Chapter 3: Permits to Practice

Section 1. All certificate holders in Wyoming who utilize the CPA designation in any manner and practice public accounting, shall obtain and hold a permit-to-practice issued by the Board.
(a) The applicant for a permit-to-practice as a certified public accountant (CPA) is required to have two (2) years of experience as specified in paragraph (b) of this Section. The two (2) years shall be within the five (5) years immediately preceding the application date. The term 'year' means a minimum of one thousand nine hundred twenty (1920) working hours per year. Part-time experience may be considered at a rate of each hour worked up to a maximum of eight (8) hours within any twenty-four (24) hour period.
(b) The experience as set forth in W.S. 33-3-120(f) shall include tax work and the preparation of financial statements. Tax work includes varied experience in the areas of individual, partnership and corporate income taxes and/or estate, gift, and fiduciary taxes. The preparation of financial statements may include the preparation of compilations, reviews, unaudited financial statements, or audited financial statements in conformity with the standards as outlined in Chapter 6 of the Rules.
(c) The Board shall consider experience gained by applicants applying under the provisions of W.S. 33-3-116 when the experience gained does not comply with the five (5) year requirements of paragraph (a) of this Section when:
(i) The applicant has earned at least two years experience in compliance with paragraph (b) of this Section, and
(ii) The applicant was granted a license to practice in another state and would otherwise be eligible for re-entry into practice in Wyoming to include compliance with continuing education requirements at the application date.
(d) The experience shall be verified by:
(i) A certified public accountant, licensed in the state where the experience was earned, who has acted as resident manager or designated permit holder, or a partner, shareholder or member who has served with the applicant in the local office; or
(ii) Providing representative samples of work performed while obtaining the experience to include copies of tax work and the highest level of financial statements issued.
Certified public accountants rendering professional accounting services shall obtain a Wyoming certificate and permit-to-practice before furnishing these services to corporations, partnerships, individuals, etc., which are domiciled in or are residents of Wyoming when all or part of the services are performed within Wyoming.
(a) applicants applying under the provisions of W.S. 33-3-116 and Section two (2) of the Chapter must provide an official transcript which evidences compliance with the educational requirements imposed by W. S. 33-3-109 and Chapter II, Section 2 of the rules and regulations; or
(b) individuals applying under the provisions of W. S. 33-3-116 who cannot show compliance with the education requirements imposed by W.S. 33-3-109 and Chapter II, Section 2 of the rules and regulations must provide verification of completion of five years experience in the practice of public accounting within the last ten years. The experience shall be verified as outlined in Section 2 (d) of this Chapter.
Section 4. Documentation. The Board reserves the right to request permit applicants provide representative samples of work performed while obtaining the experience required by Section 1(b) of this Chapter.
(a) All permits expire December 31 of each calendar year. Applications for renewal shall be mailed to all permit holders no later than October 1 of each calendar year. Permit fees are not prorated.
(b) Applications for renewal shall be postmarked or received no later than November 1 of each calendar year and be accompanied by the following:
(i) Annual Notice of Form and Scope of Practice form;
(ii) A listing of courses which evidences compliance with continuing education requirements and all certificates of completion for correspondence courses;
(iii) Firm or office registration forms, if applicable; and
(iv) Applicable fees for permit and firm registration.
(c) Extensions. Written requests for an extension may be made to the Board. The Board may grant extension of time for good cause shown if written requests are received or postmarked no later than November 1 of the current calendar year.
(d) Late fees, in addition to the annual renewal fee, of up to one-half (½) of the current annual fee (not to exceed the statutory maximums) may be assessed to all individuals who apply for the renewal of the permit after the deadlines outlined in subsection (b) of this section.
(e) All permits expire on December 31 of each year. The Board shall contact all permit holders who have not submitted complete renewal applications before December 31 and schedule hearings for non-compliance with the requirements of this Chapter.
(f) Upon application for the renewal of a permit-to-practice, all permit holders shall disclose any conviction or a pending charge of a felony in any jurisdiction.
