Chapter 8: Livestock Board Import Rules

(a) Pursuant to the authority vested in the Wyoming Livestock Board by virtue of W.S. §11-18-103(a)(v), §11-19-403, §11-20-202 and §11-32-102 the following rules are hereby promulgated.
(a) The purpose of these rules is to protect the Wyoming livestock industry and general public by establishing procedures for the import, and when necessary quarantine, of Animals and Biologic Agents into the State of Wyoming.
(a) For the purposes of implementing these rules the following definitions exist:
(i) 'Accredited Veterinarian' means an individual who is licensed to practice veterinary medicine and is accredited by the United States Department of Agriculture, Animal Plant and Health Inspection Service in the state where he/she practices.
(ii) 'Adjacent State Border Property Movement Permit' means a permit issued by the Wyoming Livestock Board, for movement of Animals across the state line waiving certain animal health import requirements, upon the applicant satisfactorily demonstrating that he owns land or has leased land for at least two (2) or more consecutive years that is contiguous with land they own or have leased for two (2) or more consecutive years in an adjacent state.
(iii) 'Animal' means any living creature that is not a human being.
(iv) 'Approved Livestock Market' means a market that is licensed by the Board.
(v) 'Approved Livestock Market Veterinarian' means an Accredited Veterinarian employed by an Approved Livestock Market.
(vi) 'Biologic Agent' means any biologic product used for agricultural or veterinary purposes and for the purposes of these rules includes semen and embryos.
(vii) 'Bison' means a ruminant mammal of the genus Bison.
(viii) “Board” means the Wyoming Livestock Board, state agency 051, whose address is 2020 Carey Avenue-4th Floor, Cheyenne, WY 82002-0051, (307) 777-7515.
(ix) “Board Approved Individual Identification” means a permanent, green metal Wyoming identification ear tag, or a permanent, silver metal United States Department of Agriculture, Animal and Plant Health Inspection Service, Veterinary Services identification ear tag, or a permanent, blue metal identification ear tag with the word “spayed” stamped or engraved into the metal signifying that the animal has been spayed or a permanent, orange metal United States Department of Agriculture, Animal and Plant Health Inspection Service, Veterinary Services Brucellosis Vaccination ear tag or other identification approved by the Wyoming State Veterinarian. The ear tag must be placed in the right ear of a Bovinae.
(x) “Bovine” means a ruminant mammal of the genus Bos and crossbred Bovine/Hybrid Animals.
(xi) “Brand Inspection Form” means an official form issued by the Board used to transfer title of Bovine, Equine and Ovine or an official form issued by an agency in the state of origin that is responsible for Animal identification listing all of the identification marks of a specific Animal.
(xii) “Brucella ovis” means a bacteria that causes a disease of Ovine characterized by testicular swelling, inflammation in the epididymis and impaired fertility.
(xiii) “Brucellosis” means an infectious disease of animals and humans caused by Brucella abortus.
(xiv) “Brucellosis Test Eligible” means all Bovine and Bison eighteen (18) months of age and over (as evidenced by the loss of the first pair of temporary incisor teeth), except steers, spayed heifers and official calfhood vaccinates of the dairy breeds under twenty (20) months of age, and official calfhood vaccinates of beef breeds under twenty four (24) months of age. (Presence of the first pair of fully erupted permanent incisor teeth is evidence that the animal has reached twenty four (24) months of age.) All Bovine and Bison that are Parturient or Post Parturient are test eligible regardless of age.
(xv) “Brucellosis Vaccination Eligible” means sexually intact female Bison and/or Bovine between the ages of four (4) months and twelve (12) months of age.
(xvi) “Cage and Aviary Birds” means captive-reared birds that are adapted to live and breed in a cage or aviary.
(xvii) “Camelidae” mean a ruminant mammal that for the purposes of these rules includes camels, lamas, alpacas, guanacos and vicunas.
(xviii) “Canine” means a carnivorous mammal of the genus Canis.
(xix) “Caprine” means a ruminant mammal of the genus Capra.
(xx) “Certificate of Veterinary Health Inspection” means an official form documenting the health status of an animal, after being visually inspected by an Accredited Veterinarian, issued at the state of origin. A Certificate of Veterinary Health Inspection is valid for thirty (30) days after issuance.
(xxi) “Certified Spay Technician” means an individual who is certified by the state in which he or she resides to spay female Bovine.
(xxii) “Certified Trichomoniasis Negative” means any sexually intact male Bovine which has tested negative to one (1) Official Trichomoniasis Test and two (2) Official Trichomoniasis Retests and is accompanied by a Certificate of Veterinary Health Inspection from the testing Licensed and Certified Veterinarian.
(xxiii) “Chapter 2 Rules” means official rules promulgated by the Board entitled Vaccination Against and Surveillance for Brucellosis and on file with the Secretary of State’s Office in Cheyenne, Wyoming.
(xxiv) “Chapter 15 Rules” means official rules promulgated by the Board entitled Trichomoniasis Rules and on file with the Secretary of State’s Office in Cheyenne, Wyoming.
(xxv) “Direct Movement” means movement in which the animals are not unloaded en route to their final destination and not commingled with another producer’s animals.
(xxvi) “Equine” means a herbivorous mammal that for the purposes of these rules means asses, horses and mules.
(xxvii) “Equine Infectious Anemia” means a viral disease of Equine causing anemia.
(xxviii) “Feline” means a carnivorous mammal of the genus Felis.
