Section 1. Board Authorization. The Board is authorized to refuse to renew, or may deny, suspend, revoke or otherwise restrict the license or certification of any person violating provisions of the Act pursuant to W.S. 33-38-110.
Section 2. Grounds. The Board may also take action for unprofessional conduct.
(a) Unethical conduct shall include, but is not limited to:
(i) Willful violation of any provision of these Rules;
(ii) Suspension or revocation of a license or certification held in another jurisdiction. A certified copy of the disciplinary order shall be conclusive evidence;
(iii) Representation of oneself as licensed to engage in private practice in professional counseling, clinical social work, marriage and family therapy and/or addictions therapy without a license or certification;
(iv) Conviction of a felony or conviction of a high misdemeanor involving moral turpitude. The record of conviction certified by the clerk or judge of the court in which the conviction is held shall be conclusive evidence;
(v) Renting or lending the license or certification issued pursuant to this act to any person planning to use that license or certification;
(vi) Soliciting clients by any form of false or misleading communication.
(vii) Gross incompetence or malpractice.
(viii) Mental incompetency.
(ix) Knowingly submitting false information to the Board in any application.
(x) Habitual intemperate use of alcohol and/or a controlled substance.
(xi) Violation and conviction of a charge under the Wyoming Controlled Substance Act.
(xii) Sexual exploitation of a patient, defined as:
(A) Any behavior by a Licensee or Certificate which involves offers of exchange of professional services for some form of sexual gratification; or
(B) Unlawful or unprofessional sexual contact with a client.
(xiii) Willful violation of any provisions of this Act, W.S. 33-38-101, et. seq.
(b) Unethical conduct shall be a violation of any provision of the adopted Ethical Standards as set forth in Chapter VII of these Rules.
