CHILD SUPPORT ENFORCEMENT DIVISION CHAPTER 12 RECOVERY OF RETAINED SUPPORT
(a) If a POWER recipient receives child or spousal support payments directly while a POWER case is active, such payment must be remitted to the IV-A agency. The assignment of support rights covers all support due to any person in the POWER recipient’s household who is on the POWER grant and applies to past due support owed at the time the POWER grant went into effect. Therefore, the recipient may not retain any support payment made on behalf of any person who is on the POWER grant.
(b) If the IV-D agency discovers a POWER recipient has retained support assigned to the state, DFS shall verify child support has been retained by the recipient
(c) If the IV-D agency determines a support payment has been retained by a current recipient, the information will be transmitted to the recipient’s Economic Assistance Specialist (EAS) for IV-A recovery.
(d) If the IV-D agency determines support payments have been retained by a prior recipient, the information will be transmitted to the IV-A recovery group at the state central office.
If CSED determines an obligee was paid erroneously, the obligee is personally liable for the return of any amounts received.