(xxix) “Feral Animal” means an animal species, which was originally domesticated and has become wild.
(xxx) “Foot Rot” means a chronic, progressive disease caused by a mixed infection of bacteria causing lameness and severe tissue destruction.
(xxxi) “Hatching Egg” means a hard-shelled reproductive body produced by Ratites and/or Poultry.
(xxxii) “Hybrid Animal” means an animal produced by crossing species or subspecies of animals.
(xxxiii) “Immediate Slaughter” means the slaughter of an Animal within three (3) working days at a Recognized Slaughter Establishment.
(xxxiv) 'Import Permit' means a number issued by the Board within ten (10) days in advance of any Bison, Bovine, Ovine, Porcine or Yaks being imported. Import numbers must be obtained by calling (307) 777-7515. The Board may authorize an Import Permit prefix to out of state livestock markets for the creation of their own Import Permits with written approval of the Wyoming State Veterinarian.
(xxxv) 'Interstate Livestock Health Movement Agreement' means a written agreement that allows for the movement of Bison and/or Bovine between Wyoming and adjacent states. This Agreement must be approved by state animal health officials in the state of origin and state of destination prior to movement.
(xxxvi) 'Johnes Disease' means a chronic, debilitating disease of ruminants that is caused by a bacterium mycobacterium paratuberculosis.
(xxxvii) 'K Brand' means a 3' X 2' or larger hot iron, freeze, or bleach single K character brand, placed on the left side of the tail-head of a female Bison or Bovine over twenty four (24) months of age being fed in a K Lot pursuant to a K Lot Agreement.
(xxxviii) 'K Lot Agreement' means a contractual agreement with the Board and feedlot operator that allows for the feeding of non vaccinated, female Bison or Bovine twenty four (24) months of age and older in a feedlot based upon the operation's compliance with the provisions of the Agreement. All Bison and Bovine will be identified with Board Approved Individual Identification and a K Brand upon arrival. Bison or Bovine from a state or country with less than a Brucellosis class free status must test negative for Brucellosis prior to entry.
(xxxix) 'National Poultry Improvement Plan Form VS 9-3' means a form used to document interstate sales and movement of Hatching Eggs, Poultry and Ratites.
(xl) 'O Brand' means a 3' X 2' or larger hot iron, freeze, or bleach single O character brand, placed on the left side of the tail-head of a female Bison or Bovine under twenty four (24) months of age being fed in an O Lot pursuant to an O Lot Agreement.
(xli) 'O Lot Agreement' means a contractual agreement with the Board and feedlot operator that allows for the feeding of non vaccinated, female Bison or Bovine under twenty four (24) months of age in a feedlot based upon the operation's compliance with the provisions of the Agreement. All Bison or Bovine will be identified with Board Approved Individual Identification and an O Brand upon arrival. Bison or Bovine from a state or country with less than a Brucellosis class free status must test negative for Brucellosis prior to entry.
(xlii) 'Official Adult Vaccinate' means a female Bison or Bovine that is vaccinated for Brucellosis when over twelve (12) months of age using the approved vaccination procedure outlined in the Brucellosis Eradication Uniform Methods and Rules of February, 1998, and as amended, and only after written approval is issued by the Wyoming State Veterinarian and the United States Department of
Agriculture, Animal and Plant Health Inspection Service, Area Veterinarian in Charge. The Bison or Bovine must be properly identified as an Official Adult Vaccinate for Brucellosis by Board Approved Individual Identification, and a vaccination tattoo, and must be reported on the appropriate certificate to the appropriate State and Federal animal health agencies. Verification of official vaccinate status requires evidence of the vaccination shield.
(xliii) “Official Calfhood Vaccinate for Brucellosis” means a female Bison or Bovine that has been inoculated subcutaneously with a United States Department of Agriculture, Animal and Plant Health Inspection Service, Veterinary Services and Board approved Brucella vaccine, by a State or Federal representative or an Accredited Veterinarian using the approved vaccination procedure outlined in the Brucellosis Eradication Uniform Methods and Rules of February, 1998, and as amended. The Bison or Bovine must be properly identified as a Brucellosis vaccinate by Board Approved Individual Identification, and a vaccination tattoo, and must have been reported on the appropriate certificate to the appropriate State and Federal animal health agency. Verification of official vaccinate status requires evidence of the vaccination shield.
(xliv) “Official Trichomoniasis Retest” means an Official Trichomoniasis Test conducted at least seven (7) days, but not more than twenty-one (21) days, after any previous Official Trichomoniasis Test.
(xlv) “Official Trichomoniasis Test” means a test conducted on a properly cultivated sample to detect the presence of the organism Tri Trichomonas fetus.
(xlvi) “Ovine” means a ruminant mammal of the genus Ovis.
(xlvii) “Parturient” means an Animal that is visibly prepared to give birth or within two weeks of giving birth.
(xlviii) “Porcine” means an omnivorous mammal of the genus Suis.
(xlix) “Post Parturient” means an Animal that has recently given birth.
(l) “Poultry” means fowl Animals commonly referred to as chickens, ducks, geese, guineas, peacocks, pigeons and turkeys.
(li) “Pseudorabies” means a virus infection of swine primarily, but occurring incidentally in most other species. The disease is a United States Department of Agriculture, Animal and Plant Health Inspection Service program disease under strict regulation.
(lii) “Quarantine” means an official document issued by the Board that restricts the movement of specified Animals and sets forth requirements regarding testing, import, containment or dispersal of the specified Animals.
