Section 1. Submission of Plans and Specifications.
(a) To obtain a plan review the applicant shall submit two (2) complete sets of plans and one complete set of specifications to the State Fire Marshal for review and approval along with the applicable plan review fee.
Sufficient postage to provide for the return of one set of plans and specifications shall be included and attached to a label bearing the return address of the applicant.
(b) When plans and specifications are submitted to the State Fire Marshal for review they shall be examined to determine that they are drawn to scale on substantial paper and shall be of sufficient clarity to indicate the nature and extent of the work proposed and show in detail that it will conform to the provisions of the statutes and the rules and regulations of the Department.
(c) Plans purporting to have been prepared by an individual or firm practicing architecture or engineering shall include the name and Wyoming license number of the responsible architect or engineer.
(d) The first sheet of the plans shall give the following information, or it shall be similarly outlined in the attached correspondence:

Plans shall include a plot plan showing the location of the building(s) and of every existing building on the property, right-of-way width, and the building address. Plot plans shall indicate detailed location of fire hydrants. In lieu of detailed specifications, the State Fire Marshal may approve references on the plans to a specific section of the rules and regulations or other standards or laws. Plans and Specifications should indicate conformance to the Uniform Building Code Chapter 53, for efficient energy usage.
(f) Such other data, as is necessary to show the correctness of the plans, shall be submitted when required by the State Fire Marshal. Plans for buildings more than two (2) stories in height shall indicate how fire resistive integrity will be maintained where a penetration will be made for electrical, mechanical, plumbing, and communications conduits, pipes and similar systems.
(g) Electrical: Sufficient information on the plans and in the specifications shall include one line diagrams showing feeders, service and panels, panel schedules, location of all electrical equipment, devices, classification on hazardous areas, emergency systems, and short circuit current available at the supply terminals at the service equipment.
(a) Preliminary code research information sessions may be offered to the public, providing time and staff is available. Only verbal comments will be issued, as written explanations are sometimes misconstrued to be binding. In no way will preliminary findings be allowed to limit or influence the correct application of minimum state standards. Where conflicts of this nature occur, the practice will be discontinued.
(b) When the State Fire Marshal determines the review submittal contains sufficient information for a comprehensive plan review, the plans and specifications shall be stamped and dated as 'RECEIVED, ACCEPTABLE FOR REVIEW.' The person submitting plans will be notified in writing of the date plans are complete and when plans are due out.
(c) If it is determined that the review submittal contains insufficient information for a review, the applicant will be advised in writing of the necessary additional information and the plans and specifications will be held until the information is received by the State Fire Marshal. If the additional information requested by the State Fire Marshal is not received within twenty-one (21) working days from the date of the request the plans and specifications will be stamped 'NOT APPROVED, INSUFFICIENT INFORMATION' and returned to the applicant. Upon timely receipt of the requested information the plans and specifications will be stamped and dated as 'RECEIVED, ACCEPTABLE FOR REVIEW'.
(d) After having been stamped as 'RECEIVED, ACCEPTABLE FOR REVIEW', the plans and specifications shall be assigned to a plans analyst for the review.
(e) When the State Fire Marshal is satisfied that the plans and specifications conform to all the requirements of the rules and regulations of the Department of Fire Prevention and Electrical Safety he shall issue an approval therefore to the applicant. If additional compliance to minimum standards is found to be necessary during the review process the applicant shall be notified within twenty-one (21) working days from the date stamped 'RECEIVED, ACCEPTABLE FOR REVIEW', by being sent a copy of the general plan correction list used by the State Fire Marshal in the review. If the applicant agrees to correct the deficiencies, he shall sign the list and return it to the State Fire Marshal for final review and approval. The applicant shall be notified of final approval within (10) working days of the receipt of the agreement to correct the deficiencies.
(f) If the applicant does not agree to correct the deficiencies he shall submit to the State Fire Marshal his reason for objection by mail or in person. It shall be the right of the applicant to appeal the decision of the State Fire Marshal through the provisions of W.S. 35- 9-106(c) and in conformance with Chapter VIII of these rules and regulations.
(g) When the State Fire Marshal issues final approval, he shall stamp on both sets of plans and the specifications 'APPROVED'. The approved plans and specifications shall not be changed, modified, or altered without authorization of the State Fire Marshal relative to fire safety and energy efficiency consideration, and all work shall be done in accordance with the approved plans.
(h) One set of approved plans and specifications shall be retained by the State Fire Marshal for not less than ninety (90) days from the completion of the work covered therein. One set of plans shall be returned to the applicant and kept on the site of the building or work at all times during which the work authorized thereby is in progress. The general plan correction list shall be attached to the applicant's plans and shall remain as a part of the plans.
(i) Approval of plans and specifications is not approval of the violation of any applicable code, law, or regulation. No approval presuming to give authority to violate or cancel the provisions of any applicable code, law, or regulation shall be valid except insofar as the work or use which it authorizes is lawful.
(j) After approval by the State Fire Marshal construction shall commence within 180 days. The approval shall expire if the building or work authorized by the approval is suspended or abandoned for a period of 180 days. Before work can be recommenced, new approval shall be obtained.
(k) The State Fire Marshal may, in writing, suspend or revoke approval issued under the provisions of the rules and regulations whenever the approval is issued in error or on the basis of incomplete or incorrect information.
(a) No building or structure of Group A, E, I, H, B, or R Division I Occupancy, shall be used or occupied without prior approval by the State Fire Marshal.
(a) Where joint plan review authority has been provided for state owned or leased buildings by W.S. 35-9- 121(b) the normal review process will be followed.
(b) Conflicts of interpretations of the codes shall be settled in writing by the staff of the applicable code.
