1. (a) The Commissioner shall maintain a list of the names of all certified members and associate members granted permission under these sections to use the mark. The list shall be available upon request for public inspection during normal business hours in the offices of the Texas Department of Agriculture, 1700 North Congress Avenue, in Austin, Texas.

2. (b) Procedure for renewal of licensees authorized to use the mark, which shall be made every three years.

   1. (1) Forty-five days before the expiration date of the registration the department shall mail to each licensee a renewal application.
   2. (2) Within 30 days of receipt by the department of the renewal application, the department will mail to the licensee a renewal license agreement.
   3. (3) Failure to remit the renewal application by the due date shall result in the licensee being designated as inactive. Failure to remit renewal application within 366 days of the due date shall result in the expiration of the license and a new application for certified membership or associate membership will be required for re-instatement to the program.
