Chapter 6: Income Withholding

CSE shall use the federally approved uniform notice to payer and income withholding order and issue it to an employer within two (2) business days of receipt of employment information. This issuance may be by electronic means.
(a) CSE may issue an administrative income withholding order or National Medical Support Notice if a court or tribunal has entered a support order, which may include health care coverage.
(b) CSE may issue an immediate administrative income withholding order if an arrearage occurs, in child support, which may include health care coverage.
(c) This administrative order shall be in a form approved by CSE and signed by the Title IV-D Director.
(d) The administrative order shall be sent to the obligor via first class mail to the obligor's last known address, with a Notice of Administrative Income Withholding advising the obligor that:
(i) Within 20 calendar days of the date printed on the notice, the obligor may request in writing an administrative records review;
(ii) CSE shall review the records and respond to the obligor within 30 calendar days with the results of the administrative records review; and
(iii) The obligor may appeal the order to the appropriate district court.
CSE, upon entry or modification of any support order, shall request the court to issue an immediate income withholding order.
All Title IV-D payments shall be made to the State Disbursement Unit (SDU) and all non-Title IV-D income withholding payments on orders entered after January 1, 1994, shall be made to the SDU.
