(a) The protection of the public health, safety and welfare shall be the primary guide in determining the appropriate professional conduct of all licensees.
(b) The current National Code of Ethics as promulgated by the APTA is adopted by the Board. Any violation of these ethical standards shall be a violation of these rules.
In addition to prohibited acts set forth in the Act, the Board may suspend, revoke or deny licenses and registrations and take other disciplinary action for any of the following reasons:
(a) Fraud, deception, or misrepresentation in applying for a license or registration, in taking an examination, or in rendering services;
(b) Immoral, unprofessional, or dishonorable conduct;
(c) Practicing physical therapy in such a manner as to endanger the welfare of clients or patients;
(d) Conviction of a felony;
(e) Harassment, intimidation, or abuse, sexual or otherwise, of a client or patient;
(f) Practicing outside the areas of professional competence as established by education, training, or experience;
(g) Gross or repeated malpractice or gross negligence in the practice of physical therapy;
(h) Aiding or abetting the practice of physical therapy by individuals not licensed or registered by the Board;
(i) Conviction of fraud in filing Medicare or Medicaid claims or in filing claims to any third party;
(j) Exercising undue influence to exploit a patient, student or supervisee for financial or other personal or third party advantage;
(k) The suspension or revocation by another jurisdiction of a license or registration to practice physical therapy. A certified copy of the order of suspension or revocation shall be conclusive evidence thereof;
(l) Refusal to appear before the Board after having been ordered to do so;
(m) Making any fraudulent or untrue statement to the Board;
(n) Violation of the current National Code of Ethics as established by the APTA;
(o) Inability to practice physical therapy with reasonable skill and safety to patients or clients by reason of illness, or as a result of any mental or physical condition;
(p) Addiction to alcohol, narcotics or other habit-forming substances;
(q) Willful or negligent violation of any provisions of the Act or these rules;
(r) Failure to meet the requirements for licensure set forth herein;
(s) Conviction of any crime or offense that reflects the inability of the licensee or registrant to practice physical therapy with due regard for the health and safety of clients or patients;
(t) Violation of a Board decision or order;
(u) Failure to post information as required by the Act; or
(v) Failure to refer a patient as required by the Act.