(liii) “Ratite” means an avian Animal that for the purposes of these rules includes ostriches and emus.
(liv) “Recognized Slaughter Establishment” means any slaughter establishment operating under the provisions of the Federal Meat Inspection Act of 1906, and as amended, or the Wyoming Food Safety Rule of 2000, and as amended. These documents are available to the public at the office of the Board.
(lv) “Recreational Event” means events commonly referred to as exhibitions, fairs, gymkhanas, rodeos, shows and trail rides.
(lvi) “Reportable Disease” means any disease that is on the order of international epizootiacs A or B reportable disease lists.
(lvii) “Scrapie” means a nonfebrile, transmissible, insidious, degenerative disease affecting the central nervous system of Ovine and Caprine and causing a spongiform encephalopathy.
(lviii) “Shipping Number” means a number issued by the automated attendant service after regular business hours, on weekends and holidays, in lieu of an Import Permit which is only issued during regular business hours for the import of Bison, Bovine, Ovine, Porcine and Yaks. The Accredited Veterinarian receiving the Shipping Number must call the Board the next regular business day and convert the Shipping Number into an Import Permit. Shipping Numbers must be obtained from (307) 777-7515.
(lix) “Show Lamb Fungus” means a contagious skin disease of Ovine caused by a species of fungi that invades the skin and creates lesions.
(lx) “Trichomoniasis” means a contagious venereal disease of Bovine, caused by a protozoan, Tri Trichomonas fetus, and characterized by infertility, pyometra, abortion, and reproductive inefficiency.
(lxi) “Trichomoniasis Test Eligible Bovine” means any non-virginal, sexually intact male Bovine.
(lxii) “Tuberculosis” means a chronic, progressive disease in Bovine and other species, including humans.
(lxiii) “UMR” means the Brucellosis Eradication Uniform Methods and Rules of February, 1998, and as amended, published by the United States Department of Agriculture, Animal Plant Health Inspection Service. The document is available to the public at the office of the Board.
(lxiv) “USDA/APHIS/VS” means the United States Department of Agriculture, Animal Plant and Health Inspection Service, Veterinary Services.
(lxv) “V Lot Agreement” means a contractual agreement between the Board and an operator that allows for the feeding of untested Trichomoniasis Test Eligible Bovine, Trichomoniasis Infected Bovine or Trichomoniasis exposed Bovine, in a Feedlot based upon the operation’s compliance with the provisions of the V Lot Agreement. All Trichomoniasis Infected and exposed Bovine will be branded with a V Brand on the left tail head. All male Bovine must be isolated from all female Bovine at all times while in the V Lot and must be shipped in Direct Movement to Immediate Slaughter when leaving the V Lot.
(lxvi) “Virulent” means capable of causing a disease.
(lxvii) “VS Form 1-27” means an official restricted movement document form created and supplied by the USDA/APHIS/VS and issued by a state or federal representative or by an Accredited Veterinarian.
(lxviii) “Wyoming Game and Fish Commission” means state agency 040 whose address is 5400 Bishop Boulevard, Cheyenne, WY 82006 (307) 777-4600.
(lxix) “Wyoming Licensed Veterinarian” means an individual who is licensed by the State of Wyoming to practice veterinary medicine in Wyoming.
(lxx) “Wyoming State Veterinarian” means an Accredited Veterinarian employed by the Board who serves as the State Veterinarian for the State of Wyoming and Chief Executive Officer of the Board.
(lxxi) “Yak” means a long haired ruminant mammal of the genus Bos.
(a) Penalties for a violation of these rules will be pursuant to law.
(a) Pursuant to W.S. §16-3-103, the Code of Federal Regulations as published January 1, 2002, 9CFR, Chapter I (Animal and Plant Health Inspections Service, Department of Agriculture), Sub-chapter B (Cooperative Control and Eradication of Livestock of Poultry Diseases); Sub-chapter C (Interstate Transportation of Animals (Including Poultry) and Animal Products); Sub-chapter D (Exportation and Importation of Animals (Including Poultry) and Animal Products); Sub-chapter E (Viruses, Serums, Toxins, and Analogous Products; Organisms and Vectors); Sub-chapter G (Poultry Improvement) shall be adopted by the Agency insofar as these federal regulations are not inconsistent with the rules, regulations, and laws of the State of Wyoming. These documents are available to the public at the offices of the Agency.
(a) No Animal may be imported into Wyoming that is affected with or that has recently been exposed to any infectious, contagious or communicable disease or that originates from a Quarantine area, area suspected of harboring disease or foreign nation where any Reportable Disease is currently endemic.
(b) All Animals being imported into Wyoming for any purpose, except those specifically exempted by these rules, shall be visually inspected by an Accredited Veterinarian and accompanied by a Certificate of Veterinary Health Inspection issued within thirty (30) days prior to entry.
(c) All imports allowed by these Rules shall comply with all applicable federal regulations.
(d) Interstate Animal shipments, under specified restriction by the USDA/APHIS/VS may be transported through Wyoming if accompanied by a Form VS 1-27 with prior written approval from the Wyoming State Veterinarian.
(e) No import Animal shipment, allowed by these Rules, shall be diverted from the Wyoming destination stated on the Certificate of Veterinary Health Inspection and/or Import Permit.
(i) The following exception to this requirement exists:
(A) Diversions that have been approved by the Wyoming State Veterinarian in writing.
(f) All international imports must be in compliance with all applicable federal and state law.
