(a) Pursuant to the authority vested in the Wyoming Livestock Board by virtue of W.S. §11-18-103(a)(v) and §11-32-102, the following rules are hereby promulgated.
(a) The purpose of these rules is to protect the Wyoming livestock industry and general public by establishing procedures for the import, and when necessary Quarantine of Animals and Biologic Agents into the State of Wyoming.
(a) For the purposes of implementing these rules, the following definitions exist:
(I) 'Accredited Veterinarian' means an individual who is licensed to practice veterinary medicine and is accredited by the USDA/APHIS/VS in the state where he or she practices.
(ii) 'Adjacent State Border Property Movement Permit' means a permit issued by the Wyoming Livestock Board, for movement of Animals across the state line waiving certain Animal health import requirements, upon the applicant satisfactorily demonstrating that he or she owns land or has leased land for at least two (2) or more consecutive years that is contiguous with land he or she owns or has leased for two (2) or more consecutive years in an adjacent state.
(iii) 'Animal' means any living vertebrate that is not a human being.
(iv) 'Approved Livestock Market' means a market that is licensed by the Board and the USDA/APHIS/VS.
(v) 'Approved Livestock Market Veterinarian' means an Accredited Veterinarian employed by an Approved Livestock Market.
(vi) 'Aviary and Cage Birds' means captive-reared birds that are adapted to live and breed in an aviary or cage.
(vii) 'Biologic Agent' means any biologic product used for agricultural or veterinary purposes and includes semen and embryos.
(viii) 'Bison' means a domestic ruminant mammal of the genus Bison.
(ix) 'Board' means the Wyoming Livestock Board, state agency 051, whose address is 2020 Carey Avenue 4th Floor, Cheyenne, WY 82002-0051, (307) 777-7515.
(x) 'Bovine' means a ruminant mammal of the genus Bos and crossbred Bovine/Hybrid Animals.
(xi) 'Brand Inspection Form' means an official form issued by the Board used to transfer title of Bovine, Equine and Ovine or an official form issued by an agency in the state of origin that is responsible for Animal identification, listing all of the identification marks of a specific Animal.
(xii) 'Brucella ovis' means a bacteria that causes a disease of Ovine characterized by testicular swelling, inflammation in the epididymis and impaired fertility.
(xiii) 'Brucellosis' means an infectious disease of Animals and humans caused by a bacteria, Brucella abortus.
(xiv) 'Brucellosis Test-Eligible' means all sexually intact Bison and Bovine eighteen (18) months of age and over (as evidenced by the loss of the first pair of temporary incisor teeth). (Presence of the first pair of fully erupted permanent incisor teeth is evidence that the Bison or Bovine has reached twenty four (24) months of age.) All Bison and Bovine that are Parturient or Post Parturient are test eligible regardless of age.
(xv) 'Brucellosis UMR' means the Brucellosis Eradication Uniform Methods and Rules as issued and amended as of October 1, 2003 by the USDA/APHIS/VS. These Rules do not include any later amendments of the UMR past October 1, 2003. Copies of the UMR are available to the public at the office of the Board.
(xvi) 'Brucellosis Vaccination Eligible' means sexually intact female Bison and/or Bovine between the ages of four (4) months and twelve (12) months of age.
(xvii) 'Camelidae' means a ruminant mammal that includes alpacas, camels, guanacos, llamas and vicunas.
(xviii) 'Canine' means an omnivorous mammal of the genus Canis.
(xix) 'Caprine' means a ruminant mammal of the genus Capra.
(xx) 'Certificate of Veterinary Health Inspection' means an official form documenting the health status of an Animal, after being visually inspected by an Accredited Veterinarian, issued at the state of origin. A Certificate of Veterinary Health Inspection is valid for thirty (30) days after issuance.
(xxi) 'Certified Brucellosis-Free Herd' means a herd of Bison or Bovine that has qualified for and has been issued a certificate signed by both the appropriate state Animal health official and by the USDA/APHIS/AVIC signifying that the herd is free of Brucellosis.
(xxii) 'Certified Spay Technician' means an individual who is certified by the state in which he or she resides to spay female Bison or Bovine.
(xxiii) 'Certified Trichomoniasis Negative' means any sexually intact male Bovine which has tested negative to one (1) Official Trichomoniasis Test and two (2) Official Trichomoniasis Retests, has not been used for natural breeding purposes since the official Trichomoniasis Test, and is accompanied by a Certificate of Veterinary Health Inspection from the Certified Veterinarian who conducted the test.
(xxiv) 'Certified Veterinarian' means an Accredited Veterinarian who has been certified to perform Trichomoniasis testing by the Wyoming State Veterinarian.
(xxv) 'Chapter 2 Rules' means official rules promulgated by the Board entitled Vaccination Against and Surveillance for Brucellosis on file with the Secretary of State's Office in Cheyenne, Wyoming.
(xxvi) 'Chapter 15 Rules' means official rules promulgated by the Board entitled Trichomoniasis Rules on file with the Secretary of State's Office in Cheyenne, Wyoming.
(xxvii) 'Commingling' means Animals having direct physical contact. Commingling does not include incidental contact lasting less than 24 hours between Animals off the Premise.
(xxviii) 'Direct Movement' means movement in which the Animals are not unloaded en route to their final destination and not Commingled with another producer's Animals.
(xxvix) 'Equine' means a herbivorous mammal of the genus Equus.
(xxx) 'Equine Infectious Anemia' means a viral disease of Equine causing anemia.
(xxxi) 'Feline' means a carnivorous mammal of the genus Felis.
(xxxii) 'Feral Animal' means an individual of a domesticated Animal species, that has become wild.
(xxxiii) 'Flock' means all Caprine and/or Ovine maintained together on a single Premise or maintained together under common ownership on two or more Premises with interchange between the Premises. Caprine or Ovine maintained temporarily on a Premise for activities such as shows and sales or while in marketing channels are not a Flock. More than one Flock may be maintained on a single Premise provided Commingling does not occur in accordance with the Scrapie UMR.
(xxxiv) 'Foot Rot' means a chronic, progressive disease caused by a mixed infection of bacteria causing lameness and severe tissue destruction.
(xxxv) 'Hatching Egg' means a hard-shelled reproductive body produced by Poultry or Ratites.
(xxxvi) 'High Risk' means any Caprine or Ovine determined by epidemiologic investigation to face an increased probability of developing Scrapie as described in the Scrapie UMR.
(xxxvii) 'Hybrid Animal' means an Animal produced by crossing species or subspecies of Animals.
(xxxviii) 'Immediate Slaughter' means the slaughter of an Animal within three (3) working days at a Recognized Slaughter Establishment.
(xxxix) 'Import Permit' means a number issued by the Board within ten (10) days in advance of any Bison, Bovine, Ovine, Porcine or Yaks being imported. Import numbers shall be obtained by calling (307) 777-7515. The Board may authorize an Import Permit prefix to out of state livestock markets for the creation of their own Import Permits with written approval of the Wyoming State Veterinarian.
(xl) 'Interstate Equine Health Movement Agreement' means a written agreement between the Wyoming State Veterinarian and an Equine owner that allows for the movement of Equine between Wyoming and an adjacent state. The agreement allows Wyoming origin Equine to return to Wyoming without a current Certificate of Veterinary Health Inspection after having spent fifteen (15) days or less in the adjacent state.
