(a) 'Certification' means recognition that the program meets the Department standards promulgated for the respective program areas and complies with the applicable laws and regulations.
(b) 'Certifying authority' means the Department of Family Services.
(c) 'Child abuse and neglect' means the improper treatment of children as defined in W.S. 14-3-202(a) and 14-6-201(a)(xvi), and as defined in Chapter I of the Rules and Regulations governing child protective services.
(d) 'Child-placing agency' means any private person, partnership, cooperation, association, agency or other entity that arranges for the permanent placement or temporary care, maintenance and supervision of children in a place other than the home of their parents or relatives.
(e) 'Client' means the individual recipient of services from the program provider.
(f) 'Clinical director' means an individual who is responsible for planning, developing, implementing and assessing social, clinical or ancillary services. If services are provided, the clinical director is responsible for staff delivering these services and is also responsible for developing in-service training.
(g) 'Conduct disorder' means an individual who manifests long-time behavior problems that may include impulsiveness, aggressiveness, antisocial acts, refusal to accept limits, suicidal gestures and substance abuse. Functional deficits may include impaired academic and social functioning. The essential feature is a repetitive and persistent pattern of conduct in which either the basic rights of others or major age-appropriate societal norms or rules are violated. The conduct is more serious than the ordinary mischief and pranks of children and adolescents.
(h) 'Counseling' means the planned use of interpersonal relationships to promote social adjustment.
(i) 'Crisis counseling' means the resolving of an unusual event that requires immediate response and solution. The level of counseling required is intensive and of short duration.
(j) 'Day treatment' means activities occupying more than three hours in any given day away from the minor. Its regular residence conducted in either a residential or nonresidential setting that provide treatment and rehabilitation to children requiring mental health services. Activities may include group therapy, socialization, counseling and support services.
(k) 'Department' means the Department of Family Services created pursuant to W.S. 9-2-2006.
(l) 'Director' means the person appointed by the Governor to administer the Department of Family Services.
(m) 'Discharge plan 11 means the planning that is initiated at the time of admission to the program through which the length of stay is determined and the services necessary to treat the child in a less restrictive environment are developed and put into place by the time the child is discharged from the program. The discharge plan must be consistent with the placing agency's case plan and is subject to the placing agency's agreement.
(n) 'Discipline' means a system of rules governing conduct, which usually prescribes consequences for the violation of particular rules.
(o) 'Facility' means any program certified to care for more than six children.
(p) 'Petitioner' means an individual, a group of individuals or a private or a public agency seeking relief against the Division.
(q) 'Program' means furnishing services for the prevention of child abuse and neglect and for the enhancement of the quality of life for families and children.
(r) 'Presiding officer' means the person designated by the Director to serve as the officer to preside at the taking of evidence in all contested cases.
(s) 'Provider' means a person participating in the delivery of substitute care services.
(t) 'Substitute care', means board, room and counseling provided to children on a 24-hour a day basis away from their own home environment.
(u) 'Time-out room' means a secure, safe and clean room in which an individual can be held contrary to their wishes.
