CHILD SUPPORT ENFORCEMENT DIVISION CHAPTER 8 LICENSE REVOCATION AND SUSPENSION
(a) CSED may request the court to enter an order withholding or suspending a driver's license, commercial driver's license, any professional, occupational, recreational license, or any other license, certificate, permit, or authority as allowed by W.S.20-6-112, of licensee who is in arrears in child support payments the equivalent of at least triple the current monthly child support obligation.
(b) For purposes of this chapter, child support obligors are referred to as 'licensee.'
(c) Upon obtaining a Court order, CSED shall send a certified copy of the court order to any licensing agency identified in the court order.
(d) Upon determining the obligor is in compliance with the terms of the court order to suspend a license, CSED shall notify the licensing agency who was notified to suspend under paragraph (c) of this chapter of the obligor's compliance. This notice shall be in writing and sent via regular mail.
If CSED determines a driver's license suspension may be better achieved through an administrative process, CSED may, pursuant to W.S. 20-6-111, initiate administrative suspension proceedings.
A licensee shall be notified via certified mail at last known address or by personal service, the child support obligation is in arrears the equivalent of at least three (3) times the monthly child support obligation and the licensee's driver's license may be suspended. Licensee will be advised of rights and responsibilities under W.S. 20-6-111(d) and 20-6-111(e).
If the licensee demonstrates full payment of arrearage as stated in notice, or if licensee enters into a payment plan approved by CSED, CSED shall notify the Department of Transportation to terminate the suspension process.
(a) Administrative Record Review - A request for a records review must be made within twenty (20) days of receipt of notice of intent to suspend the license with the requisite fee of fifteen dollars ($15.00) pursuant to W.S. 20-6-111(d)(ii). Within sixty (60) days of a request for records review by a licensee, CSED shall conduct a review of its records and issue a determination which affirms, modifies, or rescinds notice to suspend the license. The licensee will be notified of the determination from the records review. If the record review results in a finding that the licensee's child support obligation is current, CSED shall return the fee required under this paragraph. Failure to request review within twenty (20) days shall constitute a waiver of opportunity for records review.
(b) The licensee will be notified in writing of records review results or the denial of the records review. Results or denials can be appealed under Section 6 below.
Section 6. Request for Administrative Hearing.
Contested Cases - Requests for contested case hearings received by CSED will be forwarded to the Director of the Department of Family Services according to W.S. 20-6-111(d) & (e). Requests must be made within twenty (20) days of receipt of notice of intent to suspend the license and with the requisite fee of twenty-five dollars ($25.00) pursuant to W.S. 20-6-111(d)(iii).
Section 7. Results of Administrative Hearing.
CSED shall notify the Department of Transportation of any hearing resulting in the suspension of a license.
Section 8. Licensee Failure to Respond.
If no request for review or objection is received by CSED, from the licensee or authorized representative within twenty (20) days, the Department shall issue an administrative order directing the Department of Transportation to suspend the license.
