Section 1. General Requirements. A provisional license shall not be issued until the applicant has provided satisfactory evidence to the Board that they;
(a) are of majority age; and
(b) have no felony convictions, and no misdemeanor convictions involving moral turpitude, although exceptions to this requirement may be granted by the Board if consistent with the public interest; and
(c) meet the educational requirements, and agree to abide by the supervision requirements established in these rules.
Section 2. Education. The applicant shall have received a master's or doctorate degree in the discipline in which they are seeking licensure from an accredited program and institution of higher education, which is professional in content and which meets the academic and training content standards as established in Chapter 3, Section 2.
Section 3. Supervision. The applicant and clinical supervisor shall, by signed and notarized agreement, mutually consent to comply with the supervision requirements established herein. The supervision agreement must be approved by the Board. Any changes in the agreement must be submitted in writing to the Board, within ten (10) days of the change, for approval.
(a) Individual face-to-face supervision shall be obtained at a ratio of one (1) hour for every thirty (30) hours of experience in such a manner that the hours are reasonably and uniformly distributed over not less than twelve (12) months or more than thirty-six (36) months. Provisional licenses are not renewable, but the Board may extend the license period upon a showing of good cause.
(b) Supervised clinical experience obtained in another jurisdiction may be acceptable if approved by the Board.
(c) Provisional Licensees shall be eligible for examination.
Section 4. Qualified Clinical Supervisor. For the purposes of this chapter, the term 'clinical supervisor' shall mean a professional meeting the qualifications of a clinical supervisor established in Chapter 3.
(a) The clinical supervisor shall have been licensed for a minimum of two (2) years and shall have had four (4) years of professional experience in their discipline prior to beginning supervision.
(b) The Board may require an evaluation of the qualifications and roles of any clinical supervisor and may approve or disapprove supervision at its discretion.
(c) The clinical supervisor shall allow the Provisional Licensee to perform independently only those functions for which the Provisional Licensee has training and experience.
(d) The clinical supervisor shall keep records verifying the training and evaluation of the Provisional Licensee, including the precise nature and number of hours of experience. A supervision report shall be submitted to the Board at least once during the supervision period with a final recommendation due upon completion of the supervision.
(e) The clinical supervisor shall co-sign all reports and correspondence of a professional nature, excluding disciplinary correspondence with the Board.
(f) A clinical supervisor shall not serve as clinical supervisor for more than three (3) Provisional Licensees at any time.
(g) The clinical supervisor assumes ethical responsibility and may be sanctioned by the Board for all acts and omissions of the Provisional Licensee within the scope of the supervision.
(a) The terms 'Provisional Counselor,' 'Provisional Social Worker,' 'Provisional Marriage and Family Therapist' or 'Provisional Addictions Therapist' may be used only after the applicant is granted a provisional license by the Board, and only in conjunction with activities and services that are part of the supervised experience.
(b) In the required professional disclosure statement, the Provisional Licensee shall also provide to every client, full disclosure of the supervised nature of their work, which shall include the name, address and telephone number of their clinical supervisor.
(c) The supervisory relationship must be indicated, and the clinical supervisor's name, address and telephone number must appear on all documents relating to advertisement by the Provisional Licensee.
(d) The Provisional Licensee shall adhere to the applicable code of ethics and standards of practice for their discipline.
(e) Upon receipt of a passing score report on the required examination, and the final recommendation due from the clinical supervisor, the Provisional Licensee's documents shall be presented to the Board for full license approval.
