2 CSR 10-3.010 Usage Fees for the KC1 Auth: section 261.020, RSMo (1986). Multipurpose Export Facility Original rule filed April 16, 1990, effective Sept. 28,199O. PURPOSE: This rule establishes and fixes the uarious fees md charges for facility usage and housing of liuestock and agricultural products at the KU Multipurpose Ezport Facility in Kansas City, Missouri prior to shipment. (1) The following fees are established by the director of the Department of Agriculture for livestock and agricultural products being housed at the KC1 Multipurpose Export Facility prior to shipment:

1. (A) The director will charge eight dollars ($8)~ headforthefirsttwenty-four(24) hours for cattle and twelve dollars ($12) per head after the first twenty-four (24) hours, with a minimum fee of one hundred fifty dollars ($150);
2. (B) The director will charge five dollars ($5) per head for the first twenty.four 124) hours for hogs and sheep, and seven dollars and fifty cents ($7.50) per head after the first twenty. four (24) hours, with a minimum fee of one hundred fifty dollars ($150);
3. (C) The director will charge twenty-two dollars ($22) per head for the first twenty-four

4. (24) hours for horses and thirty-three dollars ($33) per head after the first twenty-four (24) hours, with aminimumfeeofone hundred fifty dollars ($150);

   1. (D) The director will charge a deposit fee of one hundred fifty dollars ($150) to be paid at the time of scheduling a shipment. Deposit fees are nonrefundable; and
   2. (E) An additional fee for resting animals will be charged representing fifty percent (50%) of the total rate charges which will include ., penning and water. Fees for feed and bedding will be prorated.
5. (2) The fee structure for zoo animals will be assessed on an individual basis with a minimum fee of one hundred fifty dollars ($150).
6. (3) The fee structure for other agricultural products and materials will be negotiated on a cost-recovery basis by the Department of Agriculture and the requesting agent in advance of shipment with a minimum fee of one hundred fifty dollars ($150).

7. (4) The provisions of this rule are declared severable. If any fee fixed by this rule is held invalid by a court of competent jurisdiction or by the Administrative Hearing Commission,