(a) The Certificate of Veterinary Health Inspection, or copies of the original Certificate of Veterinary Health Inspection, shall be in the possession of the operator of each and every vehicle transporting Animals.
(b) Wyoming requires that a copy of the Certificate of Veterinary Health Inspection be forwarded to the Board by the animal health official of the state of origin or the Accredited Veterinarian that issued the Certificate of Veterinary Health Inspection within ten (10) days of issuance.
(c) The Certificate of Veterinary Health Inspection shall contain the following information:
(i) Shipping Number and/or Import Permit number when required;
(ii) Name and complete mailing address of the consignor;
(iii) Name and complete mailing address of the consignee;
(iv) Origin of the Animals;
(v) Number of Animals covered by the Certificate of Veterinary Health Inspection;
(vi) Purpose for which the Animals are being moved;
(vii) Verification that the Animals being moved are in good health and free of disease;
(viii) Dates of required testing and the specific test;
(ix) Dates of required vaccination;
(x) Physical Wyoming destination of the Animals;
(xi) Accurate description including sex and breed of the Animals and showing the official ear tag number, individual Animal registered breed association tattoo, registered brand, or similar individual identification of each Animal;
(xii) Ownership brands may only be used as identification on Certificates of Veterinary Health Inspection for Animals moved interstate when no official test is required for import. The ownership brands must be registered with the official brand recording agency in the state of origin and the Animals must be accompanied by the state of origin’s official Brand Inspection Certificate; and
(xiii) United States Department of Agriculture license numbers for Animals used in circuses, carnivals and petting zoos.
(d) Only a Certificate of Veterinary Health Inspection issued by Accredited Veterinarians who are approved by the livestock health official of the state of origin, and veterinarians in the employ of the USDA/APHIS/VS will be accepted.
(a) The owners and operators of any Animal conveyances importing Animals into Wyoming shall:
(i) Be forbidden to import any Animal into the state except in compliance with the provisions set forth in these Rules;
(ii) Insure that all such conveyances used in the transportation of Animals shall be maintained in a clean, sanitary condition in compliance with USDA/APHIS/VS rules and guidelines;
(iii) Insure that all conveyances that have been used for movement of any Animal infected with or exposed to any infectious, contagious, or communicable diseases are thoroughly cleaned and disinfected under official supervision of the Board or USDA/APHIS/VS before further use in the transportation of Animals;
(iv) Assure themselves that each consignment is prepared for shipment according to the requirements of these Rules and all other applicable state and federal regulations;
(v) Have in their immediate possession all necessary documents related to the shipment of Animals being transported;
(vi) Insure that no Animal is diverted from the Wyoming destination stated on the Certificate of Veterinary Health Inspection; and
(vii) Stop at the first Port of Entry encountered in Wyoming.
(a) Agreements may be applied for to the Board and issued when approved by the Wyoming State Veterinarian for one calendar year.
(b) The producer applying for an Agreement must own or control property in Wyoming and an adjacent state to Wyoming.
(c) Any Animal moving on an Agreement must be branded or identified with Board Approved Individual Identification.
(d) Animals that move on an Agreement must originate from an established breeding herd (excluding steers and spayed heifers) and must not have been assembled within the past six (6) months.
(e) Animals that move on an Agreement may not commingle with any other producer's Animals.
(f) All mature female Bison and/or Bovine moving under an Agreement must be Official Calfhood Vaccinates for Brucellosis or Official Adult Vaccinates for Brucellosis.
(g) Animals from an adjoining state, moving under an Agreement, must enter Wyoming with a valid Certificate of Veterinary Health Inspection.
(h) Wyoming origin Animals returning to Wyoming under an Agreement may enter Wyoming without a Certificate of Veterinary Health Inspection if no commingling has occurred out of state and the Animals met the state of destination's import and export requirements.
(i) These Agreements do not waive any brand inspection requirements.
(a) In areas where the state line creates a contiguous property situation, Animals may move into Wyoming from adjacent states provided that the owner has made application to the Board and has been issued an Adjacent State Border Property Movement Permit.
(a) No Animal may be imported into Wyoming that is affected with or that has recently been exposed to any infectious, contagious or communicable disease or that originates from a Quarantine area, area suspected of harboring disease or foreign nation where any Reportable Disease is currently endemic.
(b) No Feral Animal may be imported into Wyoming.
(a) Animals entering Wyoming in violation of these Rules will be held in Quarantine at the owner's liability and expense. Owner or owner's agent shall not allow said Animals to be moved, turned loose, slaughtered, or to escape, but shall be held subject to the order of the Quarantine.
(a) Movement of Quarantined Animals will only be allowed pursuant to a VS Form 1-27 approved by the Wyoming State Veterinarian.
(a) A Release of Quarantined Animals is contingent upon satisfactory completion of all conditions set forth in the Quarantine and with written approval of the Wyoming State Veterinarian.
(a) The importation of any Virulent Biologic Agent must be approved in writing by the Wyoming State Veterinarian.
(b) Only USDA/APHIS/VS licensed or approved veterinary Biologic Agents may be imported into Wyoming.
(c) The sale and use of any Biologic Agents for Brucellosis is limited to Accredited Veterinarians.
(d) The sale and use of any Biologic Agent for Pseudorabies is limited to Accredited Veterinarians with prior written approval of the Wyoming State Veterinarian.
(e) The sale and use of any live Biologic Agent for Rabies is limited to Accredited Veterinarians.
