The following procedures apply to unemployment compensation interception for both Public Assistance and Non-PA cases:
(a) Upon disclosure that an obligor under court order is, or will be a recipient of benefits, written notice will be given of proposed interception upon the obligation including an amount upon arrears, up to 35% of the monthly benefits.
(b) The obligor is given twenty (20) days to respond to the notice.
(c) If the obligor responds within the twenty (20) day time period, CSES will seek to resolve any disputes as to the amount due.
(d) If no response is received within 20 days, request for interception shall be made to the Employment Security Commission.
(e) In the event of unresolved disputes or refusal of the obligor to agree to interception, a Notice pursuant to the Income Withholding Act shall be made.