(xli) 'Interstate Livestock Health Movement Agreement' means a written Agreement that allows for the movement of Bison, Bovine, Equine used for herd management purposes, and Ovine between Wyoming and an adjacent state. This Agreement shall be approved by state Animal health officials in the state of origin and state of destination prior to movement.
(xlii) 'Johnes Disease' means a chronic, debilitating disease of ruminants that is caused by a bacteria, Mycobacterium avium paratuberculosis.
(xliii) 'K Brand' means a 3' X 2' or larger hot iron, freeze, or bleach single K character brand, placed on the left hip near the tail-head of a female Bison or Bovine being fed in a K Lot.
(xliv) 'K Lot' means a feedlot that is established by a contractual agreement (K Lot agreement) with the Board and feedlot operator that allows for the feeding of non Brucellosis vaccinated, female Bison or Bovine in a feedlot based upon the operator's compliance with the provisions of the agreement. All Bison and Bovine shall be identified with Official Individual Identification and a K Brand upon arrival. All Bison and Bovine shall be sent to Immediate Slaughter or to an out of state destination that will accept non vaccinates. All Brucellosis Test Eligible Bison or Bovine imported into Wyoming from a state or country with less than a Brucellosis class free status shall test negative for Brucellosis prior to entry.
(xlv) 'Licensed Veterinarian' means an individual who is licensed to practice veterinary medicine in the state where he or she practices.
(xlvi) 'Mustelid' means a domestic carnivorous mammal of the genus Mustela.
(xlvii) 'National Poultry Improvement Plan Form VS 9-3' means a form used to document interstate sales and movement of Hatching Eggs, Poultry and Ratites.
(xlviii) 'Official Adult Vaccinate for Brucellosis' means a female Bison or Bovine that is over twelve (12) months of age when vaccinated using the approved vaccination procedure outlined in the Brucellosis UMR as issued and amended as of October 2003, only after written approval is issued by the Wyoming State Veterinarian and the USDA/APHIS/AVIC. The female Bison or Bovine shall be properly identified as an adult vaccinate by Official Individual Identification, and by a vaccination tattoo or brand, and shall be reported on the appropriate certificate to the appropriate State and Federal Animal health agencies.
(xlix) 'Official Calfhood Vaccinate for Brucellosis' means a female Bison or Bovine that has been inoculated between four (4) months and twelve (12) months of age with a USDA/APHIS/VS and Board approved Brucella vaccine, by a State or Federal representative or an Accredited Veterinarian using the approved vaccination procedure outlined in the Brucellosis UMR as issued and amended as of October 1, 2003. The female Bison or Bovine shall be properly identified as a vaccinate by Official Individual Identification, and a vaccination tattoo, and shall have been reported on the appropriate certificate to the appropriate State and Federal Animal health agencies. Verification of official vaccinate status requires evidence of the vaccination shield.
(l) 'Official Individual Identification' means any form of identification approved by USDA/APHIS/VS that identifies the Animal to the Flock or herd of birth or origin.
(li) 'Official Spay Tag' means a permanent, blue metal identification ear tag with the word 'spayed' stamped or engraved into the metal, placed in the right ear, signifying that the animal has been spayed. These tags are available only to Licensed Veterinarians from manufacturers approved by the Wyoming State Veterinarian.
(lii) 'Official Trichomoniasis Retest' means an Official Trichomoniasis Test conducted at least seven (7) days, but not more than twenty-one (21) days, after any previous Official Trichomoniasis Test.
(liii) 'Official Trichomoniasis Test' means a test conducted on a properly cultivated sample to detect the presence of the protozoa Tritrichomonas foetus.
(liv) 'Ovine' means a ruminant mammal of the genus Ovis.
(lv) 'Parturient' means an Animal that is visibly prepared to give birth or within two weeks of giving birth.
(lvi) 'PEMMP' means a post exposure management and monitoring plan which is a written agreement signed by the owner of a Flock, any Accredited Veterinarian employed by the owner, and a State or USDA/APHIS/VS representative in which each participant agrees to undertake specified actions to reduce the risk of the occurrence of Scrapie and to monitor for the occurrence of Scrapie in the Flock for at least sixty (60) months after the last High Risk or Scrapie Positive Caprine or Ovine was removed from the Flock or after the last exposure of the Flock to a Scrapie Positive Caprine or Ovine unless the monitoring time is otherwise specified by a State or USDA/APHIS/VS representative. The Flock owner must provide the facilities and personnel needed to carry out the required elements listed in the plan.
(lvii) 'Porcine' means an omnivorous mammal of the genus Suis.
(lviii) 'Port of Entry' means a facility operated and staffed by personnel from the Wyoming Highway Department where people importing Animals must stop and provide necessary documentation regarding the health status of the Animals.
(lvix) 'Post Parturient' means an Animal that has recently given birth.
(lx) 'Poultry' means fowl Animals commonly referred to as chickens, ducks, geese, guineas, peacocks, pigeons and turkeys.
(lxi) 'Premise' means an identifiable physical location that represents a unique and describable geographic location where grazing operations exist.
(lxii) 'Pseudorabies' means a virusal infection primarily of Porcine, but occurring incidentally in most other species. The disease is a USDA/APHIS/VS program disease under strict regulation.
(lxiii) 'Quarantine' means an official document, issued by the Wyoming State Veterinarian or his or her authorized representative, that restricts the movement of specified Animals and prohibits their Commingling, their being slaughtered, turned loose, removed, or permitted to escape, and sets forth requirements regarding their testing; or qualification for import and Quarantine release. The Animal owner or owner's agent is responsible for all liability and expense associated with a Quarantine.
(lxiv) 'Rabies' means an acute, rhabdoviral encephalomyelitis that can affect any mammal. Once clinical signs appear, it is invariably fatal. Transmission is by introduction of virus-laden saliva or nervous tissue into tissues, usually by the bite of an infected Animal.
(lx) 'Ratite' means an avian Animal that includes emus and ostriches.
(lxvi) 'Recognized Slaughter Establishment' means any slaughter establishment operating under the provisions of the Federal Meat Inspection Act, (21 U.S.C. 601-695) including all amendments as of August 2006, or the Wyoming Food Safety Rule found at Chapter 1 Purpose, Variances, Definitions, Demonstration of Knowledge, and Health Status as promulgated and amended by the Wyoming Department of Agriculture as of August 2003. This does not include any later amendments past August 2006 and August 2003 respectively. These documents are available to the public at the office of the Board.
(lxvii) 'Recreational Event' means events commonly referred to as exhibitions, fairs, gymkhanas, rodeos, shows and trail rides.
(lxviii) 'Reportable Disease' means any disease that is on the Wyoming State Veterinarian's list of Reportable Diseases pursuant to W.S. §11-19-102 that must be reported when suspected or diagnosed.
(lxix) 'Scrapie' means a nonfebrile, transmissible, insidious, degenerative disease affecting the central nervous system of Ovine and Caprine and causing a spongiform encephalopathy.
(lxx) 'Scrapie Positive' means any Caprine or Ovine that has tested positive on an official test for Scrapie.
