(a) The protection of the public health, safety and welfare and the best interest of the public shall be the primary guide in determining the appropriate professional conduct of all individuals whose activities are regulated by the Board.
(b) The current Ethical Principles as promulgated by the APA shall be used by the Board to provide guidelines to ethical standards for all individuals licensed or certified under W.S. 33-27-113 through 33-27-123. Any violation of the Ethical Principles shall be a violation of these rules.
The Board may suspend, revoke or deny licenses or certificates and take other disciplinary action for any of the following reasons:
(a) Fraud, deception or misrepresentation in applying for a license or certificate, in taking an examination, or in rendering services;
(b) Immoral, unprofessional or dishonorable conduct.
(c) Practicing psychology or school psychology in such a manner as to endanger the welfare of clients or patients;
(d) Conviction of a felony;
(e) Harassment, intimidation or abuse, sexual or otherwise, of a client or patient;
(f) Engaging in sexual intercourse or other sexual contact with a client or patient;
(g) Practicing outside the areas of professional competence as established by education, training and experience;
(h) Gross or repeated malpractice or gross negligence in the practice of psychology;
(i) Aiding or abetting the practice of psychology or school psychology by individuals not licensed or certified by the Board;
(j) Conviction of fraud in filing Medicare or Medicaid claims or in filing claims to any third party payor.
(k) Exercising undue influence to exploit a client, patient, student or supervisee for financial or other personal advantage to the practitioner or a third party;
(l) The suspension or revocation by another state of a license to practice psychology. A certified copy of the order of suspension or revocation shall be conclusive evidence thereof;
(m) Refusal to appear before the Board after having been ordered to do so in writing by the executive officer or Chair of the Board;
(n) Making any fraudulent or untrue statement to the Board;
(o) Violation of the current APA Code of Ethics;
(p) Inability to practice psychology with reasonable skill and safety to patients or clients by reason of illness, or as a result of any mental or physical condition;
(q) Addiction to alcohol, narcotics or other habit-forming drugs;
(r) Willfully or negligently violating any of the provisions of the Act;
(s) Failure to meet the requirements for licensing or certification set forth herein;
(t) Revealing the content of privileged communications, except as required by an established court of law, or as stipulated in the current APA Code of Ethics and as provided in W.S. 33-27-123.
(u) Conviction of any crime or offense that reflects the inability of the practitioner to practice psychology or school psychology with due regard for the health and safety of clients or patients; or
(v) Violation of a Board decision or order.
