Notwithstanding any other Rule of the Division with regard to Information Practices, CSES will make information available to consumer reporting agencies, as follows:
(a) Upon request, information on the amount of overdue support will be provided to consumer reporting agencies for cases in which the amount of arrears exceeds one thousand dollars ($1,000).
(b) CSES will not provide information to a consumer reporting agency in the following instances:
(i) The obligor has contested the release and an administrative hearing is pending or decided in the obligor's favor.
(ii) The obligor has entered into and complied with an agreement to fully pay support arrears in accordance with a written and signed repayment schedule and a wage withholding action has been implemented.
(c) CSES will provide advance notice to an obligor, by regular mail, to the obligor's last known address of the proposed release of information to a consumer reporting agency, including a notice of procedures for contesting the accuracy of the information by the obligor's completing a sworn statement of support payments or proof of payment.
(d) CSES will compare its record of payment with information provided by the obligor of any adjustment. If CSES determines that no adjustment is indicated, CSES will notify the obligor of his/her right to an administrative hearing on the matter, to be conducted in accordance with the Division's Rules on administrative hearings.