(lxxi) 'Scrapie UMR' means the Scrapie Eradication Uniform Methods and Rules as issued and amended as of June 1, 2005, which are cooperative procedures and standards adopted by USDA/APHIS/VS and participating states for controlling and eradicating Scrapie. These Rules do not include any later amendments of the UMR past June 1, 2005. Copies of the UMR are available to the public at the office of the Board.
(lxxii) 'Shipping Number' means a number issued by the automated attendant service after regular business hours, on weekends and holidays, in lieu of an
Import Permit which is only issued during regular business hours for the import of Bison, Bovine, Ovine, Porcine and Yaks. The Accredited Veterinarian receiving the Shipping Number shall call the Board the next regular business day and convert the Shipping Number into an Import Permit. Shipping Numbers shall be obtained from (307) 777-7515.
(lxxiii) 'Show Lamb Fungus,' also known as ring worm, means a contagious skin disease of Ovine caused by a species of fungi that invades the skin and creates lesions.
(lxxiv) 'Third Eyelid Test' means the ante-mortem test for Scrapie.
(lxxv) 'Trichomoniasis' means a contagious venereal disease of Bovine, caused by a protozoa, Tritrichomonas foetus, and characterized by infertility, pyometra, abortion, and reproductive inefficiency.
(lxxvi) 'Trichomoniasis Test Eligible Bovine' means any non-virginal, sexually intact male Bovine.
(lxxvii) 'Tuberculosis' means a chronic, progressive disease caused by a bacteria, Mycobacterium bovis in Bovine and other species, including humans.
(lxxviii) 'Tuberculosis UMR' means the Bovine Tuberculosis Eradication Uniform Methods and Rules as issued and amended as of January 1, 2005, by the USDA/APHIS/VS. These Rules do not include any later amendments of the UMR past January 1, 2005. Copies of the UMR are available to the public at the office of the Board.
(lxxix) 'USDA/APHIS/AVIC' means the United States Department of Agriculture, Animal and Plant Health Inspection Service, Area Veterinarian in Charge who is the veterinary official assigned to supervise and perform Animal health work of USDA/APHIS/VS in the state concerned.
(lxxx) 'USDA/APHIS/VS' means the United States Department of Agriculture, Animal and Plant Health Inspection Service, Veterinary Services.
(lxxxi) 'V Brand' means a 3' X 2' or larger hot iron, freeze, or bleach single V character brand, placed on the left hip near the tail-head of a male Bovine being fed in a V Lot.
(lxxxii) 'V Lot' means a feedlot that is established by a contractual agreement (V Lot agreement) with the Board and feedlot operator that allows for the feeding of untested Trichomoniasis Test Eligible Bovine, Trichomoniasis Infected Bovine or Trichomoniasis exposed Bovine in a feedlot based upon the operator's compliance with the provisions of the agreement. All Trichomoniasis infected and exposed Bovine shall be branded with a V Brand. All male Bovine shall be isolated from all female Bovine at all times while in the V Lot and shall be shipped in Direct Movement to Immediate Slaughter when leaving the V Lot.
(lxxxiii) 'Virulent' means capable of causing a disease.
(lxxxiv) 'VS Form 1-27' means an official restricted movement document form created and supplied by the USDA/APHIS/VS and issued by a state or federal representative or by an Accredited Veterinarian.
(lxxxv) 'Wildlife' means all living vertebrates that are not domesticated.
(lxxxvi) 'Wyoming Game and Fish Commission' means state agency 040 whose address is 5400 Bishop Boulevard, Cheyenne, WY 82006, (307) 777- 4600.
(lxxxvii) 'Wyoming Licensed Veterinarian' means an individual who is licensed by the State of Wyoming to practice veterinary medicine in Wyoming.
(lxxxviii) 'Wyoming State Veterinarian' means a graduate of a recognized veterinary college and licensed to practice in Wyoming, who shall be the chief executive officer of the Board.
(lxxxix) 'Yak' means a long-haired ruminant mammal of the genus Bos.
(a) Penalties for a violation of these rules shall be pursuant to law.
(a) The United States Code of Federal Regulations 9 CFR, Chapter I (Animal and Plant Health Inspections Service, Department of Agriculture), Sub-chapter B (Cooperative Control and Eradication of Livestock o-f r Poultry Diseases) (including all its parts and subparts); Sub-chapter C (Interstate Transportation of Animals (Including Poultry) and Animal Products) (including all its parts and subparts); Sub-chapter D (Exportation and Importation of Animals (Including Poultry) and Animal Products) (including all its parts and subparts); Sub-chapter E (Viruses, Serums, Toxins, and Analogous Products; Organisms and Vectors) (including all its parts and subparts); Sub-chapter G (Poultry Improvement) (including all its parts and subparts) as issued and amended as of January 1, 2006, shall be adopted by the Board insofar as these federal regulations are not inconsistent with the rules, regulations, and laws of the State of Wyoming. These rules do not include any later amendments of the Code of Federal Regulations past January 1, 2006. Copies of the Code of Federal Regulations are available to the public at the offices of the Board.
(b) The United States Department of Agriculture, Animal and Plant Health Inspection Service's Brucellosis Eradication Uniform Methods and Rules (UMR) as issued and amended as of October 2003, shall be adopted by the Wyoming Livestock Board insofar as those procedures are not inconsistent with the rules, regulations and laws of the State of Wyoming. These rules do not include any later amendments of the UMR past October 2003. Copies of the UMR are available to the public at the office of the Board.
(c) The United States Department of Agriculture, Animal and Plant Health Inspection Service’s Scrapie Eradication Uniform Methods and Rules as issued and amended as of June 1, 2005, shall be adopted by the Wyoming Livestock Board insofar as those procedures are not inconsistent with the rules, regulations and laws of the State of Wyoming. These rules do not include any later amendments of the UMR past June 1, 2005. Copies of the UMR are available to the public at the office of the Board.
(d) The United States Department of Agriculture, Animal and Plant Health Inspection Service’s Tuberculosis Eradication Uniform Methods and Rules as issued and amended as of January 1, 2005, shall be adopted by the Wyoming Livestock Board insofar as those procedures are not inconsistent with the rules, regulations and laws of the State of Wyoming. These rules do not include any later amendments of the UMR past January 1, 2005. Copies of the UMR are available to the public at the office of the Board.
(a) For purposes of import, an Animal will be considered a resident of a state only after residing in that state for thirty (30) consecutive days. If the Animal originates from a foreign nation, it will be considered to be a resident of the United States only after residing in the United States for three hundred sixty five (365) consecutive days.
(b) Any person importing, causing to be imported or directing to be imported any Animal into Wyoming for any purpose, except those specifically exempted by these Rules, shall have the Animal visually inspected by an Accredited Veterinarian and the shipment shall be accompanied by a Certificate of Veterinary Health Inspection issued within thirty (30) days prior to entry.
(c) Any person importing, causing to be imported, or directing to be imported any Animal into Wyoming shall comply with these Rules and all applicable federal animal health regulations.
(d) Interstate Animal shipments, under specified restriction by the USDA/APHIS/VS may be transported through Wyoming if accompanied by a Form VS 1-27 with prior written approval from the Wyoming State Veterinarian.
