PURPOSE: This rule describes who may file a petition for clarification of bargaining unit or amendment of certification and the contents of the petition.

1. (1) The majority representative or the public employer may file a petition for clarification of a bargaining unit or amendment of any certification issued by the chairman or the board.

2. (2) A petition for clarification or amendment, in addition to setting forth the information required by 8 CSR 40-2.030(1)(A) and (D)— (I), shall contain the following:

   1. (A) A description of the present negotiation unit and the date of the certification or recognition;
   2. (B) The proposed clarification or amendment of the unit; and
   3. (C) A statement by petitioner setting forth reasons as to why clarification or amendment is requested.
