1. (a) If an institution wishes to appeal the recommendation of the Restricted Research Review Panel, the President of the institution shall notify the Commissioner, in writing, not later than September 1.
2. (b) After completion of the institutions' annual financial reports, scheduled audits of restricted research expenditures, and incorporation of corrections from audits, each eligible institution shall provide the Commissioner with a final report of restricted research expenditures.
3. (c) Each institution shall provide to the Commissioner a copy of the institution's fiscal year report to the Legislative Budget Board that describes the expenditures of the allocation from the Research Development Fund within 30 days of submission to the Legislative Budget Board.
4. (d) The Commissioner may reduce an institution's allocation from the Research Development Fund as a penalty for failure to comply with recommendations made by the review panel, the auditors, or the Commissioner. In determining such a penalty, the Commissioner shall consider any excess distribution(s) received by the institution as a result of not complying with the recommendations.
