Chapter 20: Registration of Weighing & Measuring Device Service Technicians

Section 1. Authority. Pursuant to the authority vested in the Director of Agriculture in accordance with Section 40-10-122, Wyoming Statutes 1993, the following regulations are hereby promulgated.
Section 2. Registration of Weighing & Measuring Device Service Technicians. For the benefit of and as a convenience to the users, manufacturers, and distributors of weighing and measuring devices in the State of Wyoming, and to those persons installing, servicing and repairing such instruments, the Department of Agriculture shall accept applications for registration for persons qualified by training and experience, to install, service and repair weighing and/or measuring devices.
A certificate of registration shall be issued to any person satisfactorily passing examination and having adequate equipment to properly service and test weighing and/or measuring devices. The testing equipment used by a registered service technician shall be submitted for approval upon request.
A holder of a certificate of registration shall have authority to:
(a) Remove rejected tags and/or condemn tags placed on weighing and measuring devices by authorized weights and measures officials.
(b) Place in service on a temporary basis, repaired devices which have been previously rejected or condemned and newly installed devices, (including new and used devices), until such time as an official inspection can be made by an authorized inspector.
(i) All registered service technicians, shall use a standard Placing in Service Report that has been approved by the Department of Agriculture. Said registered service technician shall execute the Placing in Service Report for all devices that they repair and/or adjusts, which affects the accuracy of the device. They shall also execute this same report for all devices which are newly installed, (including new and used devices). When a rejected or condemn tag is removed from a device, said tag shall be attached to the original Placing in Service Report, and the original shall be mailed to the Department of Agriculture, 2219 Carey Avenue, Cheyenne, Wyoming, 82002, within 24 hours after the device has been placed in service. The duplicate shall be left with the user of the device and the triplicate retained by the registered service technician. A device Placed in Service by a registered service technician shall meet all specifications, tolerances and technical requirements as specified in W.S. 40-10-120.
(ii) Each registered service technician shall have a thorough knowledge of all laws, specifications, tolerances, rules and regulations pertaining to weighing and measuring devices which they are registered to service. They shall refrain from removing the rejected tag or condemn tag or issuing of a Placing in Service Report, unless said device meets all legal requirements.
(iii) Registration with the Department of Agriculture shall be on a voluntary basis and the foregoing shall not preclude the right of any qualified individual who is not registered with the Department of Agriculture to install, service, repair and/or adjust weighing and measuring devices.
(iv) Weighing or measuring devices to be used for the purpose of buying or selling which have been installed, serviced or repaired by a person not registered, shall not be used until sealed as correct by an official inspector from the Wyoming Department of Agriculture, or placed into service by a registered service technician.
(v) Any weighing or measuring device, serviced, repaired, or installed by a registered service technician shall be sealed with a seal approved by the Department of Agriculture.
(vi) The Department of Agriculture shall reserve the right to cancel the registration of any service technician after careful consideration and good cause. Upon suspension of a registration, the holder of this registration may appeal in accordance with the Administrative Procedures Act.
