Section 1. Authority and Purpose. These rules are adopted by the Wyoming State Board of Cosmetology, hereafter 'Board,' pursuant to the authority granted by W.S. 33-12-123 and 134, and in accordance with the Administrative Procedures to the Board in undertaking its responsibilities pursuant to W.S. 33-12-119 through 140.
Section 2. Disposition of Fees. Under no circumstances will fees be refunded.
Section 3. Correspondence Courses and Apprenticeship Training. Correspondence courses and apprenticeship training are not recognized by the Board.
Section 4. Display of License. Every school, salon, independent contractor, cosmetologist, manicurist/nail technician, esthetician, hairstylist and instructor shall conspicuously display the appropriate license(s), sanitation rules and regulations, most recent inspection sheet, wet disinfection and blood spill procedures, in a location accessible and visible to the consumer, void of any obstructions to view.
Section 5. Compliance Period. Full Compliance with these rules is required ninety (90) days after the effective date of these rules.
Section 6. Credit Allowed to Barbers. A Wyoming barber may enroll in a licensed cosmetology school and upon completion of not less than 1,000 hours training, may qualify for the cosmetology examination.
(a) A 'Cosmetologist' means a person who engages and who is licensed to perform services for others for the improvement and beautification of the hair, skin and nails of the human body for cosmetic purpose by means of any one or a combination of the following practices but not limited to :
(i) Cutting, clipping or trimming hair
(ii) Massaging, cleansing, stimulating, manipulating, exercising, beautifying or applying oils, lotions, or other preparations, styling, arranging, dressing, braiding, curling, waving, permanent waving, straightening, singeing, bleaching, tinting, coloring or similar work, upon the scalp, hair, wig, or hairpiece of any person, by any means, with hands or by mechanical or electrical apparatus or appliances.
(iii) Applying hair extensions by means of bonding or sewing or braiding or any other means to a persons hair.
(iv) Practice of Nail Technology
(v) Practice of Esthetics.
(b) A 'Hairstylist' means a person who engages and who is licensed to perform services for others for the improvement and beautification of hair and scalp only as listed in Section 7 (a), (i), (ii) and (iii).
(c) A 'Manicurist/Nail Technician' means a person who engages and who is licensed to perform services for others for the improvement and beautification of the hands and arms to the elbow and foot and ankle to the knee, for cosmetic purposes by means of any one or a combination of the following practices but not limited to:
(i) Cutting, trimming, polishing, coloring, tinting, cleansing or otherwise treating a persons nails.
(ii) Applying artificial nails
(iii) Superfluous hair removal by means other than electrolysis, only on back of hand or top of foot including fingers and toes.
(iv) Massaging, cleansing, stimulating, manipulating, exercising, beautifying or applying oils, lotions, or other preparations, to a persons hands and arms to the elbows, feet and ankles to the knees, by any means, with hands or by mechanical or electrical apparatus or appliances.
(d) An "Esthetician" means a person who engages and who is licensed to perform services for others for the improvement and beautification of the skin of the body for cosmetic purposes by means of any one or combination of the following practices but not limited to:
(i) Massaging, cleansing, exfoliating, stimulating, manipulating, exercising, beautifying or applying makeup, oils, lotions, or other preparations, to a persons body, by means, with hands or by chemical, mechanical or electrical apparatus or appliances.
(ii) Removal of superfluous hair by means other than electrolysis.
(iii) Arching eyebrows or tinting eyelashes or eyebrows.
(v) Perform extractions on the face by means, with hands or by mechanical or electrical apparatus or appliances.
(vi) Procedures which no not penetrates below the outer most layer of the skin called the Epidermis into the Dermis layer that contain the connective tissue of the skin. This is considered invasive and is prohibited.
(e) Using the term or title of "Medical Esthetician" is not allowed under this act. This term is misleading and could be deemed deceptive or fraudulent.
(f) Any machine or appliance which penetrates the dermis layer of the skin is considered invasive and is therefore prohibited.
