The following words and terms, when used in this subchapter, shall have the following meanings, unless the context clearly indicates otherwise.

1. (1) Department--The Texas Department of Transportation.
2. (2) Division director--The director of the department's Rail Division.
3. (3) FRA--The Federal Railroad Administration.

4. (4) Railroad--Any form of nonhighway ground transportation that runs on rails or electromagnetic guideways.

   1. (A) Railroad includes:

      1. (i) commuter or other short-haul railroad passenger service in a metropolitan or suburban area; and
      2. (ii) high speed ground transportation systems that connect metropolitan areas, without regard to whether those systems use new technologies not associated with traditional railroads.
   2. (B) Railroad does not include rapid transit operations in an urban area that are not connected to the general railroad system of transportation.
