Usage Fees for the KCI Multipurpose Export Facility

PURPOSE: This rule establishes and fixes the various fees and charges for facility usage and housing of livestock and agricultural products at the KCI Multipurpose Export Facility in Kansas City, Missouri prior to shipment.
(1) The following fees are established by the director of the Department of Agriculture for livestock and agricultural products being housed at the KCI Multipurpose Export Facility prior to shipment:
- (A) The director will charge eight dollars ($8) per head for the first twenty-four (24) hours for cattle and twelve dollars ($12) per head after the first twenty-four (24) hours, with a minimum fee of one hundred fifty dollars ($150);
- (B) The director will charge five dollars ($5) per head for the first twenty-four (24) hours for hogs and sheep, and seven dollars and fifty cents ($7.50) per head after the first twenty-four (24) hours, with a minimum fee of one hundred fifty dollars ($150);
- (C) The director will charge twenty-two dollars ($22) per head for the first twentyfour (24) hours for horses and thirty-three dollars ($33) per head after the first twentyfour (24) hours, with a minimum fee of one hundred fifty dollars ($150);
- (D) The director will charge a deposit fee of one hundred fifty dollars ($150) to be paid at the time of scheduling a shipment. Deposit fees are nonrefundable; and
- (E) An additional fee for resting animals will be charged representing fifty percent (50%) of the total rate charges which will include penning and water. Fees for feed and bedding will be prorated.
- (2) The fee structure for zoo animals will be assessed on an individual basis with a minimum fee of one hundred fifty dollars ($150).
- (3) The fee structure for other agricultural products and materials will be negotiated on a cost-recovery basis by the Department of Agriculture and the requesting agent in advance of shipment with a minimum fee of one hundred fifty dollars ($150).
- (4) The provisions of this rule are declared severable. If any fee fixed by this rule is held invalid by a court of competent jurisdiction or 2 CSR 10-3
by the Administrative Hearing Commission, the remaining provisions of this rule shall remain in full force and effect unless otherwise determined by a court of competent jurisdiction or by the Administrative Hearing Commission.