(e) No import Animal shipment allowed by these Rules shall be diverted from the Wyoming destination stated on the Certificate of Veterinary Health Inspection and/or Import Permit.
(i) The following exception to this requirement exists:
(A) Diversions that have been approved by the Wyoming State Veterinarian in writing.
(f) All international imports shall be in compliance with all applicable federal animal health laws and state laws.
(a) The Certificate of Veterinary Health Inspection, or copies of the original Certificate of Veterinary Health Inspection, shall be in the possession of the operator of each and every vehicle transporting Animals.
(b) Wyoming requires that a copy of the Certificate of Veterinary Health Inspection be forwarded to the Board by the animal health official of the state of origin or the Accredited Veterinarian that issued the Certificate of Veterinary Health Inspection within ten (10) days of issuance.
(c) The Certificate of Veterinary Health Inspection shall contain the following information:
(i) Import Permit number and/or Shipping Number when required;
(ii) Name and complete mailing address of the consignor;
(iii) Name and complete mailing address of the consignee;
(iv) Origin of the Animals;
(v) Number of Animals covered by the Certificate of Veterinary Health Inspection;
(vi) Purpose for which the Animals are being moved;
(vii) Verification that the Animals being moved are in good health and free of disease;
(viii) Dates of required testing and the specific test;
(ix) Dates of required vaccination, and
(A) The following exception to this requirement exists:
(I) Animals being used by participants in consecutive Recreational Events shall list Wyoming as a destination in what is commonly known as a circuit.
(xi) Accurate description including sex and breed of the Animals and showing the Official Individual Identification, individual Animal registered breed association tattoo, ownership brand or similar individual identification of each Animal;
(xii) Ownership brands may only be used as identification on Certificates of Veterinary Health Inspection for Animals moved interstate when no official test is required for import. The ownership brands shall be registered with the official brand recording agency in the state of origin and the Animals shall be accompanied by the state of origin's official Brand Inspection Form. These animals are still required to have Official Individual Identification though it need not be recorded on the Certificate of Veterinary Health Inspection, and
(xiii) United States Department of Agriculture license numbers for Animals used in circuses, carnivals and petting zoos.
(d) Only a Certificate of Veterinary Health Inspection issued by Accredited Veterinarians who are approved by the livestock health official of the state of origin, and veterinarians in the employ of the USDA/APHIS/VS shall be accepted.
(a) The owners and operators of any Animal conveyances importing Animals into Wyoming shall:
(i) Not import any Animal into the state except in compliance with applicable federal animal health law, state law, and the provisions set forth in these Rules;
(ii) Not import any Animal into the state unless the Animal has been imported in compliance with these Rules and all applicable federal animal health regulations.
(iii) Not import any Animal into the state unless all such conveyances used in the transportation of Animals are maintained in a clean, sanitary condition in compliance with USDA/APHIS/VS rules and guidelines;
(iv) Not import any Animal into the state unless all conveyances that have been used for movement of any Animal infected with or exposed to any infectious, contagious, or communicable diseases are thoroughly cleaned and disinfected as approved by the Wyoming State Veterinarian before further use in the transportation of Animals;
(v) Not import any Animal into the state unless each consignment is prepared for shipment according to the requirements of these Rules and all other applicable state and federal animal health regulations;
(vi) Not import any Animal into the state unless they have in their immediate possession all necessary documents related to the shipment of Animals being transported;
(vii) Not divert any Animal brought into Wyoming for production purposes or to become a permanent resident from the Wyoming destination stated on the Certificate of Veterinary Health Inspection; and
(viii) Stop at the first Port of Entry encountered in Wyoming.
(a) Any person, including but not limited to Animal owners or owners’ agent, importing, causing to be imported or directing to be imported any Animal into Wyoming shall:
(i) Not import, cause to be imported, or direct the importation of any Animal into the state except in compliance with applicable federal law, state law, and the provisions set forth in these Rules.
(ii) Not import, cause to be imported, or direct the importation of any Animal into the state unless each consignment is prepared for shipment according to the requirements of these Rules and all other applicable state regulations and federal animal health regulations;
(iii) Not import, cause to be imported, or direct the importation of any Animal into the state unless the Animal carriers have in their immediate possession all necessary documents related to the shipment of Animals being transported; and
(iv) Ensure that no Animal under their control, ownership or supervision that is brought into Wyoming is diverted from the Wyoming destination stated on the Certificate of Veterinary Health Inspection.
(vi) Not import, cause to be imported, or direct the importation of any Animal into the state unless the Animal has been visually inspected by an Accredited Veterinarian and the shipment is accompanied by a Certificate of Veterinary Health Inspection issued within thirty (30) days prior to entry.
(a) Interstate Livestock Health Movement Agreements may be applied for to the Board and issued when approved by the Wyoming State Veterinarian for one (1) year.
(b) The producer applying for an Agreement shall own or control property in Wyoming and an adjacent state to Wyoming.
(c) Any Animal moving on an Agreement shall be branded or identified with Official Individual Identification.
(d) Animals that move on an Agreement shall originate from an established breeding herd (excluding steers and spayed heifers) and shall not have been assembled from three (3) or more herds within the past six (6) months.
(e) Animals that move on an Agreement may not Commingle with any other producer's Animals.
(f) All mature female Bison and/or Bovine moving under an Agreement shall be Official Calfhood Vaccinates for Brucellosis or Official Adult Vaccinates for Brucellosis.
(g) Animals from an adjoining state, moving under an Agreement, shall enter Wyoming with a valid Certificate of Veterinary Health Inspection and a copy of the Agreement.
(h) Wyoming origin Animals returning to Wyoming under an Agreement may enter Wyoming without a Certificate of Veterinary Health Inspection if no Commingling has occurred out of state.
(i) Animals moving on an Agreement shall meet the adjacent state's import and export requirements.
(j) The Wyoming State Veterinarian may revoke Agreements at any time if disease concerns arise or if owners do not comply with the terms of the Agreement.
(k) These Agreements do not waive any brand inspection requirements.
(a) Interstate Equine Health Movement Agreements may be applied for to the Board and issued when approved by the Wyoming State Veterinarian for one (1) year.
(b) Within thirty (30) days prior to the application for an Agreement it is required that each Equine have a Certificate of Veterinary Health Inspection and a negative test for Equine Infectious Anemia.
(c) Wyoming origin Equine returning to Wyoming under an Agreement may return to Wyoming with no additional requirements if no Commingling with diseased Equine occurred out of state.
(d) Equine moving on an Agreement shall meet the adjacent state’s import and export requirements.
(e) The Wyoming State Veterinarian may revoke Agreements at any time if disease concerns arise or if owners do not comply with the terms of the Agreement.
(f) These Agreements do not waive any brand inspection requirements.
(a) In areas where the state line divides a contiguous property. Animals may move into Wyoming from adjacent states provided that the owner has made application to the Board and has been issued an Adjacent State Border Property Movement Permit.
(a) No Animal may be imported into Wyoming that is affected with, or that has recently been exposed to, any infectious, contagious, or communicable disease or that originates from an area under Quarantine, or an area suspected of harboring disease, or foreign nation where any Reportable Disease is currently endemic.
