Section 1. Authority. These regulations are promulgated pursuant to the Wyoming Pharmacy Act, W.S. 33-24-101 to 33-24-151.
Section 2. Records Information - Confidentiality. The following information and records are deemed to be confidential to wit:
a) applications for licensure by examination or reciprocity. b) examination scores c) personnel records d) inspection and/or investigation reports e) permanent ledger (or record) entries for registered pharmacists f) intern evaluation reports.
All other information and records are deemed to be public subject only to the provisions of Chapter 145, Session Laws of Wyoming, 1969 [WS 9 - 629.1 et seq.] - INSPECTION OF PUBLIC RECORDS Act.
Section 3. Minimum Equipment and Stock Requirements to Open and/or Operate a Pharmacy. Every pharmacy must be equipped with proper pharmaceutical utensils so that prescriptions can be properly filled and compounded. The board subscribes a minimum of professional and technical equipment which a pharmacy shall at all times possess.
a) The necessary equipment for dispensing and compounding shall include, but not be limited to: (i) Graduates (4) capable of accurately measuring volumes from one minim to one pint and from 1 cc. to 500 cc. ii) Mortars and Pestles - glass, two sizes. iii) Spatulas - steel and non-metallic iv) Funnels - assorted sizes v) Stirring rods.
vi) Pill tile, ointment slab or ointment pads.
vii) Filter paper, powder papers.
viii) Empty capsules - various sizes.
ix) Ointment jars - various sizes.
x) Prescription record book or patient profile record, poison record book and Schedule V Controlled Substances record book.
xi) Bottles - clear and amber glass, necessary sizes.
xii) Suitable containers for capsules, including light inhibiting types.
xiii) Prescription Balances - Class 'A' sensitivity.
xiv) Weights - Metric - from 10 mg. to 20 Gm. Weights shall be furnished with a wooden or plastic box to serve as protection against damage and the set shall have tweezers for handling weights.
xv) Prescription files, regular and special labels, including those to be used for poisons.
xvi) Typewriter, numbering machine.
b) The prescription area shall be a suitable, well-lighted, and well-ventilated room or department with clean and sanitary surroundings devoted primarily to the compounding of prescriptions, the manufacture of pharmaceutical preparations, and the operations necessary to determine strength and purity of medicines.
c) Any new pharmacy or any existing pharmacy which is remodeled or changing location must comply with the following provisions:
i) The are devoted to the prescription department and laboratory shall not be less than 150 sq. ft.
ii) The prescription department of any new or remodeled pharmacy shall be so designed that the door entrances may be locked, so as to prevent entrance to the department if a pharmacist is not on duty.
iii) There shall be a prescription counter on which to work and the free working surface shall not be less than eighteen inches in width and not less than twelve continuous square feet in area. This minimum free working surface must be kept clear at all times for the compounding of prescriptions and other pharmaceutical manufacturing.
e) The free floor space behind the prescription counter shall not be less than thirty inches in width.
f) An adequate sink equipped with running cold and hot water shall be available for the prescription department during the hours the pharmacy is normally open for business.
g) There shall be sufficient shelf, drawer or cabinet space for proper storage of a representative stock of labels, an assorted stock of prescription containers and adequate stock of prescription drugs, chemicals and other required equipment.
h) The professional reference library must contain: U.S. Pharmacopeia and Supplements (latest edition) and all Wyoming Pharmacy Laws and Regulations.

Section 4. Examinations for Registration. Examinations of candidates for registered pharmacist will be at such meetings as the board may deem advisable. Candidates may be examined on the following subjects: Pharmacy, Chemistry, Pharmacology, Mathematics, Jurisprudence and Practical Work. These subjects may be changed at the discretion of the board.
a) The candidates will be required to make an average grade of 75 percent and not less than 60 percent in any one subject, and must achieve a grade of at least 75 percent in the practical work examination, in order to be entitled to a certificate as a registered pharmacist.
b) Applications for examinations must be completed and forwarded to the Executive Director of the board at least ten days prior to the date of the examinations and must be accompanied by the proper fee.
Section 5. Reciprocal Registration. Any pharmacist who registered by examination and is in good standing in any state which is an active member of the National Association of Boards of Pharmacy, and who desires to register by reciprocity into Wyoming, shall proceed in the manner outlined by the National Association of
Boards of Pharmacy after first submitting the 'Preliminary Application for Reciprocal Licensure', obtained from the Executive Director of the board.
a) The Wyoming Board will recognize the qualifications of the applicant as determined by the National Association of Boards of Pharmacy. Persons who have become registered as to satisfy only the requirements which existed in this state at the time they became registered in the other state, provided that the state in which said person is registered shall under like conditions grant reciprocal registration as pharmacist, without examination, to pharmacists duly registered by examination in this state. The board reserves the right to reject any application.
b) In the event of rejecting an application, the fee paid to the board will be refunded. No applicant for reciprocal registration who has previously taken the Wyoming examination and failed will be accepted, unless he can show satisfactory evidence of having acquired increased proficiency in the knowledge and practice of pharmacy equivalent to that required in the Wyoming examination.
c) All applicants must have an oral interview with the members of the Wyoming Board before reciprocity is granted. Knowledge of all Wyoming Pharmacy Laws and Regulations, as well as evidence of good moral character and competence, must be demonstrated by the applicant.
