7 CCR 1101-7 – Standards for Public School Buildings and Structures

DEPARTMENT OF LABOR AND EMPLOYMENT Division of Oil and Public Safety STANDARDS FOR PUBLIC SCHOOL BUILDINGS AND STRUCTURES 7 CCR 1101-7 [Editor’s Notes follow the text of the rules at the end of this CCR Document.]

1.1 Purpose.

Pursuant to Colorado Revised Statutes sections 22-32-124 and 23-71-122 and 8-1-107 as amended, this regulation is promulgated to incorporate updated codes for the construction and inspection of public school buildings and structures, in the interest, safety and welfare of the general public.

1.2 Repeal.

All prior standards for public school buildings and structures are hereby repealed.

1.3 Effective date.

These standards shall be effective April 24, 2008.

2.1 Standards.

After duly conducting a public hearing thereon, in accordance with C.R.S. 24-4-103, as amended, the Colorado Division of Oil and Public Safety does hereby adopt and promulgate as Colorado standards for erection and for purposes of inspection, of public school buildings and structures of the following codes as being the published codes of nationally recognized associations or organizations.

2.1.1 International Building Code – 2003 Edition, First Printing: December 2002 (Copyright 2002 by International Code Council, Inc. - Falls Church, Virginia) 2.1.2 International Fire Code – 2003 Edition, First Printing: December 2002 (Copyright 2002 by International Code Council, Inc. - Falls Church, Virginia) 2.1.3 International Mechanical Code – 2003 Edition, Second Printing: May 2003 (Copyright 2003 by International Code Council, Inc. - Falls Church, Virginia) Effective January 1, 2009 the Colorado Division of Oil and Public Safety will adopt the 2006 editions of the codes referenced in sections 2.1.1, 2.1.2 and 2.1.3, as well as the International Energy Conservation Code – 2006 Edition.

Interested parties may inspect or obtain information for the referenced incorporated materials by contacting Schools Construction Program Manager, Division of Oil and Public Safety, 633 17th Street, Suite 500, Denver, Colorado 80202, and / or The State Depository Libraries.

3.1 Availability.

The Division of Oil and Public Safety shall maintain copies of the complete texts of the codes hereinabove, adopted as said standards, which copies shall be available for public inspection during regular business hours.

3.2 Definitions.

Building Permit: An official document issued by The Division of Oil and Public Safety which authorizes performance of the erection, alteration, demolition and/or moving of buildings and structures. Certificate of Occupancy: An official document issued by The Division of Oil and Public Safety which authorizes a building or structure to be used or occupied. Core and Shell Permit: An official document issued by The Division of Oil and Public Safety which authorizes construction of base structure foundation, columns, floor slabs, and roof structure, exterior walls, and exterior glazing.

Demolition Only Permit: An official document issued by The Division of Oil and Public Safety which authorizes demolition of all or part of a building or structure. Foundation: Work related to building footings, piers, foundation walls, slabs on grade, under slab and underground building services.

Foundation Only Permit: An official document issued by The Division of Oil and Public Safety which authorizes construction of foundations.

Small Construction Project: Includes, installation of one or more new security gate, new window: interior/exterior, new door: fire rated, new door: non-fire rated, magnetic hold open device, wall: non-load bearing, skylight, new playground, partition over 5'-9", new operable partition, recreational equipment supported by structure, occupational therapy hook, dugout (fence), dugout (CMU), shop/vocational instruction equipment, shade structure, One or more Portable Modular’s, Re-Roofs, installation involving roof penetration, alteration of door: adding window/glazing in door, alteration of door hardware: panic hardware, or area that changes in use (Interior).

Temporary Certificate of Occupancy: An official document issued by The Division of Oil and Public Safety which authorizes a building or structure to be temporarily used or occupied for a period not to exceed 90 days, unless an extension has been granted by the Director. ARTICLE 4 PLAN REVIEW AND ISSUANCE OF A CONSTRUCTION PERMIT 4-1 Plan review fee.

