establish the tuition rate to be charged for resident and nonresident students for the following two (2) academic years. Nonresident tuition must be at a rate not less than three (3) times the amount charged residents, except as provided for by statute or State Commission Rules.
(c) The State Commission may review the tuition structure at any time for the purposes of increasing or decreasing the established rates.
(d) Nonresident students shall pay the appropriate rate of tuition regardless of the number of hours taken in any term. The State Commission may grant exceptions.
(e) All fees will be clearly identified. Each student will be informed of the amount and purpose for each fee. Systemgenerated student statements shall contain a detailed breakdown of all fees. All fees will be spent only for the identified purpose. Expenses in a fee area will be at least the amount of fees generated for that area.
(a) This residency policy shall be published in catalogs of the college districts.
(i) A student previously classified as a nonresident may be reclassified any time prior to the end of the published refund period of any term in which he/she qualifies.
(ii) A student who is classified as a resident by one college will be considered a resident at all colleges.
(b) Classification Procedures.
(i) Residence classification shall be initiated for each student at the time the application for admission is accepted and whenever a student has not been in attendance for more than one (1) semester.
(ii) Only individuals or their legal dependents who are U.S. citizens or are in an immigrant status may qualify for residency.
(iii) Community college districts may require applicants to supply information to document residency status.
(c) Residence. Any of the following may be used by a student and would result in an individual being classified or reclassified as a Wyoming resident for tuition purposes:
(i) A graduate of a Wyoming high school or recipient of a GED in Wyoming who enrolls in a community college within twelve (12) months of either high school graduation or GED completion;
(ii) An individual who can provide written verification that he/she has lived in Wyoming continuously for one (1) year prior to enrolling;
(iii) A legal dependent under the age of 24, or a spouse of a resident of the State of Wyoming who qualifies as a resident based upon this policy;
(iv) A legal dependent under the age of 24 of a Wyoming Community College graduate;
(v) A student who marries a Wyoming resident shall be granted resident classification at the beginning of the next term following the marriage;
(vi) An individual on active duty in Wyoming with the United States Armed Forces, Wyoming National Guard or Reserves, and his/her legal dependents;
(vii) An individual who can provide written verification from an employer that he/she will be employed in Wyoming for an anticipated period of not less than seven (7) months, and such employment is the principal means of support; (viii) Persons temporarily absent from the state due to military service, attendance at educational institutions, or other types of documented temporary absences will not have their resident status voided by such absence.
(d) Exceptions. In accordance with W.S. 21-17-105, an individual who does not reside in Wyoming may be considered a resident for tuition purposes if he/she meets all of the following criteria:
(i) Has been employed in Wyoming for at least seven (7) months, and such employment is the applicant’s principal means of support;
(ii) Pays Wyoming taxes as required by law;
(iii) Resides in a state with a similar law; and
(iv) Is willing to submit an affidavit to the above.