(f) No Biologic Agent that is affected with or that has recently been exposed to any infectious, contagious or communicable disease or that originates from a Quarantine area or area suspected of harboring disease may be imported.
(a) An Import Permit is required on all Bison entering Wyoming.
(b) A Certificate of Veterinary Health Inspection is required on all Bison entering Wyoming.
(i) The following is an exception to this requirement:
(A) Bison consigned for Direct Movement from a premise of origin to an Approved Livestock Market.
(c) Brucellosis requirements for the importation of Bison:
(i) All Brucellosis Test Eligible Bison imported must be identified with Board Approved Individual Identification prior to import.
(A) The following is an exception to this requirement:
(I) Bison consigned for Direct Movement from a premise of origin to an Approved Livestock Market.
(ii) Wyoming does not allow the importation of sexually intact female Bison that are not Official Calfhood Vaccinates for Brucellosis.
(A) The following categories of imported female Bison are exempt:
(I) Bonafide Wyoming origin heifers of Brucellosis Vaccination Eligible age may return to Wyoming if they are being imported pursuant to an Interstate Livestock Health Movement Agreement. Following their return these Bison are subject to the mandatory Brucellosis vaccination requirements as described in Chapter 2 Rules entitled Vaccination Against and Surveillance for Brucellosis.
(II) Female Bison that are moving under Direct Movement to an approved K Lot;
(III) Female Bison that are moving under Direct Movement to an approved O Lot;
(IV) Female Bison that are imported with certification and identification that they have been spayed prior to import;
(V) Female Bison imported with prior Board approval to be spayed by a Wyoming Licensed Veterinarian within two (2) weeks of arrival. The animals will be Quarantined until spayed and held separate and apart from all other Animals;
(VI) Brucellosis Vaccination Eligible Bison imported with prior Board approval to be vaccinated by an Accredited Veterinarian within two (2) weeks of arrival. The animals will be placed under Quarantine until vaccinated and held separate and apart from all other animals;
(VII) Female Bison younger than six (6) months of age, nursing their import eligible mothers and imported with prior Board approval will be subject to the Brucellosis vaccination requirements in Chapter 2 Rules entitled Vaccination Against and Surveillance for Brucellosis;
(VIII) Brucellosis Vaccination Eligible Bison imported under Direct Movement from a premise of origin to an Approved Livestock Market where they will be spayed or vaccinated; and
(IX) Female Bison not yet Vaccination Eligible age, not accompanying their mothers may be imported but will be subject to the Brucellosis vaccination requirements of Chapter 2 Rules entitled Vaccination Against and Surveillance for Brucellosis.
(X) Female Bison authorized in writing by the Wyoming State Veterinarian and USDA/APHIS/AVIC to be imported into Wyoming under Quarantine to be adult vaccinated as described in Chapter 2 Rules entitled Vaccination Against and Surveillance for Brucellosis.
(B) Brucellosis Test Eligible Bison from a state with less than a class free Brucellosis status must test negative to a Brucellosis test within thirty (30) days prior to entry and may be held under Quarantine and subject to a negative Brucellosis retest within forty-five (45) to one hundred twenty (120) days after the pre entry test.
(d) No Bison that is known to be seropositive for Johnes Disease may be imported into Wyoming.
(e) Tuberculosis requirements for the importation of Bison:
(i) Bison originating from a state that is not accredited Tuberculosis free must meet the USDA/APHIS interstate test requirements for Tuberculosis.
(ii) Bison originating from a foreign nation must be tested negative for Tuberculosis prior to entry and will be held under Quarantine pending the results of a post entry Tuberculosis test sixty (60) to ninety (90) days following the negative pre entry Tuberculosis test.
(a) An Import Permit is required on all Bovine entering Wyoming.
(i) The following are exceptions to this import requirement:
(A) Bovine consigned for Direct Movement from a premise of origin to an Approved Livestock Market.
(B) Bovine consigned for Direct Movement from a premise of origin for Immediate Slaughter at a Recognized Slaughter Establishment.
(b) A Certificate of Veterinary Health Inspection is required on all Bovine entering Wyoming.
(i) The following are exceptions to this import requirement:
(A) Bovine consigned for Direct Movement from a premise of origin to an Approved Livestock Market.
(B) Bovine consigned for Direct Movement from a premise of origin for Immediate Slaughter at a Recognized Slaughter Establishment.
(c) Bovine under two (2) months of age are not permitted entry for purposes of resale. Bovine under two (2) months of age may be imported by Wyoming residents provided that the Bovine move in Direct Movement to the farm or ranch destination listed on the Certificate of Veterinary Health Inspection and Import Permit to be held for a minimum of sixty (60) days.
(i) The following are exceptions to this requirement:
(A) Bovine under two (2) months of age accompanied by their mothers; and
(B) Bovine under two (2) months purchased by Wyoming residents from Approved Livestock Markets in their trade area for which a certificate of Veterinary Health Inspection has been obtained.
(d) Any female Bovine that has been spayed prior to entry must be identified with a blue spay tag in the right ear prior to or within fourteen (14) days of import. Spayed Bovine must be spayed by a licensed veterinarian or a Certified Spay Technician.
(e) Brucellosis requirements for the importation of Bovine:
(i) All Brucellosis Test Eligible Bovine imported must be identified with Board Approved Individual Identification prior to import.
(A) The following is an exception to this requirement:
(I) Bovine consigned for Direct Movement from a premise of origin to an Approved Livestock Market, to be vaccinated prior to movement from the Livestock Market if sold to remain in Wyoming. These Bovine must be vaccinated prior to movement from the Livestock Market if sold to remain in Wyoming.