The Director of the Division shall charge a fee for plan review and issuance of a construction permit within the ranges in Table 4-1 to cover the actual, reasonable, and necessary expenses of both the Division of Oil and Public Safety in the Department of Labor and Employment and the Division of Fire Safety in the Department of Public Safety. The ranges of fees were calculated based upon the number of projects received in FY 2006 and the anticipated annual expenses as appropriated by the legislature. The fees incorporate a base rate of $50.00, a multiplier of 0.0065 for the first calculated range ($2,001 to $25,000), and a discount factor of 0.641 to integrate economies of scale for subsequent ranges. The actual fee, for a particular dollar amount within these ranges, will be available on the OPS website. Table 4-1 – Plan Review Fees Table 4-1 – Plan Review .

The Director of the Division will review the fund balance periodically and may reduce the amount of the fee, if necessary, pursuant to section 24-75-402 (3), C.R.S., in order to reduce the uncommitted reserves of the fund. The new fee structure will be calculated according to the formula identified in Section 4-1, with the exception that the multiplier of 0.0065 will be adjusted in order to decrease the fees collected to reflect the revised number and costs of projects received. The reduced fee schedule (with the dates of applicability) will be available on the OPS website. The fee schedule applied to a project will be the fee schedule in effect on the date of issuance of the construction permit. 4-3 Plan review fee – increased.

The Director of the Division may increase the amount of the fee as provided in section 24-75-402 (4), C.R.S., if necessary. The new fee structure will be calculated according to the formula identified in Table 4-1 with the exception that the multiplier of 0.0065 will be adjusted in order to increase the fees collected to reflect the revised number and costs of projects received. The increased fee schedule (with the dates of applicability) will be available on the OPS website. The fee schedule applied to a project will be the fee schedule in effect on the date of issuance of the construction permit. 4-4 Building construction notification The school district, charter school, and junior college (hereinafter “board” ) must notify the Department of Labor and Employment, Division of Oil and Public Safety, the certified local fire department, and the Department of Public Safety, Division of Fire Safety within five days of initiating a project. Notification is to include:

(a) Name of project (including district);

(b) Location of project;

(d) Projected cost;

(e) Planned construction start and end dates;

(f) Schedules for schematic documents, design documents, and construction documents; and (g) Selection of delegation for fire review (local fire department or Division of Fire Safety) Section 4-5 Building Permit Application Process 4-5-1 Preliminary Application Package Review (a) For all construction projects with a projected value equal to, or in excess of, $500,000, the board must hold a preliminary review meeting with the Division of Oil and Public Safety and the certified local fire department or the Division of Fire Safety at the appropriate design stage of document preparation.

(b) The preliminary review package should include:

(1) A site plan, showing the property address(s) (or legal description), boundaries, existing buildings, proposed buildings and/or additions, parking lots, fenced areas, fire hydrants, fire equipment access, water supply and topography.

(2) Sufficient documentation to illustrate and describe the design of the project, establishing the scope, relationships, forms, size and appearance of the project by means of plans, sections and elevations, typical construction details, and equipment layouts. The documents shall include outline specifications that identify major materials and systems and establish in general their quality levels.
2. (3) A code plan that includes the following minimum information,
  1. (A) Calculation of the allowable and actual square footage of the new construction;
  2. (B) The floor plan of all new construction, existing to remain, and remodel areas;
  3. (C) The proposed occupancy group(s) of the building. Include daytime use and after- hours use occupancy groups where applicable;
  4. (D) All fire and smoke rated construction (including rated exit corridors, fire walls, fire barriers, fire partitions, smoke barriers), and construction capable of resisting the passage of smoke; and (E) All exits and all stairways.
3. (4) A letter attesting that the board has consulted with the Colorado Geological Survey regarding potential swelling soil, mine subsidence, and other geologic hazards and to determine the geologic suitability of the site for its proposed use, as required by C.R.S. 2-32-124 (1).

