Section 1. Authority. Pursuant to the authority vested In the Commissioner of Agriculture in accordance with Section 40-87, Wyoming Statutes 1957, the following regulations are hereby promulgated.
Section 2. Registration of Weighing & Measuring Device Servicemen. For the benefit of and as a convenience to the users, manufacturers, and distributors of weighing and measuring devices in the State of Wyoming, and to those persons installing, servicing and repairing such instruments, and the Department of Agriculture, Division of Markets & Industry, Weights and Measures Section, shall accept applications for registration for persons qualified by training and experience, to install, service and repair weighing and/or measuring devices.
A certificate of registration shall be issued to any person satisfactorily passing examination and has adequate equipment to properly service and test weighing and/or measuring devices.
A holder of a certificate of registration shall have authority to:
a. Remove condemned tags placed on weighing and measuring devices by authorized weights and measures officials.
b. Place in service on a temporary basis, repair devices which have been previously condemned and newly installed devices, (including new and used devices), until such time as official inspection can be made by an authorized inspector.
c. Place in service, devices inspected and tested by him, pending official inspection.
(1) All registered servicemen, shall use a standard Placing in Service Report that has been approved by the Department of Agriculture. Said registered servicemen shall execute the Place in Service Report for all devices that he repairs and/or adjusts, which have been previously condemned by an authorized weights and measures inspector. He shall also execute this same report for all devices which are newly installed, (including new and used devices). When a condemned tag is removed from a device, said tag shall be attached to the original Placing in Service Report, and the original shall be mailed to the Department of Agriculture, Division of Markets & Industry, Weights & Measures Section, 313 Capitol Building, Cheyenne, Wyoming, 82001, within 24 hours after the device has been placed in service. The duplicate shall be left with the user of the device and the triplicate retained by the registered serviceman.
(2) Each registered serviceman shall have a thorough knowledge of all laws, specifications, tolerances, rules and regulations pertaining to weighing and measuring devices which he is registered to service. He shall refrain from removing the condemned tag or issuing of a Placing in Service
Report, unless said device meets all legal requirements. The testing equipment used by a registered serviceman shall be submitted for approval upon request.
(3) Registration with the Department of Agriculture shall be on a strictly voluntary basis and the foregoing shall not preclude the right of any qualified serviceman who is not registered with the Department of Agriculture to install, service, repair and/or adjust weighing and measuring devices.
(4) Permission to remove the condemned tag by a nonregistered serviceman or owner, for the purpose of making repairs, shall first be obtained from the Wyoming Department of Agriculture. Weighing or measuring devices to be used for the purpose of buying or selling which has been installed, serviced or repaired by a person not registered, shall not be used until sealed as correct by an official inspector from the Wyoming Department of Agriculture, Division of Markets & Industry, Weights & Measures Section.
(5) Any weighing or measuring device, serviced, repaired, or installed by a registered serviceman shall be sealed with a seal approved by the Department of Agriculture.
(6) The Department of Agriculture shall reserve the right to cancel the registration of any serviceman after careful consideration and a good cause.
