- (a) The governing body of a county with a population of 150,000 or less, on completion and approval of the feasibility study and survey by the Commissioner, on its own motion and without presentation and approval of a certified petition to the Board may propose an election to authorize a branch campus maintenance tax.
- (b) The governing body of an independent school district or county notwithstanding subsection (a) of this section, shall present a certified petition to the Commissioner who shall then present it to the Board for approval or disapproval.
- (c) After the petition and any additional documentation or information are presented to the Commissioner, a minimum of 45 days must elapse between the date on which the petition and supporting documents are received by the Commissioner and the quarterly meeting of the Board when the Board will consider the petition.
