Chapter 14: Presentation of Official Forms By Licensed And Accredited Veterinarians

(a) Pursuant to the authority vested in the Wyoming Livestock Board by virtue of Wyoming Statute §11-18-103 (a)(v) the following rules are hereby promulgated.
(a) To ensure that the health status and any required official identification of animals involved in intrastate and interstate movement, regulatory testing, vaccination and disease reporting are properly documented and submitted to the Board in order that maximum protection regarding disease transmission, detection and control can be provided. These rules are therefore adopted to establish guidelines for the content, issuance, legibility and timely submission of Certificates of Veterinary Inspections and other Official Forms for state and federal disease programs.
(a) The following definitions are applicable for these rules:
(i) 'Board' means the Wyoming Livestock Board, state agency 051, 1934 Wyott Drive, Cheyenne WY 82001-0051, (307) 777-7515, and whose website is http://wlsb.state.wy.us.
(ii) 'CFR' means the Code of Federal Regulations; 9 CFR 1-1-2016 edition, Chapter 1, Subchapter J, parts 160-162.
(iii) 'Electronic Certificate of Veterinary Inspection (e-CVI)' means an electronic format of a Certificate of Veterinary Inspection that is able to be transmitted electronically and is approved by the Wyoming State Veterinarian. A list of approved e-CVIs is available on the Board website.
(iv) 'Official Form' means any paper or electronic laboratory diagnostic submission form, reporting form, certificate or movement document relating to state or federal disease programs including, but not limited to, test charts, vaccination certificates, quarantine movement documents and reportable disease reports.
(v) 'Paper Certificate of Veterinary Inspection (CVI)' means a four-part paper format of a Certificate of Veterinary Inspection uniquely and sequentially numbered, authorized by the Board and issued in books of twenty-five (25) to Wyoming Accredited Veterinarians. A list of approved vendors is available on the Board website.
(vi) 'Wyoming Accredited Veterinarian' means an individual who is licensed to practice veterinary medicine in Wyoming and is accredited by the United States Department of Agriculture Animal Plant Health Inspection Service (USDA APHIS) to perform accredited duties in the state of Wyoming.
(vii) 'Wyoming State Veterinarian' means a Wyoming Accredited and licensed Veterinarian employed by the Board who serves as the State Veterinarian for the State of Wyoming as outlined in W.S. 11-19-101.
(a) Penalties for a violation of these rules will be pursuant to those described in the CFR and other applicable state or federal law.
(b) The Board may deny requests by Wyoming Accredited Veterinarians for Paper Certificates of Veterinary Inspection forms for a violation of any portion of these rules pertaining to CVIs.
(a) The following sections of the Code of Federal Regulations (CFR): 9 CFR 1-1-2016 edition, Chapter 1, Subchapter J, parts 160-162, shall be adopted by the Wyoming Livestock Board in so far as those procedures are not inconsistent with the rules, regulations and laws of the State of Wyoming. The Board has determined that incorporation of the full text in these rules would be cumbersome and inefficient given the length and nature of the rules. The incorporation by reference does not include any later amendments or editions of the incorporated matter beyond January 1, 2016. The incorporated CFRs can be obtained at Board Office and are available for public inspection and copying at cost at that location; or obtained online via the USDA APHIS website at www.ecfr.gov.
(a) Paper Certificates of Veterinary Inspection are issued only to Wyoming Accredited Veterinarians. Only forms which are approved by the Board may be used to document animal health status in Wyoming Electronically-generated attachments to Certificates of Veterinary Inspection, in a format authorized by the Wyoming State Veterinarian, may also be utilized to document required identification and testing.
(b) Electronic Certificates of Veterinary Inspection submitted through approved vendors or on approved format will be compatible with the Wyoming Livestock Board computerization objectives, a list of which will be posted on the Board website.
(c) Official Forms are provided by either the Board, the USDA or the laboratory to which samples are being submitted. In certain cases, electronic versions may be available.
(a) The Board has the authority to recover any and all used or unused copies of paper CVIs and Official Forms at any time regardless of where or how they were obtained.
(a) Once a paper Certificate of Veterinary Inspection is issued by a Wyoming Accredited Veterinarian, the “state of origin” and “state of destination” copies must be received by the Board within seven (7) calendar days. The “carrier” copy must accompany the shipment of livestock and the “veterinarian” copy is to remain in the veterinarian’s files for at least five (5) years. In instances of a voided Certificate of Veterinary Inspection, all but the veterinarian copy must be sent to the Board.
(b) Not-withstanding Section 8(a), one (1) copy may be submitted to the Board by facsimile or email within three (3) days of issuance. The physical copies of the Certificate of Veterinary Health Inspection must then be sent to the Board quarterly.
(c) Approved Electronic Certificates of Veterinary Inspection may be used in lieu of paper and must be submitted at the time of completion to both the state of destination and the Board.
(d) Laboratory submission forms must accompany and be submitted with the samples they represent.
(e) Vaccination forms must be submitted to the Wyoming USDA APHIS office within 14 days after performing the vaccinations.
(f) Quarantine documents must be submitted to the Wyoming Livestock Board office by the next business day following issuance.
(g) Reportable disease reporting forms must be submitted to the Wyoming Livestock Board office in accordance with the category designated in the Wyoming State Veterinarian’s reportable disease list as outlined in W.S. 11-19-102(a).
(a) All applicable sections of the Certificates of Veterinary Inspection and Official Forms shall be filled out legibly, and all necessary information must be included, especially the accredited veterinarian’s printed name, contact information, accreditation, license number and signature, as well as the complete names and addresses of the owners, in the case of laboratory testing and vaccination, and the complete names and addresses of both the consignor and the consignee for movement documents. All required statements, test results and other health information required by the state of destination as well as all laboratory-required information for submissions must be fully met and completed on the form. The Board may require illegible Certificates of Veterinary Inspection and Official Forms to be resubmitted electronically or to be typewritten.
(b) Any and all required identification for the specific animals being moved, tested, vaccinated or quarantined must be listed on the Certificate of Veterinary Inspection or Official Form. Only the identification information of the animals that are being moved, tested, vaccinated, or quarantined shall be included on the CVI or Official Form unless the identification information of animals not included is crossed through.
(c) All Certificates of Veterinary Inspection and quarantine documents shall clearly provide a specific physical address of destination for the animals described on the document, and the issuing veterinarian shall ensure that the federal import regulations and those of the state or area of destination have been complied with.
(a) A Certificate of Veterinary Inspection or Official Form shall not be issued unless the Wyoming Accredited Veterinarian has personally performed a visual inspection of the animals.
