2. The State of Wyoming, Department of Administration & Information, hereby gives public notice in accordance with W.S.16-3-103 (1977 as amended) of intent to amend and adopt rules. The proposed amendments and new rules will be adopted pursuant to the rule making authority of the Human Resources Division, W.S 9-2-1022. The proposed rule change meets minimum substantive state statutory requirements. The Department of Administration and Information, Human Resources Division, intends to amend the State of Wyoming Personnel Rules to provide for the implementation of the recently enacted, Enrolled Act No 50 Chapter 120 which provides for the modification of the State of Wyoming Employee Classification and Compensation Plan. Revisions, additions and deletions have been made in the following chapters:
Chapter 1, General Provisions Chapter 2, Recruitment Chapter 4, Examinations Chapter 5, Register of Eligible Applicants Chapter 6, Candidacy and Appointment Chapter 7, Position Control Chapter 8, Position Classification Chapter 9, Compensation Chapter 10, Leave Chapter 11, Discipline for Permanent Employees Chapter 12, Grievances and Appeals
3. Statement of Reasons
In accordance with W.S. 9-20-1022 and 16-3-103, the Human Resources Division of the Department of Administration and Information has amended the State of Wyoming Personnel Rules of the Executive Branch of Wyoming State Government as listed above, effective upon filing with the Secretary of State. These rules supersede all other State of Wyoming Personnel Rules as listed above and previously filed for the Executive Branch of Wyoming State Government. Recently enacted, Enrolled Act No 50 Chapter 120 provides for the modification of the State of Wyoming's employee classification and compensation plan. The proposed date for the implementation of the new classification and compensation plan is July 1, 2009. To effectuate the implementation of the newly developed classification and compensation plan, the State of Wyoming Personnel Rules must be amended. Directly related to the new classification and compensation plan, rules changes have been made to Chapter 6, Candidacy and Appointment, Chapter 7, Position Control, Chapter 8, Position Classification and Chapter 9, Compensation. Chapter 2, Recruitment, Chapter 4, Examination, and Chapter 5, Register of Eligible Applicants, have also been amended to reflect changes to the recruitment and selection procedures. These chapter changes have also been necessitated by the implementation of the on-line application system. Chapter 1, General Provisions, Chapter 10, Leave, and Chapter 12, Grievances and Appeals for Permanent Employees, have been amended to reflected procedural changes.
4. This agency welcomes all comments and suggestions on these proposed rules. A copy of the proposed rules are available and may be viewed at: The Human Resources Division, 2001 Capitol Avenue, Cheyenne, WY 82002, or at http://personnel.state.wy.us. Comments and suggestions may be submitted either by writing to the Human Resources Administrator, 2001 Capitol Avenue, Cheyenne, WY 82002 or at the scheduled public hearing to be held on Monday, June 1, 2009 from 8:00 am to 12:00 pm in the Herschler Building, Room B63,122 West 25th Street, Cheyenne, WY. All comments and suggestions must be received by the Human Resources Division by 5:00 pm on Monday, June 1, 2009.
5. These are not new rules.
6. Any person may urge the agency not to adopt the rules and also request the agency to state its reasons for overruling the consideration urged against the adoption. Requests for an agency response must be made prior to, or within thirty (30) days after adoption of the rule, addressed to the address in item 1. If timely objections are submitted, the agency will provide the objecting person with a written response explaining and substantiating the agency position by reference to federal law or regulation.
7. These rules have not been adopted, amended or repealed to comply with federal law or regulatory requirements.