Section 6. Pharmacy Must be in Daily Charge of a Registered Pharmacist. Every licensed pharmacy must be in the continuous daily charge of a registered pharmacist. Being in charge means having direct control of the pharmaceutical affairs of said pharmacy.
a) A non-pharmacist owner must comply strictly with the above provisions and provide a manager who is a registered pharmacist and give him complete control over the pharmaceutical affairs of said pharmacy. The registered pharmacist shall have the personal management of not more than one pharmacy at the same time.
b) Responsibility as a pharmacy manager is to see what all Pharmacy Laws, Rules and Regulations are complied with and enforced including limitations of interns. It shall be the duty of the registered pharmacist manager to report all pharmacy violations to the Board of Pharmacy or delegated officials of the board.
c) The license of any pharmacy shall be void if the registered pharmacist in whose name the store license was issued ceases to be engaged in such pharmacy as manager and the owner shall suspend the sale of drugs until he has employed a registered pharmacist and has made application for another license.
d) The registered pharmacist in whose name the license was obtained shall at the time he ceases to be employed in such pharmacy, immediately, report to the Executive Director of the board the fact that such pharmacy is no longer under his supervision. The owner of said pharmacy shall do likewise and surrender the pharmacy license.
e) In the absence of a registered pharmacist from a licensed pharmacy, the prescription department must be locked and kept so until his return and a sign saying 'Prescription Department Closed - No Registered Pharmacist on Duty' shall be conspicuously posted.
f) The employment of a registered pharmacist in a licensed pharmacy shall be on a bona-fide, daily basis for the operation as pharmacy and not under subterfuge.
a) All licenses and certificates issued by the Wyoming State Board of Pharmacy shall be displayed in a prominent place and always in view to the public.
b) A pharmacy license issued by the board is not transferable to a new owner of a licensed pharmacy. A new license must be applied for to the Pharmacy Board by the new owner and is subject to the same requirements as if a new store were being opened and licensed.
Section 8. Prohibition of 'Drug' Signs. No store shall display signs inside or outside using the word 'DRUG', 'DRUGS', 'PHARMACY' or other terms that might indicate or signify by any advertising medium that such establishment is a licensed pharmacy and equipped to prepare and dispense drugs and medicines under the meaning of the Pharmacy Act, unless such establishment has been licensed as a pharmacy by the Wyoming Board of Pharmacy.
Section 9. 'Legend Drug' - Non-Refillable After Two Years. A prescription specifying a drug labeled with this Federal Legend - 'Caution - Federal Law Prohibits Dispensing Without Prescription' - shall not be refilled if the prescription is more than two years old. In instances where the medication is to be continued, authorization must be obtained from a physician and a new prescription must be filed.
Any directives by the prescriber on the prescription are subject to this regulation.
Section 10. Record on Refills. The following information must be recorded in a readily retrievable manner when such prescription is refilled: Date filled, Quantity, Pharmacist's name or initial, Name or identity of authorizing agent.
Section 11. Prescription Copies. A copy of a prescription is not a prescription. A pharmacist shall not use a copy of a prescription except for reference purposes. A pharmacy in which a prescription is on file may furnish a written copy thereof to the patient or his authorized representative if copy is clearly marked 'Copy - for reference purposes only.' A pharmacist who furnishes a written copy of a prescription pursuant to this subdivision shall record on the prescription itself the name of the person to whom the copy was furnished and the date such copy was furnished.
Section 12. Labeling Prescriptions. All original or refill prescriptions shall be labeled by the pharmacist filling the prescriptions and the label must show the name and address of the pharmacy, the doctor's name, number of the prescription, date filled, directions for use and the license number of the pharmacist dispensing the prescription.
Section 13. Doctor - Patient Relationship as Affecting Prescriptions. Any prescription prescribed by an authorized practitioner is considered null and void, upon the death of the prescribing practitioner of that prescription - or when said authorized practitioner retires from practice or moves to another area so that the Doctor-Patient relationship cannot be determined.
Section 14. Return of Drugs Prohibited. The return or exchange of drugs is prohibited and a copy of the following ruling shall be furnished to all licensed pharmacies within the state:
"Drugs, medicines, sick room supplies and items of personal hygiene shall not be accepted for return or exchange by any pharmacist or pharmacy, after such drugs, medicines, sick room supplies or items of personal hygiene have been taken from the premises where sold, distributed or dispensed."
Section 15. Responsibilities of Wyoming Registered Pharmacists. Wyoming Registered Pharmacist shall:
a) Be in continuous daily physical charge of pharmacy.
b) Provide and maintain a clean dispensing area, proper storage facilities, maintain a system for checking outdated pharmaceutical.
c) Be responsible for complying with all pharmacy and controlled substances laws and regulations. (Federal and state)
d) Supervise and be responsible for all interns under his preceptorship and issue proper internship reports.
e) Supervise and be responsible for any ancillary personnel in pharmacy department.
f) Select brands of pharmaceutical and the suppliers.
t) Be responsible for the certification of drug handling procedure at drug stations in institutions.
May be performed by a Wyoming licensed pharmacist intern under direct supervision of a Wyoming registered pharmacist.
