CHAPTER 1

GENERAL PROVISIONS

Section 1. Authority. These Rules and Regulations are promulgated by the Wyoming State Board of Occupational Therapy pursuant to their authority under the Wyoming Occupational Therapy Practice Act, W.S. 33-40-101 et seq.

Section 2. Statement of Purpose. These Rules and Regulations are adopted to implement the authority of the Wyoming Board of Occupational Therapy to regulate the qualifications and standards of performance of occupational therapists and occupational therapy assistants practicing in Wyoming and to provide for enforcement and proper administration of the provisions of the Occupational Therapy Practice Act.

Section 3. Definitions. The definitions set out in the Act are hereby incorporated by reference into these Rules. In addition, as used in these Rules, the following definitions shall apply:

1. (a) 'Act' means the Occupational Therapy Practice Act (W.S. 33-40-101 et seq.).
2. (b) 'AOTCB' means The American Occupational Therapy Certification Board or its successor entity.
3. (c) 'Board' means the Wyoming Board of Occupational Therapy.
4. (d) 'Contact Hour' means one hour engaging in continuing education.
5. (e) 'Continuing Education Unit' means 10 (ten) contact hours.
6. (f) 'Inactive Status' means a license held in abeyance at the request of the licensee.
7. (g) 'Licensee' means any Registered Occupational Therapist or Certified Occupational Therapy Assistant as licensed or permitted by the Board.
8. (h) 'Relicensure' means the reissuance of a license to an applicant who has allowed a license to expire.
9. (i) 'Reactivation' means the renewal of a license to an applicant who has been on inactive status.
10. (j) 'State' means the State of Wyoming
11. (k) 'Temporary License' means a license issued to allow an applicant to practice while awaiting licensure by endorsement.

Section 4. Board Meetings.

(a) Notice of Board meetings shall be given to any person who requests such notice as specified by the Wyoming Administrative Procedures act. The notice shall specify the time and place of the meeting and the business to be transacted.

(b) All meetings shall be open to the public; the Board may conduct executive sessions in accordance with W.S. 16-4-403. In addition the board may hold closed sessions:

(i) To approve examinations;

(ii) Upon request of an applicant who fails an examination, to prepare a response indicating any reason for the applicants failure; or

(iii) To consider allegations or investigations of possible violations of the Act or these Rules.

(c) A majority of the Board members constitutes a quorum for the conduct of a Board meeting. The act of the majority of members present at a meeting, which includes a quorum, shall be the act of The Board.
