Any bond executed as a condition for holding office as a public weigher shall be:

1. (1) signed by a bonding agent licensed by the State Board of Insurance to do business in Texas;
2. (2) completed on a form prescribed by the department. The bond form may be obtained from the department; and

3. (3) filed in the following manner:

   1. (A) state public weighers shall file the bond with the department; or
   2. (B) county and deputy public weighers shall file the bond with the office of the county clerk of the county in which the public weigher intends to operate.
