Section 1. Authority. This regulation is promulgated by authority of W.S. §23-1-302(a)(i), (viii), (xiv), (xvi) and (xxii) and § 23-1-703(b)(c).
Section 2. Definitions. Definitions shall be as set forth in Title 23, Wyoming Statutes, Commission regulations, and the Commission also adopts the following definitions:
(a) 'Auxiliary Management Hunting Seasons' means hunting seasons for big game animals, trophy game animals or wild turkeys causing damage to land, growing cultivated crops, stored crops, seed crops, improvements or causing extraordinary damage to grass; hunting seasons for trophy game animals causing actual damage to livestock or bees including honey and hives; or, hunting seasons for big game animals, trophy game animals or wild turkeys for the purpose of meeting disease management objectives.
Section 3. Establishment of Areas. The Chief Game Warden or his designee shall determine the extent of alleged damage or disease management needs and shall, with consent of the District Wyoming Game and Fish Commissioner and the cooperating landowner(s) involved, designate the area to be opened to an auxiliary management hunting season, the opening and closing dates of the auxiliary management hunting season, the maximum number and type of licenses to be issued, the number, sex and species of big game animals, trophy game animals or wild turkeys to be taken and any applicable firearm or weapon type restrictions.
Section 4. Supervision of Hunters. Hunting shall be done under the supervision or direction of Department personnel or the cooperating landowner(s) or the landowner(s)'s agent(s).
(a) Department personnel may accompany hunters to accomplish the goals of the auxiliary management hunting season or when other factors require the presence of Department personnel with the hunter.
(b) Any hunter who participates in an auxiliary management hunting season and who refuses to take an available animal as directed by Department personnel shall not be allowed to continue to participate in that specific auxiliary management hunt.
(a) Auxiliary management hunting season licenses for big game animals, trophy game animals or wild turkeys shall be available to applicants after the Chief Game Warden designates a need for such a season. The issuance of licenses under this Section shall be at the direction of Department Administration. Auxiliary management hunting season licenses may be issued through the Electronic Licensing Service, designated Department personnel and facilities or designated license selling agents and shall be valid for a specific auxiliary management hunting season.
(b) The Department may authorize the use of unused licenses that are currently valid and that have not expired to be used for an auxiliary management hunting season.
(c) An auxiliary management hunting season license, valid conservation stamp and elk special management permit if applicable, shall be obtained prior to participating in any auxiliary management hunt under this regulation.
(d) Any person who has been issued a mountain goat type one (1) or type two (2) license in a previous year may apply for and receive a mountain goat auxiliary management hunting season license in any subsequent year.
(e) Holders of an auxiliary management hunting season license shall be exempt from the provisions in Commission regulations limiting the number of licenses an individual may possess in any one (1) calendar year. Auxiliary management hunting season license recipients shall not lose preference points for receiving an auxiliary management hunting season license for a species they may otherwise purchase a preference point for.
(f) A person participating in an auxiliary management hunting season may purchase more than one (1) license for a specified hunt depending on license quota availability
Section 6. Bag Limits. The bag limit for any individual participating in an auxiliary management hunting season shall not exceed more than one (1) big game animal, one (1) trophy game animal or one (1) wild turkey per auxiliary management hunting license issued. Any big game animal, trophy game animal or wild turkey taken under this regulation shall be in addition to the bag limit established by other Commission regulations. Participation in any auxiliary management hunting season under this regulation shall not deny an individual the privilege of hunting in other seasons established by the Commission, except as otherwise provided by statute or regulation.
Section 7. Mandatory Hunter Harvest Check. When an auxiliary management hunting season is implemented, every person harvesting a big game animal, trophy game animal or wild turkey may be required to have the harvested animal inspected by Department personnel. When a person purchases a license to participate in an auxiliary management hunting season under this section, the Department shall advise the person of the time and location where the harvested animal is to be brought for inspection, registration or disease sampling. During the inspection, Department personnel may collect any biological samples deemed necessary by the Department.
Section 8. General Regulations. All other Commission regulations and Wyoming statutes shall apply to the taking of big game animals, trophy game animals or wild turkeys during an auxiliary management hunting season unless specifically exempted by this regulation.