(c) Upon completion of the preliminary review meeting, the Division of Oil and Public Safety will provide to the board a comprehensive list of corrections from The building, mechanical code review conducted in the preliminary meeting to be incorporated into the final project construction documents. This list of corrections shall not be considered as all inclusive, and may not be considered as approval of any condition in violation of applicable code.

(d) The Division of Oil and Public Safety, Certified local fire department and/or the Division of Fire Safety, and the board may request a meeting or teleconference, in a timely manner, at any time during the preliminary review. The Division of Oil and Public Safety shall make reasonable accommodations for such meeting or teleconference.

4-5-2 Building Permit Application Submittal (a) For all construction projects not covered under an annual building permit as defined in code , the board must submit a complete plan review application package to the Division of Oil and Public Safety, the Certified local fire department, and the Division of Fire Safety not less than 30 days prior to beginning construction. The board may request from the Division of Oil and Public Safety an exemption to the 30 day minimum submittal time frame which will be considered on a case by case basis.

(b) The plan review application package must contain the following items listed below, except for small construction projects as defined in section 3-2

(1) A fully completed plan review application, signed by the applicant, on the form provided by the Division of Oil and Public Safety (available on the Division of Oil and Public Safety website); http://oil.cdle.state.co.us/Public%20Safety/Schools/schoolconstruction.sp (2) A code analysis as required by 4-5-1 (b) 2;
1. (3) Two full sets of construction documents (Both full size or one full and one half size), signed and wet stamped by the design professional in responsible charge, and by all design professionals in each of the design disciplines represented in the project;
2. (4) Two full sets of construction specifications (full size), signed and wet stamped by the design professional in responsible charge, and by all design professionals in each of the design disciplines represented in the project;
3. (5) A statement of special inspections, as required by IBC Section 1704; and (6) Documentation of design compliance with the International Energy Conservation Code. 4-5-3 Plan Review and Permitting

(a) The Division of Oil and Public Safety will notify the board upon receipt of a complete Building Permit Application Submittal or of incomplete Building Permit Application Submittals.

(b) The Certified local fire department and/or the Division of Fire Safety have ten business days to submit the completed fire review to the Division of Oil and Public Safety. The local fire department and/or the Division of Fire Safety may request in writing, an extension from the Division of Oil and Public Safety on the basis of the complexity of the building plans.

(c) Upon completion of the review, and after receipt of the fire review from the Certified local fire department and/or the Division of Fire Safety, the Division of Oil and Public Safety will provide to the board a comprehensive list of corrections from both building and fire code reviews to be addressed prior to the issuance of a Building Permit. This list of corrections shall not be considered as all inclusive, and may not be considered as approval of any condition in violation of applicable code.

(d) The Division of Oil and Public Safety, Certified local fire department and/or the Division of Fire Safety, and the board may request a meeting or teleconference, in a timely manner, at any time during the final review. The Division of Oil and Public Safety shall make reasonable accommodations for such meeting or teleconference.

4-5-4 Phased Permitting Upon request by the board, the Division of Oil and Public Safety may issue phased permits for demolition, construction of foundations, and construction of core and shell, provided that construction documents for the whole building or structure have been submitted per section 4-5-2. The holder of such permit for demolition, or the construction of foundations or vertical construction shall proceed at the holder’s own risk with building operation and without assurance that a permit for the entire structure will be granted. Issuance of this permit shall not be considered all inclusive and may not be considered as approval of any condition in violation of applicable codes.

5 Certification Inspectors for plan review and construction inspections shall be certified by the international code council, or another similar national organization, or have at least five years of commercial construction experience with a demonstrated knowledge of the International Building Code. 6 Inspections The Division of Oil and Public Safety shall be provided with notification in writing at least 7 days prior to any requested inspection.

7 Certificate of Occupancy The board shall not occupy or use a public school building or structure until a certificate of occupancy, or a temporary certificate of occupancy has been issued by the Division of Oil and Public Safety.