(b) No Feral Animal may be imported into Wyoming.
(a) Animals entering Wyoming in violation of these Rules shall be held in Quarantine at the owner’s or owner’s agent’s liability and expense.
(a) Movement of Quarantined Animals shall only be allowed pursuant to a VS Form 1-27 approved by the Wyoming State Veterinarian prior to the movement of any Quarantined Animal.
(a) A release of Quarantined Animals is contingent upon satisfactory completion of all conditions set forth in the Quarantine and with written approval of the Wyoming State Veterinarian.
(a) A Certificate of Veterinary Health Inspection is required on all Aviary and Cage Birds entering Wyoming.
(a) The importation of any Virulent Biologic Agent shall be approved in writing by the Wyoming State Veterinarian.
(b) Only USDA/APHIS/VS licensed or approved veterinary Biologic Agents may be imported into Wyoming.
(i) The following exception to this requirement exists:
(A) Biologic Agents of the type for which USDA/APHIS/VS has no approval process may be imported into Wyoming if other import requirements as specified in this section are met.
(c) The sale and use of any Biologic Agents for Brucellosis is limited to Accredited Veterinarians.
(d) The sale and use of any Biologic Agent for Pseudorabies is limited to Accredited Veterinarians with prior written approval of the Wyoming State Veterinarian.
(e) The sale and use of any live Biologic Agent for Rabies is limited to Licensed Veterinarians.
(f) No Biologic Agent that is infected with or that has recently been exposed to any infectious, contagious or communicable disease or that originates from a Quarantine area or an area suspected of harboring disease may be imported.
(a) An Import Permit is required on all Bison entering Wyoming.
(i) The following exceptions to this requirement exist:
(A) Bison consigned for Direct Movement from a Premise of origin within the United States to an Approved Livestock Market.
(B) Bison consigned for Direct Movement from a Premise of origin within the United States for Immediate Slaughter at a Recognized Slaughter Establishment.
(b) A Certificate of Veterinary Health Inspection is required on all Bison entering Wyoming.
(i) The following exceptions to this requirement exist:
(A) Bison consigned for Direct Movement from a Premise of origin within the United States to an Approved Livestock Market, or
(B) Bison consigned for Direct Movement from a Premise of origin for Immediate Slaughter at a Recognized Slaughter Establishment.
(c) Any female Bison that has been spayed prior to entry shall be identified with an Official Spay Tag in the right ear prior to import. Spayed Bison shall be spayed by a Licensed Veterinarian or a Certified Spay Technician.
(d) Brucellosis requirements for the importation of Bison:
(i) All Brucellosis Test Eligible Bison imported shall be identified with Official Individual Identification prior to import.
(A) The following exception to this requirement exists:
(I) Bison consigned for Direct Movement from a Premise of origin within the United States to an Approved Livestock Market to be vaccinated prior to movement from the Livestock Market if sold to remain in Wyoming. These Bison shall be vaccinated to become Official Adult Vaccinates for Brucellosis or Official Calfhood Vaccinates for Brucellosis.
(ii) The importation of sexually intact female Bison that are not Official Calfhood Vaccinates for Brucellosis or Official Adult Vaccinates for Brucellosis is prohibited.
(A) The following exceptions to this prohibition exist:
(I) Wyoming origin heifers of Brucellosis Vaccination Eligible age may return to Wyoming if they are being imported pursuant to an Interstate Livestock Health Movement Agreement. Following their return these Bison are subject to the mandatory Brucellosis vaccination requirements as described in Chapter 2 Rules entitled Vaccination Against and Surveillance for Brucellosis;
(II) Female Bison that are moving under Direct Movement to an approved K Lot;
(III) Female Bison that are imported with certification and identification that they have been spayed prior to import;
(IV) Female Bison imported with prior approval by the Wyoming State Veterinarian to be spayed by a Wyoming Licensed Veterinarian within two (2) weeks of arrival. The Bison shall be placed under Quarantine until spayed and held separate and apart from all other Animals;
(V) Brucellosis Vaccination Eligible Bison imported with prior approval by the Wyoming State Veterinarian to be vaccinated by an Accredited Veterinarian within two (2) weeks of arrival. The Bison shall be placed under Quarantine until vaccinated and held separate and apart from all other Animals;
(VI) Female Bison younger than six (6) months of age, not yet weaned from their import eligible mothers and imported with prior approval by the Wyoming State Veterinarian shall be subject to the Brucellosis vaccination requirements in Chapter 2 Rules entitled Vaccination Against and Surveillance for Brucellosis;
(VII) Brucellosis Vaccination Eligible Bison imported under Direct Movement from a Premise of origin to an Approved Livestock Market where they shall be spayed or vaccinated;
(VIII) Female Bison not yet Vaccination Eligible age, not accompanying their mothers may be imported but shall be subject to the Brucellosis vaccination requirements of Chapter 2 Rules entitled Vaccination Against and Surveillance for Brucellosis, and
(IX) Female Bison authorized in writing by the Wyoming State Veterinarian and USDA/APHIS/AVIC to be imported into Wyoming under Quarantine to become an Official Adult Vaccinate for Brucellosis
(iii) Brucellosis Test Eligible Bison from a state with less than a class free Brucellosis status shall test negative to a Brucellosis test within thirty (30) days prior to entry into Wyoming and may be held under Quarantine and subject to a negative Brucellosis retest within forty-five (45) to one hundred twenty (120) days after the pre entry test.
(A) The following exception to this requirement exists:
(I) Female Bison originating from a Certified Brucellosis-Free Herd that have not Commingled with any other producer’s Bison or Bovine.
(d) No Bison that is known to be seropositive for Johnes Disease may be imported into Wyoming.
(e) Tuberculosis requirements for the importation of Bison:
(i) Bison originating from a state or zone that is not accredited Tuberculosis free shall test negative for Tuberculosis within sixty (60) days if the Bison:
(A) Originate from a modified accredited advanced state or zone as defined in the Tuberculosis UMR and are eighteen (18) months of age or older (as evidenced by the loss of the central deciduous incisors).
(I) The following exceptions to this requirement exist:
(1.) Bison originating from an accredited free herd as defined in the Tuberculosis UMR may have this testing requirement waived at the discretion of the Wyoming State Veterinarian.
(2.) Bison imported for feeding may have this testing requirement waived at the discretion of the Wyoming State Veterinarian.
(B) Originate from a modified accredited state or zone as defined in the Tuberculosis UMR and are twelve (12) months of age or older.
(I) The following exception to this requirement exists:
(1.) Bison originating from an accredited free herd as defined in the Tuberculosis UMR may have this testing requirement waived at the discretion of the Wyoming State Veterinarian.
(C) Originate from an accredited preparatory state or zone as defined in the Tuberculosis UMR.
(ii) Bison originating from a foreign nation shall be tested negative for Tuberculosis prior to entry and shall be held under Quarantine pending the results of a post entry Tuberculosis test sixty (60) to ninety (90) days following the negative pre entry Tuberculosis test.
(a) An Import Permit is required on all Bovine entering Wyoming.
(i) The following exceptions to this requirement exist:
(A) Bovine consigned for Direct Movement from a Premise of origin within the United States to an Approved Livestock Market.
