PURPOSE: The Department of Elementary and Secondary Education has the authority to receive and expend federal funds for educational programs and to establish regulations for the administration of the programs in accordance with controlling federal statutes and regula. tions. This rule sets forth the general administrativeproceduresforthedepartmerit’s implementation of the Robert C. Byrd Honors Scholarship Program, which is a federally funded program authorized under Title IV, Part A, Subpart 6 of the Higher Education Act of 1965. American College Test test scores. Ininstances when the number of scholarships is not evenly divisible by nine (9), an equal number will be awarded in each congressional district. The remaining scholarships will be declared at large scholarships. These will be used to provide awards to both students in the event of . a tie in scores, grade point average and class rank. In the event of a tie involving a general educational development student, both students would receive scholarships. Any
