Section 1. Application for and Issuance of New Outfitter Licenses and Area Authorization. Any person desiring to operate as an outfitter and who qualifies as set forth in W.S. 23-2-411 may make application for an outfitter license for the type desired on forms provided by the Board (Figure 1 and 2). The application must be completed by the outfitter applicant and returned to the Board together with the new applicant fee. The study material for the exam will then be mailed to the applicant. This fee is non-refundable.
(a) A new applicant will show the hunt area(s) in which he desires to operate and will provide all information as provided for on the operation plan form provided in Figure 8, which is part of this regulation. Outfitters may operate only in those areas approved on the operation plan, except as provided in paragraph (e) of this section.
(b) Applicants for outfitter licenses must submit a letter of intent from an insurance company indicating they will insure the applicant if his license is approved. Insurance must be in effect during the entire licensing period. If insurance is not in effect, the license will be void.
(c) Prior to final approval of an outfitter license, the applicant shall secure written endorsement from the public land agency, landowner or lessor for the areas shown on the operation plan (see Figures 3 & 4). If permission is by landowner a 'Surface Management Status Map' must be submitted showing the intended areas of operation.
(d) All new applicants for outfitter licenses shall appear in person before the Board unless waived at the discretion of the Board and must pass an equipment and/or camp inspection before the license is issued. An applicant may also agree to sign a waiver regarding this inspection (see Figure 11).
(e) Licensed outfitters may apply for supplemental area authorization(s) on the application form provided in Figure 6, which is part of this regulation.
(f) The Board shall retain final authority regarding license issuance and hunt area authorization. The Board may restrict the species and the hunt management unit where an applicant may operate or outfit hunting clients.
(g) All area authorization permits must be issued in the name of the outfitter.
(h) There is a new applicant fee not to exceed five hundred dollars ($500.00) for all new applicants which must be submitted with the original application.
The fee will be set by the Board before December 31st of each year.
(i) An applicant for a new outfitters license must have experience as a licensed professional guide for not less than one (1) year or similar experience accepted by the Board. The applicant may submit a letter of reference from a licensed outfitter and must show knowledge of the area for which he is applying.
Section 2. Examination for Outfitters. New applicants for outfitter licenses will be given an examination prior to filing of the application. The examination will test the applicant's knowledge of game and fish laws, Board of Outfitters rules and regulations and laws, Forest Service and BLM outfitting policies, and first aid. Exam will include habits of game sought, hunting techniques, care of meat and trophies and applicable firearm laws.
An examination for a new outfitter license for the current year will be given once a month during January through June. The exam will be given once a month during July through December for the following year. Applicants must make an appointment no less than fourteen days in advance. The examination will be a closed book test. Passing the examination will constitute receiving a score of at least seventy-five percent (75%). Any person failing to pass an examination may again be given an examination after thirty (30) days. An applicant who fails the examination twice in a calendar year will not be eligible to retake the examination until the following calendar year.
Section 3. Outfitters to Submit Required Report. Each licensed outfitter shall be required to submit a report and affidavit covering the calendar year for which the license was obtained on a form as is provided in (Figure 7 and 7A) which is part of this regulation. The report information shall be legible, accurate, complete and verified by a notary public. Reports shall be submitted to the Board by January 31 of each year. A license will not be renewed until this report has been submitted.
Section 4. Renewal of Outfitter Licenses. No outfitter license may be renewed after midnight January 31 of each year. Any application received after this cutoff date will be treated as a new application.
An outfitter license may be renewed and the same license number retained if the applicant is not applying for additional areas(s) or services upon submission of the following by January 31 of the year for which a license is sought.
(a) A completed outfitter license renewal application form (Figure 5);
(b) The required report on the form provided in Figure 7 and 7A as set forth in Section 3 of this chapter;
(c) An original Certificate of Insurance;
(d) The three hundred dollar ($300.00) outfitter license fee.
When an applicant has failed to utilize and report clients hunted in an area for a period of three (3) years, he will lose his previous authorization for that area and species.
The applicant must provide proof of hunting license denial for that hunt area and species to retain authorization, or apply for supplemental authorization with the name and license number of the client to be outfitted.
Section 5. Application for and Issuance of Professional Guide Licenses. Any person desiring to operate as a professional guide and who qualifies as set forth in W.S. 23-2-412 may make application for a professional guide license as shown in (Figure 9) which is part of these regulations.
The application must be completed by the professional guide applicant and returned to the Board together with the seventy-five dollar ($75.00) annual license fee or twenty-five dollar ($25.00) license fee for a fourteen (14) day permit. An applicant may receive only one fourteen (14) day permit in any twelve (12) month period.
A professional guide license issued by the Board is valid only while the professional guide is employed by or under contract with a licensed outfitter. The licensed outfitter by whom the professional guide is employed shall sign the back of the professional guide's license and put his outfitter license number in order to validate the professional guide's license.
Professional guides employed by a landowner exempted from the outfitter licensing act shall have the landowner sign the back of the professional guide's license in lieu of an outfitter.
Professional guides covered under the liability insurance of a licensed outfitter shall not be required to furnish a separate certificate of insurance.
There is an application fee not to exceed fifty dollars ($50.00) for all new professional guide applicants.
Section 6. Examination for Professional Guides. New applicants for Professional Guide licenses will be given an examination prior to issuance of the license. The examination will test the applicant's knowledge of game and fish laws, Board of Outfitters rules and regulations and laws, Forest Service and BLM policies, and first aid. Exam will include habits of game sought, hunting techniques, care of meat and trophies and applicable firearm laws.
Passing the examination will constitute receiving a score of at least seventy-five percent (75%). Any person failing to pass an examination may again be given an examination after thirty (30) days.
Section 7. Renewal of Professional Guide Licenses. A professional guide license may be renewed upon submission of the following: (a) A completed professional guide application form; (b) The seventy-five dollar ($75.00) annual professional guide license fee, or the twenty-five dollar ($25.00) fourteen (14) day professional guide license fee.
Section 8. Proof of Licensure Required. Licensed outfitters and professional guides must carry proof of licensure at all times when providing outfitting or professional guide services.
