- A. Any person required to register pursuant to the provisions of the Sex Offenders Registration Act who violates any provision of said act shall, upon conviction, be guilty of a Class B5 felony offense. Any person convicted of a violation of this section shall be punished by imprisonment in the custody of the Department of Corrections for not more than five (5) years, a fine not to exceed Five Thousand Dollars ($5,000.00), or both such fine and imprisonment.
- B. Any person required to register pursuant to the Sex Offenders Registration Act who fails to comply with the established guidelines for Global Positioning System (GPS) monitoring shall, upon conviction, be guilty of a Class B5 felony offense punishable by a fine not to exceed One Thousand Dollars ($1,000.00), or by imprisonment in the custody of the county jail for not more than one (1) year, or by both such fine and imprisonment.
