1. (1) This chapter applies to an association if:

   1. (a) the association's declaration states that this chapter applies; or
   2. (b) if the association's declaration does not state whether this chapter applies, the plats of the association are designated as condominium plats.
2. (2) This section applies regardless of when an association is created.