(B) Bovine consigned for Direct Movement from a Premise of origin within the United States for Immediate Slaughter at a Recognized Slaughter Establishment.
(b) A Certificate of Veterinary Health Inspection is required on all Bovine entering Wyoming.
(i) The following exceptions to this requirement exist:
(A) Bovine consigned for Direct Movement from a Premise of origin within the United States to an Approved Livestock Market.
(B) Bovine consigned for Direct Movement from a Premise of origin within the United States for Immediate Slaughter at a Recognized Slaughter Establishment.
(c) Any female Bovine that has been spayed prior to entry shall be identified with an Official Spay Tag in the right ear prior to import. Spayed Bovine shall be spayed by a Licensed Veterinarian or a Certified Spay Technician.
(d) Brucellosis requirements for the importation of Bovine:
(i) All Brucellosis Test Eligible Bovine imported shall be identified with Official Individual Identification prior to import.
(A) The following exception to this requirement exists:
(I) Bovine consigned for Direct Movement from a Premise of origin within the United States to an Approved Livestock Market to be vaccinated prior to movement from the Livestock Market if sold to remain in Wyoming. These Bovine shall be vaccinated to become Official Adult Vaccinates for Brucellosis or Official Calfhood Vaccinates for Brucellosis prior to movement from the Livestock Market if sold to remain in Wyoming.
(ii) The importation of sexually intact female Bovine that are not Official Calfhood Vaccinates for Brucellosis or Official Adult Vaccinates for Brucellosis is prohibited.
(A) The following exceptions to this prohibition exist:
(I) Wyoming origin heifers of Brucellosis Vaccination Eligible age may return to Wyoming if they are being imported pursuant to an Interstate Livestock Health Movement Agreement. Following their return these Bovine are subject to the mandatory Brucellosis vaccination requirements as described in Chapter 2 Rules entitled Vaccination Against and Surveillance for Brucellosis;
(II) Female Bovine that are moving under Direct Movement to an approved K Lot;
(III) Female Bovine imported with certification and identification that they have been spayed prior to import;
(IV) Female Bovine imported with prior approval by the Wyoming State Veterinarian to be spayed by a Wyoming Licensed Veterinarian within two (2) weeks of arrival. The Bovine shall be placed under Quarantine until spayed and held separate and apart from all other Animals;
(V) Brucellosis Vaccination Eligible Bovine imported with prior approval by the Wyoming State Veterinarian to be vaccinated by an Accredited Veterinarian within two (2) weeks of arrival. The Bovine shall be placed under Quarantine until vaccinated and held separate and apart from all other Animals;
(VI) Female Bovine younger than six (6) months of age, not yet weaned from their import eligible mothers and imported with prior approval by the Wyoming State Veterinarian shall be subject to the Brucellosis vaccination requirements in Chapter 2 Rules entitled Vaccination Against and Surveillance for Brucellosis;
(VII) Brucellosis Vaccination Eligible Bovine imported under Direct Movement from a Premise of origin to an Approved Livestock Market where they shall be spayed or vaccinated;
(VIII) Female Bovine not yet Vaccination Eligible age, not accompanying their mothers may be imported with prior approval form the Wyoming State Veterinarian and shall be subject to the Brucellosis vaccination requirements of Chapter 2 Rules entitled Vaccination Against and Surveillance for Brucellosis, and
(IX) Female Bovine authorized in writing by the Wyoming State Veterinarian and USDA/APHIS/AVIC to be imported into Wyoming under Quarantine to become an Official Adult Vaccinate for Brucellosis.
(iii) Brucellosis Test Eligible Bovine from a state with less than a class free Brucellosis status shall test negative to a Brucellosis test within thirty (30) days prior to entry and may be held under Quarantine and subject to a negative Brucellosis retest within forty-five (45) to one hundred twenty (120) days after the pre entry test.
(A) The following exception to this requirement exists:
(I) Female Bovine originating from a Certified Brucellosis-Free Herd that have not Commingled with any other producer’s Bison or Bovine.
(e) No Bovine that is known to be seropositive for Johnes Disease may be imported into Wyoming.
(f) Trichomoniasis requirements for the importation of Bovine:
(i) Trichomoniasis Test Eligible Bovine being imported into Wyoming for sale for breeding purposes shall be Certified Trichomoniasis Negative prior to entry by diagnostics performed at an approved state or federal veterinary laboratory or by a veterinarian certified in Trichomoniasis diagnostics by the state of origin.
(A) The following exceptions to this requirement exist but shall comply with Section 7(b) of Chapter 15 Rules entitled Trichomoniasis Rules:
(I) Virgin male Bovine under thirty (30) months. A written statement attesting to the virginity of the Bovine shall be included on the Certificate of Veterinary Health Inspection; and
(II) Trichomoniasis Test Eligible Bovine being imported under Quarantine to be tested upon arrival.
(ii) Trichomoniasis Test Eligible Bovine being imported by a producer to use for breeding purposes in the producer's own herd only need to be tested negative to Trichomoniasis once.
(A) The following exception to this requirement exists:
(I) Wyoming origin Trichomoniasis Test Eligible Bovine returning to Wyoming after being in another state for purposes other than natural breeding.
(iii) The Certificate of Veterinary Health Inspection accompanying Trichomoniasis Test Eligible Bovine destined to be used for reproductive purposes in Wyoming shall include the following:
(A) Individual identification listing of each Bovine on the Certificate of Veterinary Health Inspection. Imported Trichomoniasis Test Eligible Bovine, which do not have individual Trichomoniasis identification from another state's Trichomoniasis program at the time of import, shall be identified with Official Individual Identification upon arrival; and
(B) Individual listing of dates for the Official Trichomoniasis Test results for each Bovine.
(iv) The Certificate of Veterinary Health Inspection accompanying virgin male Bovine destined to be used for reproductive purposes in Wyoming shall include the following:
(A) The statement, 'These Bovine have not been used for reproductive purposes,' and
(B) Individual animal identification.
(v) Trichomoniasis Test Eligible Bovine being imported by a producer pursuant to an Interstate Livestock Health Movement Agreement, Adjacent State Border Property Movement Permit or from land owned or controlled by the importer in another state do not need to be tested for Trichomoniasis provided the Bovine are returning to their Wyoming ranch of origin, the Bovine have not Commingled with any other producer's Bovine and the Bovine have not run in any common grazing.
(g) Tuberculosis requirements for the importation of Bovine:
(i) Bovine originating from a state or zone that is not accredited Tuberculosis free shall test negative for Tuberculosis within sixty (60) days if the Bovine:
(A) Originate from a modified accredited advanced state or zone as defined in the Tuberculosis UMR and are eighteen (18) months of age or older (as evidenced by the loss of the central deciduous incisors).
(I) The following exceptions to this requirement exist:
(1.) Bovine originating from an accredited free herd as defined in the Tuberculosis UMR may have this testing requirement waived at the discretion of the Wyoming State Veterinarian.
(2.) Bovine imported for feeding may have this testing requirement waived at the discretion of the Wyoming State Veterinarian.
(B) Originate from a modified accredited state or zone as defined in the Tuberculosis UMR and are twelve (12) months of age or older.
