1. (a) The director is the custodian of records of the Texas Municipal Retirement System. Certain information in the custody of the retirement system concerning an individual member, retiree, annuitant or beneficiary is confidential under §855.115, Government Code, and may not be disclosed except as provided in that section.
2. (b) The director shall appoint a staff member to coordinate release of records of the retirement system that are subject to request as public information under the provisions of the public information law, Chapter 552 of the Government Code. This staff member will certify to the authenticity of copies of board records.
3. (c) Information regarding release of these records will be prominently posted and will contain basic information regarding the rights of the requester, the responsibilities of a governmental body and the procedures for inspecting or obtaining copies of public information.
4. (d) Each request for information must be made in writing.

5. (e) The following is a summary of fees for providing copies of public information:

   1. (1) Standard paper copy--$0.10 per page.

   2. (2) Nonstandard-size copy:

      1. (A) Diskette--$1.00 each;
      2. (B) Zip Diskette -- $5.00 each;
      3. (C) Writeable CD -- $1.50 each;
      4. (D) VHS videocassette -- $2.50 each;
      5. (E) Audiocassette--$1.00 each;
      6. (F) Oversized paper copy--$0.50 each; and
      7. (G) Other--Actual cost.

   3. (3) Personnel charge:

      1. (A) Programming personnel--$26 per hour; and
      2. (B) Other personnel--$15 per hour.
   4. (4) Overhead charge--20% of personnel charge.

   5. (5) Microfiche or microfilm charge:

      1. (A) Paper copy--$0.10 per page; and
      2. (B) Fiche or film copy--Actual cost.
   6. (6) Remote document retrieval charge--Actual cost.

   7. (7) Computer resource charge:

      1. (A) Client/Server--$2.20 per hour; and
      2. (B) PC or LAN--$1.00 per hour.
   8. (8) Miscellaneous supplies--Actual cost.
   9. (9) Postage and shipping charge--Actual cost.
   10. (10) Photographs--Actual cost.
   11. (11) Other costs--Actual cost.
   12. (12) Outsourced/Contracted Services--Actual cost.
   13. (13) No Sales Tax--No Sales Tax shall be applied to copies of public information.
6. (f) Any member of the legislature shall not be charged for one copy of a record while performing his/her duties. Additionally, if it is determined by the director that providing certain records benefits the general public, fees will not be required for these records.
7. (g) All funds collected from releasing copies of records shall be credited to the expense fund under the administration of the board.