(ii) Wyoming does not allow the importation of sexually intact female Bovine that are not Official Calfhood Vaccinates for Brucellosis.
(A) The following categories of imported female Bovine are exempt:
(I) Wyoming origin heifers of Brucellosis Vaccination Eligible age may return to Wyoming if they are being imported pursuant to an Interstate Livestock Health Movement Agreement. Following their return these Bovine are subject to the mandatory Brucellosis vaccination requirements as described in Chapter 2 Rules;
(II) Female Bovine that are moving under Direct Movement to an approved K Lot;
(III) Female Bovine that are moving under Direct Movement to an approved O Lot;
(IV) Female Bovine imported with certification and identification that they have been spayed prior to import;
(V) Female Bovine imported with prior Board approval to be spayed by a Wyoming Licensed Veterinarian within two (2) weeks of arrival. The animals will be placed under Quarantine until spayed and held separate and apart from all other Animals.
(VI) Brucellosis Vaccination Eligible Bovine imported with prior Board approval to be vaccinated by an Accredited Veterinarian within two (2) weeks of arrival. The animals will be placed under Quarantine until vaccinated and held separate and apart from all other animals;
(VII) Female Bovine younger than six (6) months of age, nursing their import eligible mothers and imported with prior Board approval will be subject to the Brucellosis vaccination requirements in Chapter 2 Rules;
(VIII) Brucellosis Vaccination Eligible Bovine imported under Direct Movement from a Herd to an Approved Livestock Market where they will be spayed or vaccinated;
(IX) Female Bovine not yet Vaccination Eligible age, not accompanying their mothers may be imported but will be subject to the Brucellosis vaccination requirements of Chapter 2 Rules; and
(X) Female Bovine authorized in writing by the Wyoming State Veterinarian and USDA/APHIS/AVIC to be imported into Wyoming under Quarantine to be adult vaccinated as described in Chapter 2 Rules entitled Vaccination Against and Surveillance for Brucellosis.
(iii) Brucellosis Test Eligible Bovine from a state with less than a class free Brucellosis status must test negative to a Brucellosis test within thirty (30) days prior to entry and may be held under
Quarantine and subject to a negative Brucellosis retest within forty-five (45) to one hundred twenty (120) days after the pre entry test.
(f) No Bovine that is known to be seropositive for Johnes Disease may be imported into Wyoming.
(g) Trichomoniasis requirements for the importation of Bovine:
(i) Trichomoniasis Test Eligible Bovine being imported into Wyoming for sale for breeding purposes must be Certified Trichomoniasis Negative prior to entry by diagnostics performed at an approved state or federal veterinary laboratory or by a veterinarian certified in Trichomoniasis diagnostics by the state of origin.
(A) The following are exemptions to this import requirement but must comply with Section 7(b) of Chapter 15 Rules on Trichomoniasis:
(I) Virgin male Bovine. A written statement attesting to the virginity of the Bovine must be included on the Certificate of Veterinary Health Inspection;
(II) Sexually intact male Bovine moving in Direct Movement for Immediate Slaughter at a Recognized Slaughter Establishment;
(III) Sexually intact male Bovine offered for sale at an Approved Livestock Market to be moved in Direct Movement for Slaughter at a Recognized Slaughter Establishment;
(IV) Trichomoniasis Test Eligible Bovine being imported for feeding in a V Lot; and
(V) Trichomoniasis Test Eligible Bovine being imported under Quarantine to be tested upon arrival.
(ii) Trichomoniasis Test Eligible Bovine being imported by a producer to use for breeding purposes in the producer's own herd only need to be tested negative to Trichomoniasis once.
(A) The Certificate of Veterinary Health Inspection accompanying Trichomoniasis Test Eligible Bovine destined to be used for reproductive purposes in Wyoming shall include the following:
(I) The statement, 'Trichomoniasis is not known to exist in the herd of origin within the past two (2) years';
(II) Individual identification listing of each Bovine on the Certificate of Veterinary Health Inspection. Imported Trichomoniasis Test Eligible Bovine, which do not have individual Trichomoniasis identification from another state's Trichomoniasis program at the time of import, must be identified with Board Approved Individual Identification upon arrival; and (III) Individual listing of dates for the Official Trichomoniasis Test results for each Bovine.
(B) The Certificate of Veterinary Health Inspection accompanying Virgin male Bovine destined to be used for reproductive purposes in Wyoming shall include the following:
(I) The statement, “These Bovine have not been used for reproductive purposes”; and
(II) Individual animal identification.
(iii) Trichomoniasis Test Eligible Bovine being imported by a producer pursuant to an Interstate Livestock Health Movement Agreement, Adjacent State Border Property Movement Permit or from land owned or controlled by the importer in another state do not need to be tested for Trichomoniasis provided the animals are returning to their Wyoming ranch of origin, the animals have not commingled with any other producer’s animals and the animals have not run in any common grazing.
(h) Tuberculosis requirements for the importation of Bovine:
(i) Bovine originating from a state that is not accredited Tuberculosis free must meet the USDA/APHIS interstate test requirements for Tuberculosis.
(ii) Bovine originating from a foreign nation must be tested negative for Tuberculosis prior to entry and will be held under Quarantine pending the results of a post entry Tuberculosis test sixty (60) to ninety (90) days following the negative pre entry Tuberculosis test.
