Petition for Unit Claification

PURPOSE: This rule describes who may file a petition for clarification of bargaining unit of certification and the contents of the petition.
- (1) The petition may be filed by the certified representative, the voluntarily recognized representative, the public employer, or both. Petitioner(s) seeks clarification of placement of certain job classifications of a bargaining unit previously certified by the State Board of Mediation or voluntarily recognized by the employer.
(2) A petition for clarification in addition to setting forth the information required by 8 CSR 40-2.030(1)(A) and (D)–(H), shall contain the following:
- (A) A description of the present certified or voluntarily recognized unit and the date of the certification or voluntary recognition;
- (B) The proposed clarification of the unit; and
- (C) A statement by petitioner setting forth reasons as to why clarification is requested.
