Chapter 10: License Revocation and Suspension

(a) For purposes of this chapter, a child support obligor is referred to as 'licensee.'
(b) CSED may request the court to enter an order withholding or suspending a driver's license, commercial driver's license, any professional, occupational, recreational license, or any other license, certificate or permit, pursuant to Wyo. Stat. § 20-6-111 and § 20-6-112, of a licensee who is in arrears in child support payments.
(c) Upon obtaining a court order, CSED shall send a certified copy of the court order to any licensing agency identified in the court order.
(d) Upon determining the licensee is in compliance with the terms of the court order, CSED shall notify the appropriate licensing agency of the licensee's compliance. This notice shall be in writing and sent via regular mail within five (5) business days of the obligor's compliance.
(a) If CSED determines a driver's license suspension may be better achieved through an administrative process, CSED may, pursuant to Wyo. Stat. § 20-6-111, initiate administrative suspension proceedings.
(b) A licensee shall be notified via certified mail, restricted delivery, at the licensee's last known address or by personal service, that the child support obligation is in arrears and the licensee's driver's license may be suspended. The notice shall advise the licensee of rights and responsibilities under Wyo. Stat. § 20-6-111(f) through (k).
(c) Termination of the suspension process may be granted if a licensee demonstrates full payment of arrearage as stated in the notice, or if licensee enters into a payment plan approved by CSED. CSED shall notify the Wyoming Department of Transportation to terminate the suspension process.
(d) Request for administrative records review.
(i) The request for an administrative records review must be made within twenty (20) days of receipt of the notice of intent to suspend the license with the requisite fee of fifteen dollars ($15) pursuant to Wyo. Stat. § 20-6-111(j)(ii). Within sixty (60) days of a request for records review by a licensee, CSED shall conduct a review of its records and issue a determination which affirms, modifies, or rescinds the notice to suspend the license. The licensee shall be notified of the determination from the records review. If the records review results in a finding that the licensee's child support obligation is current, CSED shall return the fee required under this paragraph. Failure to request a review within twenty (20) calendar days constitutes a waiver of opportunity for a records review.
(ii) The licensee shall be notified in writing of the records review results. Results can be appealed pursuant to (e) of Chapter 10 Section 2 of these rules.
(e) Requests for an administrative hearing received by CSED shall be forwarded to the Office of Administrative Hearing pursuant to Wyo. Stat. § 20-6-111(j)(k). Requests must be made within twenty (20) days of receipt of the notice of intent to suspend the license and with the requisite fee of twenty-five dollars ($25) pursuant to Wyo. Stat. § 20-6-111(j)(iii).
(f) CSED shall notify the Wyoming Department of Transportation of any hearing resulting in the suspension of a license.
(g) If there is not a request for review or no objection is received by CSED from the licensee or authorized representative within twenty (20) calendar days, CSED shall issue an administrative order directing the Wyoming Department of Transportation to suspend the license.
(h) A judicial review may be requested by the licensee. The licensee may appeal the administrative decision suspending a license pursuant to Wyo. Stat. § 20-6-111(h).
