Subd. 1. Requirement.

Beginning January 1, 2005, except for a commercial animal waste technician, only a certified private manure applicator may apply animal waste from a feedlot that:

1. (1) has a capacity of 300 animal units or more; and
2. (2) does not have an updated manure management plan that meets the requirements of pollution control agency rules.

Subd. 2. Certification.

1. (a) The commissioner shall prescribe certification requirements and provide training. The training may be done in cooperation with other government agencies and must be at least three hours in duration.
2. (b) A person must apply to the commissioner for certification as a private manure applicator. The certification expires March 1 of the third calendar year after the initial year of certification.
3. (c) The commissioner shall issue a private manure applicator card to a certified private manure applicator.

Subd. 3. Fees.

1. (a) A person applying to be certified as a private manure applicator must pay a nonrefundable $10 application fee.
2. (b) A $5 fee must be paid for the issuance of a duplicate private manure applicator card.
