PURPOSE: This rule describes why and when a petition may be withdrawn or dismissed.

1. (1) If the chairman determines after an investigation that the petition has not been timely filed or that no valid question concerning the representation of employees exists in a prima facie appropriate unit, s/he may request the party filing such petition to withdraw the petition without prejudice or in the absence of such withdrawal, within a reasonable time, s/he may dismiss the petition. Such action may be taken by the chairman at any time prior to the closing of the case.
