STANDARDS FOR CERTIFICATION OF PROVIDERS OF SUBSTITUTE CARE SERVICES FOR CHILDREN DEFINITIONS
Section 1. Definitions.
(a) "Certification" - recognition that the program meets the Department standards promulgated for the respective program areas and complies with the applicable laws and regulations.
(b) "Certifying authority" - the Department of Family Services.
(c) "Child abuse and neglect" - the improper treatment of children as defined in W.S. 14-3-202 and as defined in Chapter I of the Rules and Regulation governing child protective services.
(d) "Child-placing agency" - any private person, partnership, cooperation, association, agency or other entity that arranges for the permanent placement or temporary care, maintenance and supervision of children in a place other than the home of their parents or relatives.
(e) "Client" - the individual recipient of services from the program provider.
(f) "Conduct disorder" - an individual who manifests long-time behavior problems that may include impulsiveness, aggressiveness, antisocial acts, refusal to accept limits, suicidal gestures and substance abuse.
(i) Functional deficits may include impaired academic and social functioning.
(ii) The essential feature is a repetitive and persistent pattern of conduct in which either the basic rights of others or major age-appropriate societal norms or rules are violated.
(iii) The conduct is more serious than the ordinary mischief and pranks of children and adolescents.
(g) "Confinement" - segregation of a juvenile to an individual cell in a detention center that is separated from the general population. Confinement is used only during periods of crisis or emergency for the juvenile, when juvenile is a danger to himself/herself or others, the juvenile is beyond control, and all other means to control or calm the juvenile have failed and the juvenile's welfare or welfare of others require the juvenile be confined. Confinement is not used as punishment.
(h) "Contraband" - any item possessed by a confined juvenile offender or found within the facility that is illegal by law or expressly prohibited by those legally charged with the administration and operation of the facility or program.
(i) “Corporal punishment” - any act of inflicting punishment directly on the body, causing pain or injury.
(j) “Counseling” - the planned use of interpersonal relationships to promote social adjustment.
(k) “Crisis counseling” - the resolving of an unusual event that requires immediate response and solution. The level of counseling required is intensive and of short duration.
(l) “Department” - the Department of Family Services created pursuant to W.S. 9-2-2006.
(m) “Discharge plan” - the planning that is initiated at the time of admission to the program and shall include, but not be limited, to the following:
(i) The length of stay is determined.
(ii) The services necessary to treat the child in a less restrictive environment are developed and put into place by the time the child is discharged from the program.
(iii) The discharge plan must be consistent with the agency’s case plan and is subject to the placing agency’s agreement.
(n) “Discipline” - a system of rules governing conduct, which usually prescribes consequences for the violation of particular rules.
(o) “Facility” - Any program certified to care for more than six children with the exception of child placing agencies and adoption agencies.
(p) “Mechanical restraints” - devices used to restrict physical activity. Handcuffs, leg irons, and straight jackets are typically classified as restraints.
(q) “Physical restraint” - actual holding of a child through the use of mechanical restraint or by a person.
(r)(q) “Program” - substitute care furnishing services for the prevention of child abuse and neglect and for the enhancement of the quality of life for families and children.
(s)(r) “Provider” - a person participating in the delivery of substitute care services.
(t)(s) “Safe physical management” - the application of specific skills/techniques that are designed and intended to support people with emphasis placed on protecting people from pain and injury.
(u)(t) “Seclusion room” - a secure, safe and clean room in which an individual can be held contrary to their wishes.
(v)(u) “Substitute care” - room, board and counseling provided to children on a 24-hour a day basis away from their own home environment