(a) A Certificate of Veterinary Health Inspection is required on all Cage and Aviary Birds entering Wyoming.
(a) A Certificate of Veterinary Health Inspection is required on all Camelidae entering Wyoming.
(b) Brucellosis requirements for the importation of Camelidae:
(i) All Camelidae from a country or state with less than a Brucellosis class free status must be tested negative for Brucellosis within thirty (30) days prior to entry.
(c) Tuberculosis requirements for the importation of Camelidae:
(i) Camelidae originating from a country or state that is not accredited Tuberculosis free must meet the USDA/APHIS interstate test requirements for Tuberculosis.
(ii) Camelidae originating from a foreign nation must be tested negative for Tuberculosis prior to entry and will be held under Quarantine pending the results of a post entry Tuberculosis test sixty (60) to ninety (90) days following the negative pre entry Tuberculosis test.
(a) A Certificate of Veterinary Health Inspection is required on all Canine entering Wyoming.
(b) Rabies requirements for the importation of Canine:
(i) All Canine three (3) months of age and over must be vaccinated by an Accredited Veterinarian for Rabies and be accompanied by a Rabies vaccination certificate documenting the vaccination.
(a) A Certificate of Veterinary Health Inspection is required on all Caprine entering Wyoming.
(b) Brucella Melitensis requirements for the importation of Caprine:
(i) No Caprine that originates from a premise that has been infected with or exposed to Brucella Melitensis will be allowed to be imported.
(c) Scrapie requirements for the importation of Caprine:
(i) No Caprine that has been exposed to any suspected Scrapie positive animal or premise will be allowed entry into Wyoming.
(ii) The statement, 'Scrapie is not known to exist in the flock of origin within the past five (5) years' must be written on the Certificate of Veterinary Health Inspection issued by the Accredited Veterinarian.
(d) Tuberculosis requirements for the importation of Caprine:
(i) Caprine originating from a state that is not accredited Tuberculosis free must meet the USDA/APHIS interstate test requirements for Tuberculosis.
(ii) Caprine originating from a foreign nation must be tested negative for Tuberculosis prior to entry and will be held under Quarantine pending the results of a post entry Tuberculosis test sixty (60) to ninety (90) days following the negative pre entry Tuberculosis test.
(a) A Certificate of Veterinary Health Inspection is required on all Equine entering Wyoming.
(i) The following are exceptions to this import requirement:
(A) Equine consigned for Direct Movement from a premise of origin for Immediate Slaughter at a Recognized Slaughter Facility.
(b) Equine Infectious Anemia requirements for the importation of Equine:
(i) A negative Equine Infectious Anemia Test performed in the prior twelve (12) months and noted on the Certificate of Veterinary Health Inspection.
(A) The following are exceptions to this requirement:
(I) Equine foals six (6) months of age and under nursing their birth mothers.
(a) A Certificate of Veterinary Health Inspection is required on all Feline entering Wyoming.
(b) Rabies requirements for the importation of Feline:
(i) All Feline three (3) months of age and over must be vaccinated by an Accredited Veterinarian for Rabies and be accompanied by a Rabies vaccination certificate documenting the vaccination.
(a) A Certificate of Veterinary Health Inspection, or a National Poultry Improvement Plan Form VS 9-3 is required on all Hatching Eggs entering Wyoming.
(b) No Hatching Egg shall be imported into Wyoming that is affected with or that has recently been exposed to any infectious, contagious or communicable disease or that originates from a Quarantine area or area suspected of harboring disease.
(c) Each container of Hatching Eggs imported into the state shall be labeled with the following information:
(i) The name and address of the shipper; (ii) The number of Hatching Eggs in the container;
(iii) The breed of the Hatching Eggs in the container; and
(iv) The name of the hatchery or person producing the Hatching Eggs in the container.
(a) An Import Permit is required on all Ovine entering Wyoming.
(i) The following are exceptions to this import requirement:
(A) Ovine consigned for Direct Movement from a premise of origin to an Approved Livestock Market; and
(B) Ovine consigned for Direct Movement from a premise of origin for Immediate Slaughter at a state or federally inspected slaughter facility.
(b) A Certificate of Veterinary Health Inspection is required on all Ovine entering Wyoming.
(i) The following are exceptions to this import requirement:
(A) Ovine consigned for Direct Movement from a premise of origin to an Approved Livestock Market; and
(B) Ovine consigned for Direct Movement from a premise of origin for Immediate Slaughter at a state or federally inspected slaughter facility.
(c) All imported Ovine must have individual identification and must adhere to the USDA/APHIS/VS identification requirements for interstate movement.
(d) Brucella Melitensis requirements for the importation of Ovine:
(i) No Ovine that originates from a premise that has been infected with or exposed to Brucella Melitensis, will be allowed to be imported.
(e) Brucella ovis requirements for the importation of Ovine:
(i) Any sexually intact male Ovine, six (6) months of age and older, must be tested negative for Brucella ovis using the enzyme linked immunoassay test within thirty (30) days prior to importation.
(A) The following are exceptions to this import requirement:
(I) Ovine which are six (6) months of age or younger;
(II) Ovine consigned for Direct Movement from a premise of origin for Immediate Slaughter at a Recognized Slaughter Facility; and
(III) Ovine that originates from a certified Brucella ovis free flock.
(f) Foot Rot requirements for the importation of Ovine:
(i) All Ovine that are to be imported must be examined and found free of Foot Rot. The Certificate of Veterinary Health Inspection accompanying the shipment of Ovine must state; 'These Ovine have been examined and found to be free of Foot Rot.'
