Section 1. Issuance of License. The Board shall issue to the successful applicant a license bearing the full name of the Licensee, date of issuance, license number and appropriate seal.
(a) Prior to engaging in the practice of optometry the Licensee shall notify the Board in writing of their business address.
(b) Upon retirement from active practice the Licensee shall notify the Board in writing.
(c) The Licensee shall notify the Board if a license is lost, stolen or destroyed.
(d) Duplicate wall certificates may be issued by the Board. All requests for duplicate certificates must be in writing and must be accompanied by the appropriate fee.
(a) The Board shall mail a renewal notice to active licensees at their address of record no later than forty-five (45) days prior to the license expiration date.
(b) License renewal fees shall be postmarked no later than the expiration date.
(c) Failure to receive notice for renewal of license from the Board shall not excuse a licensee from the requirement for renewal under the Act and these rules.
Section 3. Continuing Education. As a condition for renewal, each Licensee is required to complete a total of thirty (30) hours of continuing education over a period of two (2) calendar years encompassing the subjects of Contact Lenses, Primary Care (Disease), VT, Practice Management and General Optometry.
(a) Hours shall be completed by attending, in person, classes which have been certified by the Board and cannot be completed by correspondence.
(b) Continuing education hours will initially be required in the two (2) calendar years following the first renewal period.
(c) Licensees who are currently authorized to prescribe therapeutic pharmaceuticals are required to obtain at least ten (10) hours of the total of thirty (30) hours of continuing education in topics addressing ocular systemic therapeutics.
(d) A maximum of four (4) hours of continuing education in the area of Practice Management shall be applied towards the total thirty (30) hours.
(e) Verification of attendance must be submitted, on forms provided by the Board, prior to the renewal of the license.
Section 4. Failure to Renew. Any person engaging in the practice of optometry who has not renewed their license on or prior to the expiration date is in violation of W.S. 33-23-103 and subject to any and all remedies allowed by law and these rules.
(a) The Board shall revoke any license which has not been renewed on or before April 1 following sixty (60) days notice provided to the Licensee.
(i) If a written request for hearing is received by the Board from the license holder within fifteen (15) days after the notice provided, the Board shall set the matter for hearing within thirty (30) days. The license holder shall be notified twenty (20) days prior to the hearing which will be conducted in accordance with Chapter 9 of these rules. The Board shall make its order in writing within ten (10) days following the hearing.
(b) Within the sixty (60) days notice period, a license may be renewed upon payment of the renewal fee as well as a penalty of ten dollars ($10.00).
(c) The provisions of this section do not apply to those license holders who have properly notified the Board of their retirement from active practice.
Section 5. Renewal Following Retirement. If an optometrist has properly notified the Board of retirement from active practice as required in Section 1(c) of this Chapter, that optometrist may renew his/her license to practice optometry in Wyoming for a period not to exceed three (3) years from the retirement date reported previously to the Board upon payment of the renewal fee for each year the license was in lapse as well as a penalty of ten dollars ($10.00). In addition to the renewal fees, an optometrist must submit to the board verification of attendance of no less than fifteen (15) hours of approved continuing education for each year of his/her retirement.