(I) The following exception to this requirement exists:
(1.) Bovine originating from an accredited free herd as defined in the Tuberculosis UMR may have this testing requirement waived at the discretion of the Wyoming State Veterinarian.
(C) Originate from an accredited preparatory state or zone as defined in the Tuberculosis UMR.
(ii) Bovine originating from a foreign nation shall be tested negative for Tuberculosis prior to entry and shall be held under Quarantine pending the results of a post entry Tuberculosis test sixty (60) to ninety (90) days following the negative pre entry Tuberculosis test.
(iii) All dairy Bovine that are imported into Wyoming shall have a negative Tuberculosis test within sixty (60) days prior to entry. A copy of the Tuberculosis test chart shall accompany the shipment.
(A) The following exceptions to this requirement exist:
(I) Dairy Bovine younger than six (6) months of age shall be allowed to be imported into Wyoming and shall be Quarantined to the destination Premises to be tested for Tuberculosis at six (6) months of age at the owner’s expense.
(a) A Certificate of Veterinary Health Inspection is required on all Camelidae entering Wyoming.
(b) Brucellosis requirements for the importation of Camelidae:
(i) All Camelidae from a state with less than a Brucellosis class free status shall be tested negative for Brucellosis within thirty (30) days prior to entry.
(c) Tuberculosis requirements for the importation of Camelidae:
(i) Camelidae originating from a state or zone that is not accredited Tuberculosis free shall have a negative Tuberculosis test within sixty (60) days prior to entry.
(ii) Camelidae originating from a foreign nation shall be tested negative for Tuberculosis prior to entry and shall be held under Quarantine pending the results of a post entry Tuberculosis test sixty (60) to ninety (90) days following the negative pre entry Tuberculosis test.
(a) A Certificate of Veterinary Health Inspection is required on all Canine entering Wyoming.
(b) Rabies requirements for the importation of Canine:
(i) All Canine three (3) months of age and over shall be vaccinated by a Licensed Veterinarian for Rabies and be accompanied by a current Rabies vaccination certificate documenting the vaccination.
(a) A Certificate of Veterinary Health Inspection is required on all Caprine entering Wyoming.
(i) The following exceptions to this requirement exist:
(A) Caprine consigned for Direct Movement from a Premise of origin within the United States to an Approved Livestock Market.
(B) Caprine consigned for Direct Movement from a Premise of origin within the United States for Immediate Slaughter at a Recognized Slaughter Establishment.
(b) Brucella melitensis requirements for the importation of Caprine:
(i) No Caprine that originates from a Premise that has been infected with or exposed to Brucella melitensis shall be allowed to be imported.
(ii) Any sexually intact Caprine six (6) months of age and older originating from a nation that is not free of Brucella melitensis shall be tested negative for Brucella melitensis within thirty (30) days prior to importation.
(c) All imported Caprine that are destined to be used for reproductive purposes or Recreational Events shall have Official Individual Identification.
(d) Scrapie requirements for the importation of Caprine:
(i) No Caprine that has been exposed to any known suspected or Scrapie positive Animal or Premise shall be allowed entry into Wyoming.
(A) The following exception to this import requirement exists:
(I) Caprine that are enrolled in a Scrapie PEMMP approved by USDA/APHIS/VS and the Wyoming State Veterinarian.
(ii) The statement, 'Scrapie is not known to exist in the flock of origin within the past five (5) years' shall be written on the Certificate of Veterinary Health Inspection issued by the Accredited Veterinarian.
(e) Tuberculosis requirements for the importation of Caprine:
(i) Caprine originating from a foreign nation shall be tested negative for Tuberculosis prior to entry and shall be held under Quarantine pending the results of a post entry Tuberculosis test sixty (60) to ninety (90) days following the negative pre entry Tuberculosis test.
(a) A Certificate of Veterinary Health Inspection is required on all Equine entering Wyoming.
(i) The following exceptions to this import requirement exists:
(A) Equine consigned for Direct Movement from a Premise of origin within the United States for Immediate Slaughter at a Recognized Slaughter Establishment.
(b) Equine Infectious Anemia requirements for the importation of Equine:
(i) A negative Equine Infectious Anemia test performed in the prior twelve (12) months is required and shall be noted on the Certificate of Veterinary Health Inspection.
(A) The following exception to this requirement exists:
(I) Equine foals six (6) months of age and under not yet weaned from their birth mothers.
(a) A Certificate of Veterinary Health Inspection is required on all Feline entering Wyoming.
(b) Rabies requirements for the importation of Feline:
(i) All Feline three (3) months of age and over shall be vaccinated by Licensed Veterinarian for Rabies and be accompanied by a current Rabies vaccination certificate documenting the vaccination.
(a) A Certificate of Veterinary Health Inspection, or a National Poultry Improvement Plan Form VS 9-3 is required on all Hatching Eggs entering Wyoming.
(b) No Hatching Egg shall be imported into Wyoming that is affected with or that has recently been exposed to any infectious, contagious or communicable disease or that originates from a Quarantine area or area suspected of harboring disease.
(c) Each container of Hatching Eggs imported into the state shall be labeled with the following information:
(i) The name and address of the shipper;
(ii) The number of Hatching Eggs in the container;
(iii) The breed of the Hatching Eggs in the container; and
(iv) The name of the hatchery or person producing the Hatching Eggs in the container.
Section 27. Requirements for the importation of Mustelids.
(a) A Certificate of Veterinary Health Inspection is required on all Mustelids entering Wyoming.
(b) Rabies requirements for the importation of Mustelid:
(i) All Mustelids three (3) months of age and over shall be vaccinated by a Licensed Veterinarian for Rabies and be accompanied by a current Rabies vaccination certificate documenting the vaccination.
Section 28. Requirements for the importation of Ovine.
(a) An Import Permit is required on all Ovine entering Wyoming.
(i) The following exceptions to this requirement exist:
(A) Ovine consigned for Direct Movement from a Premise of origin within the United States to an Approved Livestock Market, or
(B) Ovine consigned for Direct Movement from a Premise of origin within the United States for Immediate Slaughter at a Recognized Slaughter Establishment.
(b) A Certificate of Veterinary Health Inspection is required on all Ovine entering Wyoming.
(i) The following exceptions to this requirement exist:
(A) Ovine consigned for Direct Movement from a Premise of origin within the United States to an Approved Livestock Market, or (B) Ovine consigned for Direct Movement from a Premise of origin within the United States for Immediate Slaughter at a Recognized Slaughter Establishment.
(c) All imported Ovine shall have Official Individual Identification.
(d) Brucella melitensis requirements for the importation of Ovine:
(i) No Ovine that originates from a Premise that has been infected with or exposed to Brucella melitensis shall be allowed to be imported.
(e) Brucella ovis requirements for the importation of Ovine:
(i) Any sexually intact male Ovine, six (6) months of age and older, shall be tested negative for Brucella ovis using the enzyme linked immunoassay test within thirty (30) days prior to importation.
(A) The following exceptions to this requirement exist:
(I) Ovine consigned for Direct Movement from a Premise of origin within the United States for Immediate Slaughter at a Recognized Slaughter Establishment, and
(II) Ovine that originates from a certified Brucella ovis free Flock.
