410.1 In addition to the general suitability screening, individuals applying for or occupying safety sensitive positions are subject to the following checks and tests:

1. (a) Criminal background check;
2. (b) Traffic record check (as applicable);
3. (c) Pre-employment drug and alcohol test;
4. (d) Reasonable suspicion drug and alcohol test;
5. (e) Post-accident or incident drug and alcohol test;
6. (f) Random drug and alcohol test; and
7. (g) Return-to-duty or follow-up drug and alcohol test.

410.2 Subject to the requirements of § 409.1(a), examples of safety sensitive duties and responsibilities include, but are not limited to:

1. (a) Operating large trucks, heavy or power machinery, or mass transit vehicles, tools, or equipment;
2. (b) Handling hazardous quantities of chemical, biological or nuclear materials;
3. (c) Maintaining the safety of patrons in and around a pool or aquatic area;
4. (d) Engaging in duties directly related to the public safety, including, but not limited to, responding or coordinating responses to emergency events;
5. (e) Carrying a firearm; and
6. (f) Direct care and custody of children, youth, or other vulnerable persons, which may affect their health, welfare, or safety.
