PURPOSE: This rule describes why and when a petition may be withdrawn or dismissed.
- (1) If the chair determines after an investigation that the petition has not been timely filed or that no valid question concerning the representation of employees exists in a prima facie appropriate unit, the chair may request the party filing such petition to withdraw the petition without prejudice or in the absence of such withdrawal, within a reasonable time, the chair may dismiss the petition.