(f) Foot Rot requirements for the importation of Ovine:
(i) All Ovine that are to be imported shall be examined and found free of Foot Rot. The Certificate of Veterinary Health Inspection accompanying the shipment of Ovine shall state; 'These Ovine have been examined and found to be free of Foot Rot.'
(g) Scrapie requirements for the importation of Ovine:
(i) Any Ovine that has been exposed to any known or suspected Scrapie positive Animal or Premise is prohibited from entry into Wyoming.
(A) The following exception to this prohibition exists:
(I) Ovine that are enrolled in a Scrapie PEMMP approved by USDA/APHIS/VS and the Wyoming State Veterinarian.
(ii) The statement, 'Scrapie is not known to exist in the Flock of origin within the past five (5) years' shall be written on the Certificate of Veterinary Health Inspection issued by the Accredited Veterinarian.
(iii) All black-faced Ovine that are imported into Wyoming for reproductive purposes shall be genetically tested for susceptibility to Scrapie. If found to be susceptible as determined by the Wyoming State Veterinarian, the following options exist:
(A) The import will not be allowed;
(B) If the Ovine is fourteen (14) months of age or older and tests negative on a Third Eyelid Test for Scrapie, the import will be permitted, or
(C) If the Ovine is less than fourteen (14) months of age it may be imported under Quarantine to be tested by the Third Eyelid Test for Scrapie upon reaching fourteen (14) months of age. If it tests positive, it must be ear-tagged and sent to slaughter according to the Scrapie UMR.
(h) Show Lamb Fungus requirements for the importation of Ovine:
(i) All Ovine that are to be imported as show market Ovine (club lambs) shall be examined and found free of Show Lamb Fungus. The Certificate of Veterinary Health Inspection accompanying the shipment of Ovine shall state; 'These Ovine have been examined and found to be free of Show Lamb Fungus.'
(a) An Import Permit is required on all Porcine entering Wyoming.
(i) The following exceptions to this requirement exist:
(A) Porcine consigned for Direct Movement from a Premise of origin within the United States to an Approved Livestock Market, or
(B) Porcine consigned for Direct Movement from a Premise of origin within the United States for Immediate Slaughter at a Recognized Slaughter Establishment.
(b) A Certificate of Veterinary Health Inspection is required on all Porcine entering Wyoming.
(i) The following exceptions to this requirement exist:
(A) Porcine consigned for Direct Movement from a Premise of origin within the United States to an Approved Livestock Market, or
(B) Porcine consigned for Direct Movement from a Premise of origin within the United States for Immediate Slaughter at a Recognized Slaughter Establishment.
(c) All Porcine shall have Official Individual Identification by eartags, breed association sanctioned ear notches or tattoos.
(d) No Porcine shall be imported which has been fed human garbage unless processed or treated pursuant to W.S. 11-27-106.
(e) Brucellosis requirements for the importation of Porcine:
(i) Porcine from a validated Brucellosis free state or area may be imported with no Brucellosis test requirement.
(ii) Porcine from a state or area with lower status than validated Brucellosis free shall have a negative Brucellosis test within thirty (30) days prior to import and shall be placed under Quarantine pending a negative Brucellosis post entry test at the first Wyoming destination within sixty (60) to ninety (90) days.
(A) The following exceptions to this requirement exist:
(I) Porcine from a validated Brucellosis free herd in a non validated Brucellosis free state or area may be imported with no Brucellosis test requirement.
(f) Pseudorabies requirements for the importation of Porcine:
(i) No Pseudorabies vaccinated Porcine, or Porcine from a Pseudorabies vaccinated herd, shall be allowed entry into Wyoming without prior written approval of the Wyoming State Veterinarian.
(ii) The following Pseudorabies import requirements exist for Porcine:
(A) Porcine from a federally classified Pseudorabies stage V state or area may be imported with no Pseudorabies test requirement.
(B) Porcine from a federally classified Pseudorabies stage IV state or area may be imported with a negative Pseudorabies pre entry test within thirty (30) days prior to import.
(C) Porcine from a qualified Pseudorabies negative herd in a federally classified Pseudorabies stage III, IV or V state or area may be imported with no Pseudorabies test requirement.
(iii) Porcine that do not meet the import requirements in (f)(i) or (f)(ii) shall have a negative Pseudorabies pre entry test within thirty (30) days prior to import and shall be placed under Quarantine pending a negative Pseudorabies post entry test at the first Wyoming destination within thirty (30) to sixty (60) days.
(a) A Certificate of Veterinary Health Inspection is required on all Poultry entering Wyoming.
(i) The following exception to this requirement exists:
(A) Poultry that are five (5) months of age and younger may be imported on a National Poultry Improvement Plan Form VS 9-3.
(b) Imported Poultry that shall be used for egg production and meat production, shall have a negative test result for the following diseases within thirty (30) days prior to import:
(i) Pullorum - Typhoid;
(ii) Mycoplasma gallisepticum;
(iii) Mycoplasma synoviae, and
(iv) Salmonella enteritidis.
(A) The following exception to this requirement exists:
(I) Poultry that are five (5) months of age and younger may enter that state without testing if they originate from Flocks officially classified as negative for the listed diseases;
(1.) Pullorum - Typhoid;
(2.) Mycoplasma gallisepticum;
(3.) Mycoplasma synoviae; and
(4.) Salmonella enteritidis.
(c) Each container of Poultry imported into the state shall be labeled with the following information:
(i) The name and address of the shipper;
(ii) The number of Poultry in the container;
(iii) The breed of the Poultry in the container;
(iv) The sex of the Poultry in the container;
(v) The age and hatch date of the Poultry in the container;
(vi) The name of the hatchery or person producing the Poultry in the container, and
(vii) When applicable, the Pullorum classification.
Section 31. Requirements for the importation of Ratites.
(a) A Certificate of Veterinary Health Inspection is required on all Ratites entering Wyoming.
(b) Ratites being imported shall have a negative test result for the following diseases within thirty (30) days prior to entry:
(i) Avian Influenza; and
(ii) Pullorum-Typhoid.
Section 32. Requirements for the importation of Wildlife.
(a) The importation and possession of Wildlife is regulated by the Wyoming Game and Fish Commission. Please refer to their Chapter 10 Rules regarding the importation and/or transportation of Wildlife into or through the state.
Section 33. Requirements for the importation of Yaks.
(a) An Import Permit is required on all Yaks entering Wyoming.
(b) A Certificate of Veterinary Health Inspection is required on all Yaks entering Wyoming.
(c) Brucellosis requirements for the importation of Yaks:
(i) All Yaks from a state or foreign nation with less than a Brucellosis class free status shall test negative for Brucellosis within thirty (30) days prior to entry.
(d) Tuberculosis requirements for the importation of Yaks:
(i) Yaks originating from a state or zone that is not accredited Tuberculosis free shall have a negative Tuberculosis test within sixty (60) days prior to entry.
(ii) Yaks originating from a foreign nation shall be tested negative for Tuberculosis prior to entry and shall be held under Quarantine pending the results of a post entry Tuberculosis test sixty (60) to ninety (90) days following the negative pre entry Tuberculosis test.
