Chapter 2: Organization, Responsibilities and Duties of Board

Section 1. Election of Officers. The Board shall annually elect from its own membership a chairperson, a vice-chairperson, and a secretary-treasurer who shall assume the duties of their offices at the close of the meeting at which they are elected and serve for a term of one (1) year. If an officer resigns or vacates his or her position prior to the expiration of his or her term, the Board may elect a replacement to serve the remainder of the term.
(a) The chairperson shall set the time and place of all meetings. When present, the chairperson shall preside at all meetings although at contested hearings, the chairperson may designate an attorney or another Board officer to preside at the hearing. The chairperson shall appoint all committees, sign all original certificates issued, and perform all other duties ordinarily pertaining to the office of chairperson. The chairperson shall prepare the annual report of the Board, shall cause the same to be distributed as the Board may direct, and shall assist the secretary-treasurer in matters of advice and in preparation of correspondence and reports as agreed upon by the Board.
(b) The vice-chairperson shall perform all the duties prescribed for the chairperson in the absence of the chairperson. The vice-chairperson shall assist the secretary-treasurer in matters of advice and in preparation of correspondence and reports as agreed upon by the Board.
(c) The secretary-treasurer shall, with the assistance of such staff as may be required, conduct and care for all the correspondence of the Board, sign and keep the minutes of all meetings, keep all books and records as herein provided, sign all fiscal documents, and assure that meetings are properly noticed. The secretary-treasurer shall receive all monies due to the Board, and deposit them with the State Treasurer.
Section 3. Meetings of the Board. The Board shall hold at least four (4) regular business meetings each year. The chairperson, the vice-chairperson, or any four (4) members may call other meetings to conduct the business of the Board. All meetings shall be open to the public and shall be advertised in a paper in general circulation in Wyoming at least ten (10) days prior to a meeting date. The Board may go into executive session when there is a need to protect information deemed confidential, pursuant to Chapter VII of these rules; to W.S. 16-4-201 through 16-4-205, Public Records; or as otherwise provided by law.
Section 4. Quorum. Five (5) members shall constitute a quorum, but a majority of the Board is needed to take action.
(a) It is grounds for recommending removal from the Board if a member:
(i) Does not have the prerequisite professional qualifications for appointment on the Board as required by W.S. 33-41-108(a)(ii) through (iv);
(ii) Does not maintain residency in the State of Wyoming as required by W.S. 33-41-108(a)(i);
(iii) Fails to attend at least one-half (1/2) of the regularly scheduled meetings held in all years subsequent to his or her appointment; or
(iv) Violates any of the statutes or rules and regulations governing this Board, including the Code of Professional Conduct.
(b) If a ground for removal of a Board member exists, the Board's actions taken during the existence of the ground for removal are not invalid for that reason.
(a) The Board shall determine if an applicant for certification as a geologist-in-training or an applicant for registration as a professional geologist has satisfied all the requirements required by the Act and these rules. This determination shall require a majority vote of the Board.
(b) The Board shall determine if an individual meets the provisions for exemption from registration as defined in W.S. 33-41-117. This determination shall require a majority vote of the Board.
(c) The Board may designate a member of the office staff and/or other individuals as its designee(s).
(d) The Board or its designee shall maintain a current list of all states, territories, or possessions of the United States, the District of Columbia, or foreign countries in which the requirements and qualifications for licensing are comparable to those established in the State of Wyoming and where a reciprocity agreement exists.
(e) The Board or its designee shall prepare or have prepared information of public interest describing the regulatory functions of the Board and the procedures by which complaints are filed and resolved.
(f) The Board or its designee shall prepare and maintain an up-to-date registration list showing the names, places of business, and telephone numbers of all certified geologists-in-training and professional geologists registered in Wyoming. This information shall be placed on file with the Secretary of State, and may be furnished to any person upon request.
(g) The Board may establish procedures to evaluate, recognize, prepare, accredit, or administer continuing education programs for individuals regulated by the Board.
(h) The Board may establish standards and procedures to evaluate and recognize geologic specialties. Standards and procedures for specialty registration may be established as deemed prudent to safeguard the public or any member thereof under the provisions of the Act.
(i) The Board may promulgate rules restricting advertising by trainees and registrants to prohibit false, misleading, or deceptive practices. The Board may not promulgate rules which:
(i) Restrict an individual's use of any medium of advertising;
(ii) Restrict an individual's personal appearance or use of his or her personal voice in an advertisement;
(iii) Relate to the size or duration of an advertisement by an individual; or
(iv) Restrict an individual's advertisement under a trade name.
(j) The Board may not promulgate rules restricting the use of the terms:
(i) 'Certified Professional Geologist' or 'C.P.G.' as used by the American Institute of Professional Geologists; or
(ii) 'Certified Petroleum Geologist' or 'C.P.G.' as used by the American Association of Petroleum Geologists--Division of Professional Affairs;
(iii) Provided that the full name of the organizations granting the certifications in (i) and (ii) are stated following the use of these terms, and that these terms are not used in such a manner that they tend to, or are likely to, create any impression with the public or any member thereof, that the individual is a professional geologist as defined by W.S. 33-41-102 (viii).
(k) The Board or its designee shall keep a file of all applications for certification as a geologist-in-training or for registration as a professional geologist.
(l) The files shall include:
(A) The original applications;
(B) Educational transcripts;
(C) Professional references; (D) Examination results; and (E) Other such information as may be deemed necessary by the Board.
(ii) Files related to rejected applicants may be held separate from files of approved trainees and registrants.
(l) The records of the Board shall be available for inspection by any person during normal business hours, except as provided for in Chapter VII of these rules; in W.S. 16-4-201 through 16-4-205, Public Records; or as otherwise provided by law.
(m) The Board shall have an official seal which shall be used on all certificates and registration documents issued by the Board, and on all other official business documents of the Board. The official seal of the Board shall be of a design approved by the Board.
(n) Upon written request from a registrant, the Board shall provide to another state, jurisdiction, or country, a verification of a registrant's status. This verification may include:
(i) Registration number; (ii) Date of registration; (iii) Current status of registration: (A) Final disciplinary dispositions; (iv) Type(s) of degree and date(s) awarded; (v) Basis of registration: (A) Grandfather clause; (B) Examination(s) [date(s) and minimum passing score(s)]; (C) Comity or reciprocity.
