Section 1. Rules of Professional Conduct. All outfitter and professional guide licensees shall comply with the following rules of professional conduct: (a) A licensee shall not submit any materially false statements or fail to disclose any material facts requested in connection with his application for licensure. (b) A licensee shall not engage in fraud, deceit, misrepresentation or concealment of any material fact in advertising, soliciting or providing professional services to members of the public. (c) A licensee shall not engage in any activity which results in conviction of a felony. (d) A licensee shall comply with all local, state and federal laws and regulations pertaining to wildlife, game and fish. (e) A licensee shall cooperate fully with private landowners and public land management agencies and shall respect their rights and privileges.
(f) A licensee shall advise clients of all applicable conservation and game laws and must not condone or willfully allow their violation. (g) A licensee shall promptly report any violation of federal or state law or regulation governing wildlife, game and fish observed by him to any commissioned game and fish law enforcement officer,
representative of the involved federal land management agency or to the Board. (h) A licensee shall not operate in any area for which he has not obtained authorization from the Board. If licensee shows an area for which he was not authorized on his year end report he shall receive a written reprimand upon first violation. Upon second violation the licensee will be requested to appear before the Board to explain his/her actions, and may be subject to suspension and/or revocation. (i) A licensee shall not engage in any activity for which the licensee is not licensed. (j) A licensee shall not substantially breach a contract with any person using outfitting or professional guide services of the licensee. (k) A licensee shall not willfully violate the terms and conditions under which the license is issued.
(l) A licensee shall provide any animal used by the licensee in the conduct of his business with proper food, drink and shelter and shall not subject any such animal to needless abuse or cruel and inhumane treatment. (m) A licensee shall maintain neat, orderly and sanitary camps at all times, provide clean, fresh drinking water, protect all food from contamination, and dispose of all garbage, debris and human waste in the manner prescribed by regulations concerning use of public lands. Livestock facilities shall be separate from camp facilities. Streams shall be protected from contamination. (n) A licensee shall not willfully endanger the health and safety of any person. (o) A licensee shall provide a licensed guide for each two (2) hunters in wilderness areas and up to six (6) in the rest of the state.
(p) A licensee shall not engage in any activity(ies) which is inappropriate to the conduct of the outfitting and guiding profession. (q) A licensee shall provide hunters with a brochure or statement which clearly states his refund policies. (r) A
licensee shall provide the Board, on their new application or on their renewal application, a statement which clearly states his refund policy. Said policy can not be changed during the year unless said change is approved by the Board prior to the time said change will be effective. (s) A licensee shall not violate any provision of W.S. 23-2-406 through 23-2-417. Section 2. Action against outfitters and guides who operate without a license. All individuals who outfit or guide in the State of Wyoming must be licensed by this Board unless specifically exempted under the provisions of W.S. 23-2-406 through 23-2-417. Individuals who outfit or guide without a valid license will not be eligible to apply for or receive a license for a period of three years after their first violation of practicing without a license. If there is a second violation of practicing without a license they will not be eligible to apply for or receive a license from this Board for a period of five years. A third violation of practicing without a license will make them permanently ineligible from applying for or receiving a license to outfit or guide from this Board.
Suspension and Revocation. Failure to comply with any provision of the Rules and Regulations of the Board shall be grounds for suspension for a period not to exceed three (3) years or revocation of any outfitter or professional guide license issued by the Board. Suspension and revocation proceedings shall be conducted in accordance with the Wyoming Administrative Procedure Act and the Rules and Regulations of the Board. Section 4. Reinstatement. Upon written application, after hearing and for good cause shown, the Board may reissue a license which has been revoked or modify the suspension of any license which has been suspended.
