RULES GOVERNING CONTESTS BEFORE THE WYOMING RETIREMENT BOARD AS ADMINISTRATORS OF THE STATE EMPLOYEES AND TEACHERS RETIREMENT ACT, GAME AND FISH WARDEN, HIGHWAY PATROL AND CRIMINAL INVESTIGATOR RETIREMENT ACT AND THE PAID FIREMENS PENSION REFORM ACT, 1981
CHAPTER 1
GENERAL PROVISIONS
Applicant-The employee, their designated beneficiary, surviving spouse, dependent children, or dependent parents.
Application-The application required to be filed with the Disability Committee by those claiming benefits or pensions under any retirement act.
Pleadings-Pleadings shall consist solely of the application and affidavits for benefits or pensions under all retirement acts.
Presiding Officer-The presiding officer at all hearings provided for by these rules shall be the Chairman of the Disability Committee, or an officer qualified by reason of W.S. 163-112, or such other person as may be designated by the chairman of the Wyoming Retirement Board.
Board-The Board shall consist of the Wyoming Retirement Board as outlined in W.S. 9- 3-404, as amended, and in the case of hearings or applications for disability benefits board means the Disability Committee of the Wyoming Retirement Board.
Disability Committee-There shall be a disability committee appointed by the Chairman consisting of three (3) to five (5) members of the Wyoming Retirement System Board. The committee shall review applications for disability retirement. It may require the applicant to submit evidence of the disability relied upon as qualifying him for disability benefits. It may require the applicant to submit to a medical examination by an appropriate medical specialist of the committees choice before considering the application. It may appoint hearing officers pursuant to W.S. 163-112 and conduct hearings itself or by a hearing officer pursuant to the Wyoming Administrative Procedure Act (W.S. 16-3-101 through 16-3-115).
Medical Examination means an examination conducted by a doctor licensed to practice medicine that includes a diagnosis of the applicants physical or mental condition, treatment being provided for any disability, prognosis and classification of any disability.
Total Disability which is a disability condition that renders an employee unable to engage in any occupation for which he is reasonably suited by training or experience and which is reasonably expected to last at least twelve (12) months; and
Partial Disability which is a disability condition that renders an employee unable to perform the occupation for which he is reasonably suited by training and experience but still allows him to function in other employment and which is reasonably expected to last at least twelve (12) months.
