The following words and terms, when used in this subchapter, shall have the following meanings unless the context clearly indicates otherwise.

1. (1) Commission--The Texas Transportation Commission.
2. (2) Department--The Texas Department of Transportation.
3. (3) Director--The director of the right of way division of the department or the director's designee not below the level of section director.
4. (4) Executive director--The executive director of the department or the executive director's designee not below the level of deputy executive director or assistant executive director.
5. (5) District--One of the 25 geographical district offices of the department.
6. (6) District engineer--The chief executive officer in charge of a district of the department.
7. (7) Highway asset--An interest in real property that is held or controlled by the department for a highway or department purpose.