(g) Scrapie requirements for the importation of Ovine:
(i) No Ovine that has been exposed to any known or suspected Scrapie positive animal or premise will be allowed entry into Wyoming.
(A) The following are exemptions to this import restriction:
(I) Ovine that are enrolled in a Scrapie post exposure management and monitoring plan approved by USDA/APHIS/VS and the Wyoming State Veterinarian.
(ii) The statement, 'Scrapie is not known to exist in the flock of origin within the past five (5) years' must be written on the Certificate of Veterinary Health Inspection issued by the Accredited Veterinarian.
(h) Show Lamb Fungus requirements for the importation of Ovine:
(i) All Ovine that are to be imported as show market Ovine (club lambs) must be examined and found free of Show Lamb Fungus.
(a) An Import Permit is required on all Porcine entering Wyoming.
(b) A Certificate of Veterinary Health Inspection is required on all Porcine entering Wyoming.
(i) The following are exceptions to this import requirement:
(A) Porcine consigned for Direct Movement from a premise of origin for Immediate Slaughter at a Recognized Slaughter Facility.
(c) No Porcine will be allowed import that has moved through more than one market in the thirty (30) days prior to import.
(d) All Porcine must be individually identified with eartags, breed association sanctioned ear notches or tattoos.
(e) No Porcine will be imported which has been fed human garbage.
(f) Brucellosis requirements for the importation of Porcine:
(i) The following Brucellosis import requirements exist for Porcine:
(A) Porcine from a Validated Brucellosis Free State or area may be imported with no Brucellosis test requirement.
(B) Porcine from a state or area with lower status than Validated Brucellosis Free must have a negative Brucellosis test within thirty (30) days prior to import and will be placed under Quarantine pending a negative Brucellosis post entry test at the first Wyoming destination within sixty (60) to ninety (90) days.
(I) The following exemptions exist to this import requirement:
(1.) Porcine from a Validated Brucellosis Free herd in a non Validated Brucellosis Free State or area may be imported with no Brucellosis test requirement.
(g) Pseudorabies requirements for the importation of Porcine:
(i) No Pseudorabies vaccinated Porcine, or Porcine from a Pseudorabies vaccinated herd, will be allowed entry into Wyoming without prior written approval of the Wyoming State Veterinarian.
(ii) The following Pseudorabies import requirements exist for Porcine:
(A) Porcine from a federally classified Pseudorabies stage V state or area may be imported with no Pseudorabies test requirement.
(B) Porcine from a federally classified Pseudorabies stage IV state or area may be imported with a negative Pseudorabies pre entry test within thirty (30) days prior to import.
(C) Porcine from a qualified Pseudorabies negative herd in a federally classified Pseudorabies stage III, IV or V state or area may be imported with no Pseudorabies test requirement.
(D) Porcine that do not meet the import requirements in (g)(i) or (g) (ii) must have a negative Pseudorabies pre entry test within thirty (30) days prior to import and will be placed under Quarantine pending a negative Pseudorabies post entry test at the first Wyoming destination within thirty (30) to sixty (60) days.
(a) A Certificate of Veterinary Health Inspection is required on all Poultry entering Wyoming.
(i) The following is an exception to this requirement:
(A) Poultry that are five (5) months of age and younger may be imported on a National Poultry Improvement Plan Form VS 9-3.
(b) Imported Poultry that will be used for egg production and meat production, must have a negative test result for the following diseases within thirty (30) days prior to import:
(i) Pullorum - Typhoid;
(ii) Mycoplasma Gallisepticum;
(iii) Mycoplasma Synoviae; and
(iv) Salmonella Enteritidis.
(A) The following is an exception to this import requirement:
(I) Poultry that are five (5) months of age and younger may enter that state without testing if they originate from flocks officially classified as negative for the listed diseases;
(1.) Pullorum - Typhoid;
(2.) Mycoplasma Gallisepticum;
(3.) Mycoplasma Synoviae; and
(4.) Salmonella Enteritidis.
(c) Each container of Poultry imported into the state shall be labeled with the following information:
(i) The name and address of the shipper;
(ii) The number of Poultry in the container;
(iii) The breed of the Poultry in the container;
(iv) The sex of the Poultry in the container;
(v) The age and hatch date of the Poultry in the container;
(vi) The name of the hatchery or person producing the Poultry in the container; and
(vii) When applicable, the Pullorum classification.
Section 28. Requirements for the importation of Ratites.
(a) A Certificate of Veterinary Health Inspection is required on all Ratites entering Wyoming.
(b) Ratites being imported must be tested and found to be serologically negative for the following diseases within thirty (30) days prior to entry:
(i) Avian Influenza; and
(ii) Pullorum-Typhoid.
Section 29. Requirements for the importation of Wildlife.
(a) The importation and possession of Wildlife is regulated by the Wyoming Game and Fish Commission. Please refer to their Chapter 10 Rules regarding the importation and/or transportation of Wildlife into or through the state.
Section 30. Requirements for the importation of Yaks.
(a) An Import Permit is required on all Yaks entering Wyoming.
(b) A Certificate of Veterinary Health Inspection is required on all Yaks entering Wyoming.
(c) Brucellosis requirements for the importation of Yaks:
(i) All Yaks from a state or country with less than a Brucellosis class free status must test negative for Brucellosis within thirty (30) days prior to entry.
