CHAPTER 7

CERTIFICATION BY EXEMPTION REQUIREMENTS

The deadline to apply for this method of licensure expired on June 30, 1998. Licensure by exemption is not longer applicable. This language remains in the rules and regulations for historical purposes only.

Section 1. General Requirements. No certification by exemption shall be issued until the applicant has provided satisfactory evidence to the Board that:

1. (a) The applicant has reached the age of majority; and
2. (b) The applicant has no felony convictions, and no misdemeanor convictions involving moral turpitude, although exceptions to this requirement may be granted by the Board if consistent with the public interest; and
3. (c) The applicant has been primarily employed in this state in an area of practice defined by W.S. 33-38-102(a)(iv) through (vii) within two (2) years prior to December 31, 1997; and
4. (d) The applicant should demonstrate their integrity, professionalism and character in the profession in which certification is sought through professional recommendations which attest to the applicant's abilities and professional performance.

Section 2. Certified Social Worker. In addition to the requirements established in Section 1, applicants for certification as a Social Worker by exemption must also meet the following criteria:

1. (a) The applicant has satisfied the education requirement established in Chapter 5, Section 2(a), and
2. (b) The applicant has satisfied the supervision requirement established in Chapter 5, Section 3, and the designated clinical supervisor requirements established in Chapter 5, Section 4.

Section 3. Certified Addictions Practitioner. In addition to the requirements established in Section 1, applicants for certification as an Addictions Practitioner by exemption must also meet the following criteria:

1. (a) The applicant has satisfied the education requirement established in Chapter 5, Section 2(b), or meets the educational equivalency as follows:
2. (i) The completion of a baccalaureate degree program in a human resource discipline, with either an associates degree or a concentration in addictionology, chemical dependency, or substance abuse from an accredited program and institution of higher education, or
3. (ii) A baccalaureate level equivalency in addictions therapy of fifty (50) points. At least two (2) points must be relative to professional ethics and at least four (4) points must be relative to work experience. Points shall be awarded as follows:

(A) One (1) semester credit equals one (1) point.

(B) Fifteen (15) workshop hours equals one (1) point.

(C) One (1) year of full time related work experience equals twelve (12) points. Points will be awarded for partial year or part time employment on a prorated basis.

(D) Passing the WAAS level III exam equals two (2) points.

(E) Passing the NCAC level II exam equals three (3) points.

(F) Passing the NCAC level I exam equals two (2) points.

(b) The applicant has satisfied the supervision requirements established in Chapter 5, Section 3, and the designated clinical supervisor requirements established in Chapter 5, Section 4.

Section 4. Certified Mental Health Worker. In addition to the requirements established in Section 1, applicants for certification as a Mental Health Worker by exemption must also meet the supervision requirement established in Chapter 5, Section 3, and the designated clinical supervisor requirements established in Chapter 5, Section 4.

(a) A Certified Mental Health Worker shall not be granted re-certification if the certification is allowed to lapse.

(b) A certification as a Mental Health Worker shall not be issued by the Board after July 1, 1998.

(c) The term “Certified Mental Health Worker” may be used only after the applicant is granted certification by the Board, and only in conjunction with activities and services that are part of the supervised employment.

(d) In the required professional disclosure statement, the Certified Mental Health Worker shall also provide to every client, full disclosure of the supervised nature of their work, including the name, address and telephone number of their designated clinical supervisor.

(e) The supervisory relationship must be indicated, and the designated clinical supervisor’s name, address and telephone number must appear on all documents relating to advertisement by the Certified Mental Health Worker.

(f) The Certified Mental Health Worker shall adhere to the code of ethics and standards of practice which apply to the Licensed Professional Counselor.
